I just can’t believe zoom hearings and trials are still a thing. I really, really think they should try and end remote judicial proceedings as soon as possible. It just isn’t the same as all parties being in a room, especially in a criminal trial. If I was a defendant I would not like this format at all. And as a judge you have to put up with the implied informality of people sitting at their kitchen table. It needs to stop.

@@smoorej Judge Middleton just had his first in-person trial the other day, a common-law divorce. It's up on his channel, complete with witnesses and everyone all in the courtroom. They still stream it, with just the split screen, but you see a wide shot of everyone in the room with him. I guess this means that they're starting to phase out virtual Zoom court.

Boy, this case is a mess. I went to court with a woman I was caregiving for and she had filed to evict a tenant that had been in her house for 7 years, three of them rent free (in exchange for work that wasn't done). NO written contract. The judge listened to each side, took each side to task and both sides didn't get everything they wanted. She was livid, but I told her the judge has to make decisions that not everyone will like sometimes. Believe it or not, she rented the property out AGAIN with no written contract. Yeesh. She has since passed away but I will NEVER rent anything to anyone, even free to relatives without something in writing.

This was a sad case. I feel so bad for the mother and the sister. Have you been carching judge Middleton as he starts in the morning? He is singing away. I love it. I wish all judges were like him. He knows everybody. During cases he goes off on tangents about everything. The other day, he was asking people if their related to someone he went to high school with, auctioning off his hair, ect. He's awesome.

I do the same and noticed that some of the songs he sings seem to pair up nicely with the cases he's gonna hear, almost like an inside joke. Listen for it. He's very clever. 🦉

@@HappyHoboRecovery Thank you. I haven't been able to catch what songs he's singing. I use my phone. I need to use my laptop so I can hear them better. He is definately clever. I think he should give teaching lectures on how to be a good judge. What few times I was in court, I had 2 of the worst judges. One went off on me about how ai meed to have back surgery and quit complaining about the pain I'm in. I don't have back problems, nor did I complain about pain. Just as I shouldn't practice law, he shouldn't practice medicine.

As a former Apartment manager, here is what to do if you feel that your landlord is not fixing things. 1st, You have to pay rent. 100% pay your rent. But here is the catch. Contact your local government agency that handles renters rights. You tell them the issues that you are having and the items that need fixed. Once they approve it, you pay your rent to them. They get ahold of the landlord and tell the landlord that the issue need to be addressed and they are holding your rent until the issues are fixed. The landlord cannot evict you. But you MUST pay your rent. Not paying your rent is just going to get you kicked out and sued for back rent. And the landlord will win the lawsuit no matter the reason why you were not paying your rent. You have to pay the rent.

If I remember correctly, the pop up guest was the defendant in the next case. Tenant/landlord cases are scheduled 10 or 15 minutes apart in the Judge's court.

Seemed like Judge Middleton was giving a gentle nudge, nudge, wink, wink. If the family could sort it out themselves there's less strain on everyone and family relationships in the long run, usually. Surprised at the end, that he didn't say you can finish your cigarettes now.

Whenever I get super busy and start feeling a bit stressed about things being a bit messy around the house, I like to watch anything having to do with hoarders. In comparison, my place is immaculate. Makes me feel much better. Watching Judge Middleton having to admonish not one, but two, participants for smoking is an added bonus. Pity this was a civil matter and Deborah wasn't on screen.

It’s boggling, the sheer amount of court time wasted in waiting for everyone to log on, making sure the right people are in the hearing, troubleshooting issues, muting and unmuting mics, and dealing with people whose calls have cut out. I’ve seen a hearing suspended for over an hour because the defendant had to drive to her lawyer’s office to get a decent internet connection. Virtual hearings are more convenient for the parties, but I wonder how much of judges’ limited time they waste.

At work when I know I have to do something on zoom I set everything up beforehand and practice if necessary. It'd be foolish not to! But people who have no idea what they're doing just get on and just . . . expect it to work I guess? For something as important as court you's think people would prepare!

The Gillets will not be moving out for some time. They need the reality check of standing in Court not sitting in their comfort zone. I can imagine "Oh gosh Son you are down on your luck. Stay at my place just till you get back on your feet." "Thanks Mom." Now 40 Years later.........! Good work by Judge M and great input by you Mike. Cheers.

I'd totally read his autobiography. I imagine it would be a fascinating mix of courtroom memories, local characters, county history, anecdotes, common sense legal advice and valuable folksy wisdom. The audiobook version read by him would be even better!

What are they smoking??? I worked in banking for thirty years and POA's can be sketchy at best, people can be taken advantage of and a POA can be revoked at any time. I retired a few years back and the bank had taken a firm stance on the acceptance of a power of attorney. Your distinction between a POA and guardianship is spot on. Guardianship and Conservatorship are much more official than a POA. I saw so many people that were drained of their means through greedy family members and caregivers.

This is the reason that when my family asks me if they can just do a verbal agreement with another family member or friend I tell them 1. Dealing with family is not ideal; 2. If you must, put it in writing; 3. Get an attorney (not me!) who is experienced in that area, it’s usually less expensive than sorting this crap out later!

Whenever adult children still live in their parents apartment or house, they're usually tenants at sufferance. Tenancy at sufferance is basically like the arrangement under which houseguests stay in someone else's home

Judge Middleton wins the patience award daily. I have yet to see one of his Zoom sessions when he doesn’t either have ask someone to stop driving, take off their hat, put out their cigarette, etc, etc. There was even one case where he had to ask the defendant to change his shirt because the shirt he was wearing had an obscenity written across it. Geesh!

