Goodman's constitutional point is very brave, as a defense attorney, he is fighting for that person's rights, not the person itself. Therefore, it is irrelevant if the person is guilty or not, because either way his rights must be defended to assure a logical and fair trial. The burden of proof theory says: It is not up to the defence to prove that the defendant is innocent, but to the prosecution to prove, through all the evidence gathered, that the defendant is guilty beyond any reasonable doubt.

Should a multiple homicidal murderer be refered soley as the underdog for the purpose of law? I have to agree with Mr. Goodman that even a charged suspected murderer has a right to a defence. But if the defending lawyer is knowing his client is really guilty of the charges but as a Mob Lawyer defends the suspect and by use of law or his knowledge of law, legal technicalities or how to silence witnesses. Is that lawyer really so good if he gets the real guilty homicidal murderer off by successfully defending him/her?

@@djrychlak4443 I agree there is contained with in the law provisions for criminals or suspects and their rights to fair just treatment. They are generally there to safe guard potential accused people of excesses of the Law. IE they are there to protect suspects from in appropriate convictions or sentences which are disproportionate to the crime or petty crime. So yes there are with in the many Law Books and statutes laws enacted or current that protect suspects or accused. But there are also laws that show evidence that those laws are to prevent abuses or absurdity or travesty of law. They are there to promote the 'fair trial'. Not the travesty of having heinous gangsters who used bloody intimidation, victimisation as well as multiply murders to further their continued criminal activities. A travesty of justice is not a 'fair trial'. Of course had 'Jack the Ripper' been caught and tried then acquitted he could argue that the verdict was fair. Most fair indeed. But a reasoned person may see that all the fairness seemed to be to the criminal and so that was obviously not a fair trial. But in saying that. Mr. Goodman has a point even if that point is representative of a travesty in my opinion or other people's opinions as he has stated that the Travesty was the FBI who failed to convict. As part of the fair trial process is clearly that the accusers are obliged to prove beyond a shadow of doubt that the accused did in fact commit the atrocious acts he was accused of. I think Mr. Goodman knows enough about the law but as a Mob Lawyer he is prepared to use what ever he can to favour his clients innocent or guilty. But he was winning easy points and used those easy points even to ridicule the FBI. I think Mr.Goodman has almost already acknowledged his client Mr. Spilotro was indeed who the FBI said he was and he did indeed do what the evidence suggests he did do. He has even presented him self in a film as him self where the film depicts Mr. Spilotro committing the offences as were as being considered also dangerous to the MAFIA. So Mr. Goodman appears to have already confirmed his believe in his clients guilt. But he is not prepared to act for the FBI or for the prosecution. He sees it as a battle of law in which the duty to prove guilt is entirely on the prosecution and as such he was employed as the defendant by the defendant or the MAFIA as their legal adviser. So in one sense he has kind of mocked them with the law as he asserts the law to be that they have to prove beyond a shadow of doubt which they failed to do. He clearly defends the client confidentiality to the letter of the law. Those same laws in the USA prevent admission of evidence obtained by an evasion of Client Lawyer relationships (IE The protected privilege prevents a Lawyer Client wire-tape). So whilst his legal behaviour appeared to be an abuse or a travesty of law. It remains that the persecution (FBI) failed to produce the necessary evidence. Therefore with out the evidence the acquittal was the right verdict. Therefore Mr. Goodman appears to be in the right. Even though apparently according to films (Casino (Starring Mr. Goodman himself playing himself)), books, and thousands of comments as to the guilt of Mr. Spilotro, Mr. Goodman was protecting a violent criminal multiply homicidal psychopath. But it's not for Mr. Goodman to prove that. That's for the prosecution or FBI. The travesty of law seemed that at the time the FBI failed to prove their cases by being beaten by simplistic legal arguments which should have been defeated on the basis that the accused was in deed guilty of serious 1st degree murders (If he was guilty) and so arguments that the client is entitled to a fair trial should have been acknowledged and he should have been found guilty if he was guilty by the evidence provided and then he would have had a fair trial for the crimes he did commit. But the lack of evidence meant he was acquitted and so implies the FBI were not fair or right to present a weak case with out enough evidence. Or with out a legal team good enough to present their case adequately. Of course I am commenting about events decades ago and as reality seems to indicate Mr. Spilotro along with his brother Michael Spilotro were both them selves murdered. So reality is that at the time the FBI cases were on going and they were on his tail most of the time. So if as is implied Mr. Spilotro was guilty then the FBI were not a total legal failure as they subpoenaed him a number of times. Then he was murdered and so further FBI action may have been seen by them as not so necessary or imperative due to the corpses being identified as those they had formally accused. So their attempts to prosecute may then have ceased and from then Hollywood took over and numerous books and films appeared. So we are just being witness to sensationalist documentaries and films by some trying to make money with out revealing the whole picture that whilst the FBI at the time failed to convict, the hand of fate turned the case about and closed operations as the accused was dead. So legally it is a form of case complete. A historical case. Where most people are told that he did in fact commit the crimes and he was in fact guilty and others are not being hunted by the FBI for the supposed murder of an innocent man as generally they thought he did do the crimes he was accused of. As such they can leave the case files closed unless new evidence shows up. So it;s really a cold case apart from some on going documentaries about historical murders as well as Mr. Goodman's ongoing case about some gripe he had with the FBI treatment. But the FBI do not agree with him on his issue. So about the fair trial and law there also seems no case any more as it;s just old documentaries and really the case is closed or in the cold case stack as the suspect is dead. So any new case by the FBI would be more about who killed Mr. Spilotro? And not about fairness of Law or the correct application of fair law with in the courts. So I or others could waste their time until the cows return writing about the cases presented in the documentaries. But officially the case is a cold case in the sense they no longer need to put him on trial or prosecute him as the man is dead. So in brief: this was all just a big waste of time accept that the realisation that it was a waste of time was reached. but Hollywood may yet produce more dramatisations.

