This was very informative and educational. I have a hearing early February. I'm scared, nervous and anxious all at the same time because my case is complex. I have a rare I guess you could call a brain disease . My problem is trying to get the judge to understand it and how it affects me everyday. All of my doctors never explained to me what it was and what the symptoms were. I had to play detective and doctor on my own. That's what upsets me the most. They're the doctors. When you diagnose someone with something it is their job to explain what it is and the symptoms it could cause. I've been denied by SS twice and I finally got a lawyer because what I have there is no cure and very little medications will help other than surgery and even that is NOT a guarantee it will work.

Wow, my hearing was NOTHING like this. This was a great one and very informative. I was never asked about all my disabilities. I was never even asked about one specific issue. I have CRPS and EDS plus several other issues. But I did have really great medical records. Also, the judge only asked two hypothetical questions. Both came back as a no from the VE. I’m still waiting to hear back. My phone hearing was on Jan 16th. 🤞

I have crps and got disability without any questions before a judge 30 years ago. my case did go to the 3rd (judge level) but no questions were asked due to a thick medical file with good documentation.

I was a caregiver in 2021 after my loved one passed away i went through depression and i suffered with anxiety all my life but it got worse after her passing i also developed and suffered some health issues... 7 months later for the first time as an adult age 39 I decided it was time to see a doctor for the pain and anxiety with depression I'm still going through all while trying to work to survive but my anxiety and pain crippled me to work only part time or less doing gig work.. i denied medication and mental therapy from my doctor but after i was injured in a car accident jan 2024 i went through the lowest in my life.. had an MRI on my back and suffering 3 herniated discs, spinal stenosis, carpal tunnel, Gerd, esophagus dis motility disorder, anxiety and depression.. and accepted counseling once a week, and started taking medication..all if it slighly helps but thats it.. my car accident had been life changing.. I have a mental constructive examination coming up soon.. I cry all the time so im so nervous i will break down in my meeting.

Yesterday I had probably over 1000 muscle spasms I almost went to the hospital.. my pain fluctuates every day. I wish I could take the time back from my accident. I feel so hopeless... also I wondered if my case gets approved can they find me disabled from the first time a saw a doctor? Or from when I first applied for ssdi? I was in denial that I can go back to work.. but after my accident I tried to go back do house cleaning gig job and I just couldn't do it because of severe pain I left early each time.. My first doctor visit was June 2022 the records show anxiety with depression and GERD. and my accident was jan 2023 and I decided to apply for ssdi in July 2024 because family told me I shouldnt go back to work because I'll end up in a worst situation.. with all my proof i dont understand why i have to go through a meeting I worked since 2002 I'm 42 now and have all my 40 work credits needed After i applied ssdi I worked for five days for 3 hours each time spread out 7 months.. how do i explain that to the meeting? Will they denied me for trying to go back and work? It took me 2 extra hours to do a 1 hour job on light house duty but afterwards I really had to pay for it with lots of rest and pain.. no joke. Thanks

When you're under 50 it automatically goes to a judge so they can say you can work.

SSA pretty much just pushes it through to a judge automatically.

I'm 47 as well with a pinched nerve in my neck, peripheral neuropathy, cognitive issues, memory, balance, and speech problems. I have a hearing on 06-25-2024 haven't worked full time since 2020. I have a video hearing and I'm hoping for a favorable decision. Great luck to anyone dealing with these or other conditions.

I have stage 4 copd and carpool tunnel with tendinitis in my left wrist. I'm at the lateral stages of my claim. The ssa says their 87% done . Does this mean I'm getting ready to have a date to see the judge ?

Based off the information you're giving us, i'm not sure if you're about to see a Judge. You are required to receive a 75 day written notice from SSA before your hearing date. Also, if your receiving letters from OHO (office of Hearing Opeations) that means your nextg step is to see a Judge. You can call the OHO office listed on the letters you are receiving and ask them when they think you will have your hearing.

It’s so depressing that you have to hire an attorney to fight for your money. How are people on a fixed income supposed to afford this. It’s sad that our government make it so hard they make us jump through hoops for their amusement.

SSA governs how attorneys can get paid on Social Security disability cases. They can only get paid if you win your case and it comes out of your back pay. The current rules state that a lawyer can get 25% of your past due benefits with a cap of $9,200. This is similar to how lawyers get paid in car accident cases. Lawyers in those types of cases typically get paid 33% of any financial recovery with no fee cap.

Will the Vocational Expert ever ask questions directly to the client, or does the attorney general have the discussion with the Expert?

Generally, the vocational expert does not ask questions to the claimant. However, it is not totally unusual for the Judge to allow the VE to ask the claimant questions clarifying questions about past relevant work and prior job duties.

I would love to hear a mock hearing for a client who is 60+ applying for SSI AND SSDI due to ADHD , anxiety disorder and has severe Auditory and Visual Processing Disorders. Both psychiatric and medical disabilities.

I knew some answers would be longer than 10 seconds. 26.24 seconds is example

The 10 second rule is just a general rule. I think if you are asked a question that takes 26.24 seconds to answer then you will be okay as long as you remember you don't really want your answers to run on and on and on.

I’ll be in bed for my hearing . That’s my life and truth so I won’t be forcing myself into a flare to keep up appearances. I’ll be my usual hot mess . That’s why I’m even applying for SSDI .

Seizures are difficult to get approved unless you have medical evidence of the diagnosis

People with carpal tunnel dont "lock up" it just hurts alot.....why is his attorney questioning his own client? This makes no sense, also if it were me i would be really brief in my answers you seemed to ramble on and possibly dig yourself in a hole.