This is sad. The son doesn’t have a lot to piss in and can’t pay it because he’s out of work. The mom can’t pay it as she’s on a fixed income and has a debilitating medical condition. This has no winner. Even if they are evicted the house might be a wash, they might need to burn it down if it’s that damaged. Just a horrible situation. I hope you follow up so we can see how it resolves. Best thing would be the son just moves. But if it’s homelessness and staying, he ain’t going.

I'm confused. If they can't pay $563 a month rent, how are they going to pay moving fees, security deposit and rent at an apartment? I'd kinda like to know how far in arrears it is also

Technically that’s why Amy from Keystone is on the call…they’re supposed to help figure that out and can provide assistance. That said - who knows how effective that is.

I went through something similar with properties owned by my mum. My step father had died of cancer and my mum was still working in her eighties. She loved her job and refused to retire. Together they owned several properties where all the tenants had stopped paying rent on when my step father was too ill to collect it. They never heard of the postal service I guess. In order to close out my step fathers business and rentals I got power of attorney over my mum. I immediately put all her properties in my name so I could bring action against the tenants. It was a nightmare and I got rid of the most stubborn ones the others having split in the night owing a lot of money and trashing the properties. The worst culprits were the different municipalities that saw me as a way to make money. I would never rent a property to anyone ever again. I even had one brother involved in this mess. He stole about 65,000 bucks from our mother.

Judge Middleton is so smooth. 👍🏼 In my couple short years of courtroom clerking long ago and far away in CA, I cut my clerking teeth on Unlawful Detainer cases. Early on one day after court the DA strolled by the clerk’s sanctum and told me he had been sitting in the court galley and he really got a kick out of watching my face as one of the defendants/occupants was testifying. It’s been 20 years and all I remember is George telling me, “I got as much a kick out of watching you as I did her dumbass rambling on the stand. You get it”.😆😂

I've had to deal with this far to many times! Basement full of old console TV's, old rotten furniture, once they had passed we had to haul away 13 trailer loads of stuff they had saved? Three bags of bread ties.

Judge Middleton is the kind of judge I'd like to be in front of if something horrible happened. You can he cares about people and will try to help them get back on the right path.

Good way to let People know that going into court for any reason without the full paper work.. representation, Having all ducks in a row is not a good idea. This judge handled it well, not all would be so understanding.

I'm just over here shocked people think that POA allows them to act as an attorney. I'm my mother's POA, I really should be her trustee and I won't do anything other than consent for medical treatment. Ouch 😳

Hey Mike, I think the best thing about your channel and the thing which sets you apart is… you cover a wide variety of things. Today, Ive watched cart narcs with you, a border issue and court. Indiana you can represent someone you have power of attorney in cases in small Claims court.

I’m not a lawyer but I think this is a great demonstration of the idea that lawyers exist for a reason. You can’t take a very complicated situation and apply complex laws without understanding the topic. Just normal landlord-tenant stuff can get complicated but add in all the factors here and if you’re a lay person trying to sort it out you’re doomed. You would have a better chance of landing a commercial airliner than getting this one right. The judge handled this well, planted the seed with the unwanted tenant that it’s probably not going to end well, and urged the owner to get an attorney.

Hey Mike, treats and belly rubs to the boys from me. I just love how Judge Middleton handles all his cases. Ok I am confused, cause you can not smoke in a court room and these hearings are supposed to be just that though on zoom or KZbin.

@ Andrew Vaughan. What about cases involving sovcits & Moors regarding trying to steal properties? Know of any names I can look up? Are they starting to become more frequent in IL? I wish Mike could find some court videos & comment on Cherron Phillips, a.k.a. “River Tali El Bey” and her case(s) against IL public officials. This was around 2014-ish?

It's much the same here in the U.K., people think POA gives them total power over every aspect of someone's life. When in reality it just gives them the duty to act as someone would usually act in the areas where they lack capacity. So if your granny always gave money to the cats home and you’re a dog lover you can't suddenly start giving her money to the dog's home. We have started sending people to prison for abusing POAs when usually it’s a case of things not being explained properly and people think they can treat someone else's property as their own. I think the daughter just didn’t want her mother being taken advantage of. My late mother has Lewy Bodies Dementia and you feel like you’re fighting everybody when dementia rears its ugly head, Social Services, medical, banks, care providers and the list goes on. The irony of it my mother dedicated her career to providing care for the elderly and I was brought up in nursing homes. Judge Middleton has the perfect balance of being in charge of his courtroom with compassion for all the people involved.

Very interesting. When I was a property manager for a real estate company, we’d have to take tenants to court quite often for non-payment of rent, damage to the property etc. My “training” in that was a Real Estate Certificate IV & my mentor took me to a couple of court cases she did. The company never even dreamed of hiring an attorney as it was small claims court. I did become very good at documenting everything a tenant did or did not do & filing the appropriate forms to give them Notices to Remedy Breach & Notices to Vacate as appropriate. And although I did technically win all my cases, usually it was a hollow victory as we had very little recourse to force them to pay up. The court bailiff can force them to sell things, but if they don’t have anything valuable to sell, and it takes months of notices to just get them out 🤷‍♀️ So my advice to anyone who rents out properties, is to have a good property manager & have landlord insurance. The insurers will actually hire lawyers to recover funds & in the meantime, you won’t be out of pocket.