@@damienholland8103 You realize that in our system of justice the law enforcement agencies, like the FBI, investigate crimes and file charges, that’s their job. The Federal or State Prosecuters try to present a case against the accused, who is innocent until proven guilty beyond a reasonable doubt. The Defense Attorney looks to defend his client at trial. The Jury looks at the evidence and decides if the evidence is legitimate or fabricated, and whether the prosecutor has made their case beyond a reasonable doubt. So, it’s not the Defense Attorney who ‘gets a client off’ but it is the twelve members of the jury who sit in judgement of the evidence, that’s 12 separate individuals who weigh the evidence. You cry about the attorney, but that’s how our system of justice works. i don’t hear you criticize the jurors, why is that? The FBI has a horrendous record of violating the law, acting to entrap citizens, and issuing Death Warrants, which are Extra Judicial Assassainations, falsifying evidence, politically motivated prosecutions not supported by law or evidence. The Mob has/had more moral fiber than the FBI, period. The FBI is a corrupt agency that should be dismantled for their organized crimes.

As a lawyer myself I believe that Mr. Goodman is entitled to a serious apology from the FBI-agent who tried to frame him. Mr. Goodman did nothing wrong by recommending other attorneys to so-called handle his (fake) case due to a conflict of interest. Was the FBI-agent (Rick) not in pursuit of a suspected multiply homicide suspect. Member of 'Spilotro the Hole in the Wall Gang'. If Mr.Antony Spilotro was innocent and was not a multiply murderer engaged as a Chicago MAFIA enforcer. Then why did Lawyer Oscar Goodman appear in a film (Casino) which portrayed Antony Spilotro as the very character Mr. Goodman claimed Spilotro was not? How was the FBI-agent in the wrong at the time? Okay so the documentary says the FBI thought they may get Mr.Goodman along with Spilotro. But it was the criminals they were pursuing and recording as so it seems there was no act of attempted illegal entrapment. A trap may have been set but it was a trap for those who entrapped themselves by their criminal actions or deeds. So if Mr. Goodman was not guilty then the trap was not for him. But it was for him if he turned out to be involved or a conspirator.

