If CAA is religious identity . Then what is waqf act , minority commission,1991 worship act, our temple under government control haj subsidy but not mosque , church . If country is divided on the basis of religion then why not citizenship is given on the basis of religion. Bharat is not dharmshala anyone came here live there. Our ancestors given land to Muslim Pakistan and Bangladesh . Go and lived there.

Not only Bangladesh and Pakistan on the name of partition but the lands belong to people who moved also went to either waqf or their relatives. It is like in heritage house is partitioned between the two siblings. One of nephew denied to go with own parents keeping his room and told to keep room of his sibleng as well. If not him then the parents (waqf) said it is my kid's room so you can't take it for any other use. This the tragedy we are facing in India. Even nephew shouldn't have stayed but if he stays then he can earn after his education and contribute to the home and have more room if needed with contribution from his side. But here as well the nephew become tyrant and feels entitled by saying * see I am not your kid that is why you should treat me better. * I denied to go with my parents so it is your duty till my death to feed me.

I would say, Nehru's blunder was Liaqat Nehru Pact.. complete exchange of populations should have been high priority. We didn't need the stamp of secularism then, and now. Unnecessarily thrusting secularism and self loathing down our throats. I keep wondering, when the Muslims eventually become majorityd, will they still entertain these parties and politics, and their leaders? It will be just like in Pakistan where all parties will be Muslim and Muslim oriented, no one to represent Hindus or others, and fights between Sunni and Shia, while the Hindus d!e off. Those Indians who oppose the CAA should be sent to Pakistan permanently to replace a persecuted Hindu who can come to india. The Hindus and Sikhs who found themselves in Pakistan at independence should have more right to stay in India than those born in India. They did not want a separate country but were betrayed by those living on the Indian side.

A few pointers to Hegde's opening. One, the difference is being made on the basis of persecution and since in these three countries persecution is based on religion therefore it comes into picture. Two, Constitutional rights are for citizens of India, people who are yet to become citizens do not have those rights.

There were a number of examples quoted in the debate where there were Muslims who were persecuted because of their religion. So if religious persecution was the differentiate they should have been included. And to your second point. No, Article 14 is not only for citizens but it extends to anyone inside the territory of India.

"The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India." in which within the territory of India is of importance here.

@@chatcricket1405Thanks for clarifying. You are right on Article 15. But, in this the point of contention is Article 14 and not 15 as you rightly said it deals with Citizens. The cut off year for CAA is 2014. Which means the people that will be covered by this act are already in India. Hence, in this case article 14 is the one that provides them the right to equality before law while in the territory of India.

If CAA is discriminatory on the grounds of religion then what are the following acts passed by Congress and why do these senior SC advocates never have anything to say about them being discriminatory in every sense against the Hindus and Jains 1) Over reaching powers bestowed under the WAQF Acts in favour of Muslims 2) Places of Worship act in favour of Muslims 3) State control over Hindu temples only 4) Hindu education acts against the Hindus 5) Muslim law board giving them freedoms that have been snatched from the Hindus. 6) Minorities Commission. What for? Is there an equal Majorities Commission? Above are just some of the unequal laws introduced & passed by Congress that must be done away with in their entirety. Muslims including Ahmedias & Baluchis can never be persecuted in an Islamic State because of his religion. It was the Ahmedias who had started the demand for a separate nation for the Muslims from India. Now they want to come back to India. Are they for real? If they can't live along with the other Muslims then rather than expecting India to take them, Pakistan should carve out a state from within Pakistan for the Ahmedias & they can call it Ahmedistan. But they are certainly NOT WELCOME in BHARAT. Hegde should give his expert opinion on the millions of illegal Bangladeshi & Rohingya Muslims that have invaded India and are being given protection by the SC. One should not forget that India is not signatory to the UN Refugee Convention. Both these groups have to be sent back to wherever they came from. India is already bursting at the seams. It cannot take in any more esp freeloaders which these 2 groups are. They are also trouble makers who are committing various crimes esp on the Hindu host community.

