My understanding is that these flags in particular were burned after being taken down from a monument or near a federal building (government property). Basically stealing then burning it. That's illegal no matter how you slice it. Now, the Supreme Court protects flag burning as a 1A freedom, but from my knowledge, that protects you, like if you bring a flag to a protest and you burn it, but it's your flag (you bought it or were given it, but it's your property.
