what i assumed happened is that she posted the initial video and then someone informed her the product was on Alibaba, or someone suggested that they may not be an American company. because it wasn’t until after her initial video that they reached out and she realized they wouldn’t FaceTime, so before she worked with them, it might’ve not raised any flags

Aliexpress and Alibaba actually sometimes steal from brands. My husband owns his own brand, and he has had his design stolen and attempted to be “sold” on Alibaba, he had to contact the sellers and ask them to remove it, because it’s theft! Not saying that’s the case here, but I would be pissed if someone thought my husbands design wasn’t his own just because Alibaba stole it and was selling it

I just want to clarify that it isn't AliExpress or Alibaba who steal from brands, it is individual sellers on there. That's like saying eBay steals when a seller sells a knock-off, it's on their platform and I think they should be more responsible but they aren't the ones who took the bad action and are lying to potential customers. I think in general platforms need to crack down on not just counterfeit products but ones deliberately sold as being the real thing. People stealing other people's art is a huge problem and it is on the poor real creator to get the scammers to remove the items or take legal action to force them. With technological advancements I don't see why improvements can't be made to review a claim of some copying a design, or to flag possible counterfeits.

not all makeup is the same, but I see what you mean. most TikToks don’t have two things that any good “review” requires: credibility and context. most of the time when you are just scrolling on TikTok, the (most likely ad) videos that you see are not necessarily from people you can automatically trust, and there certainly is not enough time to add proper context about the product. to be fair though, instagram and a lot of other platforms can be the same way… and I for one am definitely guilty of being influenced by instagram 🙊

Hi, I'm an IP lawyer who does influencer agreements for brands. All of our contracts contain a clause that says that all content must follow all advertising guidelines, regulations, etc, applicable to the influencer's engagement by the brand, and all content needs to be reviewed for approval by the brand prior to publication on social media. In my opinion, a lot of brands have these clauses in place but are choosing to let the non-disclosures slide (because it benefits them) on the basis that they can always go after the influencer if they get into trouble because the contract makes it the influencer's responsibility.

Hi! Also IP lawyer here (but more on the patent prosecution side so feel free to correct me if you have more experience in federal litigation). I think this would still be a problem for the brands if the feds come knocking even if they can blame the influencers. Generally there would be evidence that the brands knew or should have known that their products were being advertised unlawfully, thereby making them at fault contributorily. Do you see what I’m saying?

Med mal is rife with it; hospitals will not change their procedures that injure patients because the cost of improving care is higher than that of paying for the occasional wrongful death/med mal settlement. Its kind of a new form of bribery. Influencer teases brand with their willingness to be bought by mentioning the brand. The brand then reaches out to the influencer with grifts , I mean gifts and money, because that's the way to get an unbiased opinion right? Then the influencer does a hard sell to their followers possibly earning a commission 🤔 for that " unbiased opinion " making mega sales without full disclosure . Huh, maybe its just a shit pile of lies. Governing bodies need to do more.

It’s always been the case that if a creator gets done by the FTC so will the brand. Both get done for every link & every product not disclosed is a seperate fine for both. PR has a financial value therefore that must be disclosed also. The paid ad is a tool or prompt, not a disclaimer as such. The disclaimer at bottom of video is also not acceptable- they know all this they just think we are all stupid & they are untouchable.

Manufacturing is difficult to prove, our company disclosures often say “made in NZ with at least 90% local ingredients” so it could be something to do with the way they’re not required to specify correctly. It’s all about wording. You can see who owns the brand with the barcode number, but that also isn’t foolproof. It also could be the bottle is manufactured in China and the product is made in America, and they’re not required by law to specify?

She’s is not a real makeup artist, nor is she certified in Massachusetts (hence why her only videos of her doing someone else’s makeup is her mother and “husband.”)

This is one reason I kind of stepped away from TikTok because of how much stuff is ad content but not ad content. It’s boring and I am just over it. If it’s not ads it’s dances or someone’s drama. I literally have enough drama in my own life I don’t need anyone else’s. I also don’t come online to see ads. This should be said more and I agree anytime I see videos that are clearly ads and they don’t disclose it I just report it. Worst they get fined, and if it’s not an ad then they can provide that info and get let off.

I'm patiently waiting...and have been for a while...for someone to finally be penalised for not disclosing partnership. Idk why laws are not being implemented🤷🏻♀️ Thank you for talking about this. Perhaps something will change if more people talk about it. Hopefully...

i find it funny how people always bring out the pitchforks for mikayla putting the “partner” at the end of the caption, yet SO MANY other influencers do it too yet everyone cheers them on telling them to get their bag.. one example is Jordan, her partnership with Morphe is at the end of the caption yet not one single comment about it. If y’all are gonna be haters at least be consistent with what you stand for. don’t cancel one, yet praise another for doing the same exact thing.

I think when tiktok shops promotes your video they can change the link on your yellow basket and change it to theirs so you won't get the sale but rather it directly goes to the shop. No matter how many views or sale the product gets, if it bypasses your account, you won't get a commission.