The constitution allows laws to be passed. CAA was passed by parliament so it is constitutional. Every time Hegde comes on a debate, his argument always is this is unconstitutional. How so? In that case many many laws passed by Nehru, Indira Gandhi clan governments are unconstitutional and must be scrapped immediately just as the electoral Bonds were according to the SC! If Hegde is called, then J Sai Deepak must also be called. There needs to be balance in the debate. No point having one legal viewpoint & not the other. Him being a legal expert is questionable. Only Abhijit Iyer and Gen Katoch made sense but Hegde & the activist were talking a lot of rubbish. Any Indian Muslim feeling unsafe in India should go to Pakistan or Bangladesh, after all these countries were carved out of BHARAT for the Muslims. The whole Partition took place on the grounds of religion and now India is expected to take millions of Muslims from Pakistan. India needs to take the land back 1st. When people talk of ideas, Pakistan was an idea but NOT BHARAT. BHARAT IS A VERY OLD HINDU CIVILISATIONAL NATION, WHICH HAS BEEN BASHED ABOUT BY THE ISLAMISTS FOR OVER A THOUSAND YEARS AND THEN BY THE CHRISTIANS FOR OVER 200 YEARS BOTH INTENT ON DESTROYING THE HINDUS, their Civilisation and their culture by imposing Islamism and Christianity on the Bharatis. When the NRC exercise was done in Assam, Muslims with fake hindu names & fake paperwork got included in the list whereas a big population of innocent Bangladeshi Hindus were left out. This is totally unacceptable! India can never open its doors to anyone & everyone claiming to be persecuted. This suggestion from Barkha is absolutely ridiculous. This is not soft power. This is asking for the genocide of Hindus as Muslims from all over the world will rush to India claiming asylum because their main aim is to Islamise BHARAT at any cost! Apart from those given special clearance by CAA, everyone else including any Muslims from anywhere should only be allowed in if they enter India legally with proper paperwork. All illegal entrants MUST BE REMOVED IMMEDIATELY. Opposition parties are getting illegal Bangladeshi, Pakistani and Rohingya Muslims in for their vote bank. The central government & all it's agencies need to close all the routes through which these illegals are entering India and put them in detention centres till they are removed? All borders need to be secured.

To remind everyone the constitution of "India that is Bharat" implies that Bharat is a Hindu Rashtra, esp after Bharat was broken up on the grounds of religion, Pakistan for Muslims and India for Hindus. The word "Secular" was sneakily put in by Indira during the emergency when the opposition were not allowed to vote, so how is this constitutional? Hegde needs to go & learn true Indian history not that being taught in Indian schools written by distorians Romila Thappar, Irfan Habib. Regarding Pakistani Muslims wanting to come to India. Do the panellists even realise what allowing these people into India would do. Their children from the age of 2 are taught to hate Hindus because they are Kafirs. Hegde is deliverately confusing the viewers. India has several laws that are applied only to a particular religion. Constiitution allows laws that discrimate based on religion. The only requirement is that the criteria for applycation of the law must be defined with certain constraints imposed by constitution.

Maam, the torture of Ahemedias (an Islamic class/sect/cast or whatever) is the internal Issue of an Islamic Nation. They have taken a large portion of land in the name of Pakistan and Bangladesh Purely based on religious grounds. Infact, as per our knowledge, Ahmedias are the ones who drafted the Partition Resolution demanding a separate land of Pakistan purely based on religious grounds. Now if they want to come back here, we have every right to claim back the land of Pakistan and merge it in India. The Leftist Corrupt media and Politicians tell Ardhasatya. There is a background as to why they have been restricted. So, pls don't tell only one side of the story and instigate the muslims brothers in our country.

Barkha, the bottom line - The CAA was promised by the Congress because they were nit able to provide succor to minorities in Pakistan & Bangladesh. BJP is obviously playing & Opposition is fighting for, politics.

well Bharat didnot decide to be secular in 1947 but few bunch of politicians did. they kept fooling us for long time that secularism is ideal and being hindu is not. Now we choose people who will do exactly what we want. do hell with secularism. we will elect those who support our hindu cause and force them to change consititution for our benefit and advantage. These bafoons keep crying that secularism is heart and soul of India. But Sanatan is heart and soul of Bharat and we will get there.

Equality as per constitution applies only to our citizens. Its the discretion of the govt of the day how to proceed with granting Citizenship for 'Non-Indians'. Constitution do not provide equality etc to non-Indians. Panelist are mixing up the provision of constitution for Indians (including Muslims) with their personal opinions. No country in the world provides equality or their constitutional guarantees to people who are not their Citizens.

The law is meant for people who are NOT Indian citizens. How is any Indian citizen getting discriminated then? The Constitution says Indian citizens should not be discriminated. It doesn't say anything for non-Indians. This whole opposition argument is laughable.

The Govt wants to give citizenship to Hindus but they are afraid that if Muslims are also brought in this law, a huge influx may happen when we are finding it difficult to give food to all. The whole situation would change when Pakistan and other countries become richer than India.