Listening to the FBI agent trying to describe in his opinion about what Goodman stands for and that he obstructed justice really confirms what I have thought for many years about law enforcement. When a prosecutor WINS A case THEY SAY JUSTICE has been served. However if the defense attorneys win they will cry and stomp their feet like a child! Comments like the a NOT GUILTY VERDICT does not mean the accused is innocent of the charges. Does that not contradict everything that under the law is described as a FAIR TRIAL? I believe it does.Simply put if someone ha's a very good attorney and wins an NOT GUILTY VERDICT the prosecution will REFUSE to accept the verdict! They appeal usually right away. And those motions are usually granted, giving the state an opportunity to give it another go knowing the mistakes made at the first trial! Reverse that scenario, a convicted person finds it nearly impossible to get another trial via appeals. It does not appear to be an impartial or even close to a FAIR PROCESS!!!!.

Its that you can kill anybody“ is too limited in it's simplistic low IQ retarded foolishness. There is a lot more to the larger picture than such an irresponsible expression could be implying. But part of that larger picture is also the fact that the film and book 'The Godfather' is fiction. Also fiction is the famous expressions about the problems with gang warfare being when the initial victims friends turn up with baseball bats. If they were already part Zombie before their physical bodies died can it really be considered a natural death. Calling their final death natural I think is more for the convenience of the general public and officials who need to keep the records. But as when looking in to the cold stark eyes of a killer shark, can it really be said to be alive. They had lived or survived in their under world with out any real warm blooded heart that outwardly they resembled no greater life than a stick insect. Except a stick insect can at least be considered alive. When they left the world of humanity they left the major part of them selves. By the time they reach a decision they are totally irredeemable they are not really human any more, in some people's opinions. Other's may have used the expression 'Dead Men Walking'. As if they are never going to return then it may be an eternity. That was what they were doing before their deaths. They were handing their own souls away forever. A report of natural death does not include such as stress factors that may have led to a premature demise. When your girl wants to talk to you, she's not looking for your advice, she needs you to listen to her, to understand her, be empathetic and tell her that everything is going to be okay. 5) Be authentic, don't ever try to be someone you're not. 6) Be firm, not violent. 7) If you're wrong about something, admit it, you'll go to bed a little less dumb. 8) Listen to people when they talk to you, don't interrupt, if you think they're lying, throw them off balance with precise questions. 9) Don't ever let an asshole rent any space in your brain, don't talk about people you don't like. 10) Always say good things about people. EVERY person NO matter what they did deserves a fair trial. PERIOD!! I really love this guy and this.documentary was fantastic. I think Oscar became Mayor of Las Vegas and wanted an apology from Obama for telling citizens not to go to Vegas or something on those lines. This guy won't kiss anyone's ass and will challenge the PRESIDENT of the UNITED STATES!! Wish more people were like Oscar.

You're right ,Oscar was Mayor of Vegas ,i think he ran in the mid-late 90's ,when they were making Casino Oscar steered clear of Frank Culotta because he flipped and was gonna testify against Tony. I wonder is Oscar still a lawyer now or retired or is he still about,this went out over 20 yr ago, It was a classic line he told the FBI agent about how they couldn't put Spilotro in jail for 22 murders. You must be the most incompetent law enforcement agency in the world lol.

In my opinion it was the FBI agent who got the better of the lawyer - despite the legal training the latter had. He rightly says that they must be incompetent because they could not catch a multiple murderer but he is most annoyed at the methods used to try and catch the murderer. He cannot have it both ways. Goodman admits that one person was murdered to keep a criminal out of prison yet seems to have no remorse. What we don't find out is whether that victim was involved in crime or was an innocent bystander.

But clearly the law of the USA does not allow homical criminal murder. So making a deal with the homicidal psychopath does not supersede State, County or Federal (National) law. Nor does USA state or federal law permit a conspiracy in secret to aid a murderer to commit murder. Mr. Goodman may be confusing you with his confused view point about the law and duty of a lawyer or defense lawyer. Yes it is true a criminal has a right with in USA law to a defense. But that defense is a right to protect criminals from wrongful over zealous prosercutions by courts or justices acting themselves beyond their fair adjudication. It is not there to protect the evil criminals who are in fact guilty.

the confrontation @ 1:22:00 reminds me of an episode of WWF-world wrestling federation from the mid-1980s. the ONLY difference is, back then you knew who the good guys were and who were not. Did you not listen to what he said in the video (To the Law Enforcement Agent)? He was basically saying he supported the criminal gangster ethics of homicidal psychopaths with a history of murder. Spilotro is considered to have murdered some 26 people during his life of crime. Even using grotesque torture. But Oscar Goodman would try to bamboozle the agent by making slanderous slurs such as 'shame on you', and your bones are made trying to frame guys'. Being in the pay of the Chicargo Outfit Criminal Organisation and accepting payments to defend a criminal assassin is clearly 'aiding and abetting. It's in the same league as holding the prison door open so the psychopathic killer can go kill again and again.

Why are people ignorant to the fact that the proceeds of crime can never truly be used in a charitable way? Feeding the homeless means nothing if criminal rackets drove many of those people to be homeless in the first place. Buying meals for children does not abrogate the criminal responsibility of a murderer. I do understand guys like Spilotro - I've met some guys like that myself through life - maybe less successful, but on the same "level" as far as violent temper goes (a few even worse). What I do not understand is guys like Oscar Goodman. You may think what you want about the mobster that grew in poverty on the streets - he has his own story to tell and he will always have his particular point of view on things. ...but I DESPISE that fucking mob lawyer, that becomes a "pillar of the society" and dares to say "mafia does not exist", even though in Italy we had "men" like Riina who killed by the HUNDREDS (THOUSANDS if you include those who were killed by their heroin). That very same Goodman becomes MAYOR of Las Vegas. Sorry! That's too much to stomach for me.

Everyone knows Tony Spilotro killed McCarthy and Miraglia. The "head in the vice" story is legend in Chicago and Cullotta heard it directly from Tony. It's also a virtual guarantee that Tony and Mario DeStefano also killed Mario's brother "Mad Sam." Oscar Goodman is an actor. But he acts in the courtroom instead of on the stage. And he's acting here now. The judge found Tony not guilty of the M&M murders and Goodman gets on his soapbox of indignity "I dare him to come and say I fixed the case" to my face. Of course OSCAR didn't fix the case. The Chicago Outfit fixed the case. Fred Roti or someone like him paid the judge, not Oscar Goodman. It's the old magician trick, please look at the hand I'm pointing to and not the one hiding the little red ball. It's obfuscation on Oscar's part by saying really loudly that HE didn't fix the case, hoping to distract everyone from the fact that the case actually was fixed, just not by him.

Oascar Goodman, he may be a good lawyer, but he almost admited that a witness died because of him. He is not a stupid man, he knows what kind of monsters were some of his clients, and i understand that all people have the right to an attorney to defend them, but i ask myself a few questions: How the families f the murdered victims felt about the man that got the killer free? How did he felt knowing he got a murderer free? How he felt when a murderer he help evade justice, murdered again? How he felt when he realized he did all of these for money, when the victims were buried? How i said, yes all people have the right to an attorney, but if i was an attorney and i saw that some of the clients that i help evade justice, and they get back and murder more people, i don't think that i could help them to that again. I wouldn't have blood on my hands for all the money in the world...
