This judge just called out the child support office for basically believing mother’s testimony that the father didn’t have other children.

100%. The previous order stated that he had the second child and basically the court decided to reverse what was in that order in regards to his second child because they just believed the mom instead of dad. This is exactly what happens. Even when you've already proven your case and provided evidence, the courts still side with the mom. It's disgusting.

Seriously! The only proof the AG had to offer that dad doesn’t have other children was “well mom said he doesn’t.” Girl what lol. Not that an AG should ever just take someone’s word without proof when it comes to a court order, but I think it took us all about two minutes to figure mom is very angry and vindictive; Probably not a good idea to take her word about anything having to do with dad.

My hope is the mom is paying for her attorney. That’s only fair since she knew he had another child yet she still wanted every penny that should have been spent in his other child. Good idea to review it dad to make sure your other child was on it.

Texas sucks about this and it doesn’t matter if the mother makes 100,000 and the father makes 10,000 a year they will tell him to get a better job and impute him at a higher wage than he actually makes and her income means nothing and they must, the father that is provide all medical and dental insurance and pay for it on top of whatever child support is ordered, which is at least 25% of gross for one child in Texas. I believe it is either 30 or 33% for two children.

Ikr, when they were asking for proof? “Bc there’s no open cs order” Like what? If kid lives w him there isnt going to be one. They want birth certificate, lease, school registration etc and that’s all bc the mom was telling them he didn’t live w other kid. Which dont matter bc he’s supporting him in his household. Which is what cs is, its the portion dad would be responsible for if he were in the home. Mom Being greedy for that extra 2.5 % credit. I have seen a couple cases where men have said they have 3-5 other kids and they were stepkids so maybe that how they have to verify but does seem off. *Just got to this part, lol Plus a big one that the child was included in the 2018 cs order🤦‍♀️but not included in this new one

It does matter. If the child does not live with him and father does not pay support, then the child is not considered. If the child does not live with him and he does pay support then he is considered. In this case I think the father was trying to say that the child was not considered because he gave a different address for safety purposes and the child does not reside at that address so they did not consider him on the 2nd order.

Out of all the cases ive watched ive never seen a parent have to verify a child. Living with them or not. Just because he doesnt have a child support on record for his 9yr old doesn't mean he doesnt exist

He actually does have child support on record for the 9 year old. It’s dated 2018 at the rate of 17.5% . It’s the proposed support that didn’t take the 9 year old in to account.

I don't think he "overpaid." Instead, he was opposing a modification. The 2018 order credited him for two kids. The proposed modification dropped his second child. But the judge rejected the modification. I don't see any overpayment.

His lawyer is hesitant and unprepared. The judge asks her a question, and she doesn't respond. Dead silence. Good manners dictate that if someone asks a question and you need to review a document,you tell the questioner that you need a minute. It's weird to say nothing.

These three showed up so confident and yet so very wrong. Good for this dad to stand up for himself and what is right here. It didn’t save him a ton of money but it is what is right under the law. It is shockingly disturbing how little these two attorneys know about the law and makes me wonder how many people just took the miscalculation at face value and paid for it. This judge is amazing! Love how he held the AG accountable

Family court has come a long way. A lot of ppl fought long and hard against Coverture. Father’s don’t have to get the short end of the stick. I deal with all kinds of fathers. Some good, some bad. A man could marry prior to having a child and actually participate in the child’s day to day needs. In the alternative, father’s may pursue and assert their legal rights as soon as the child is born and maintain those rights by equally participating in the child’s day to day life. Both options would provide the father with equal rights to their child. Many fathers don’t and won’t do either.

I love how the judge is holding the AG's feet to the fire. She was a bumbling fool. She tried to speed bump past the question and tried to continue her questioning and the judge was like nope, I want an answer to my question. She saw the prior order included his other child and she CHOSE not to include his other child. Her attorney was just flat out incompetent.

Yeah apart from the judge, there seemed to be no following of the case from those in official capacities there. Linsey Kaplan messed up and after she was grilled about it, the attorney then decided to ask him why Lucca wasn’t included in 2018. Wasn’t she even listening ffs? They literally just ruled that he was included on that one but not the proposed recent one. The issue was that those in charge messed up and yet she is grilling the dad as though he did this.

My boyfriend and I decided when we first got together that we would never have kids. He's got 4 kids from 3 baby mamas and every one of them screwed him over. He's literally traumatized by them so badly. I can't imagine doing that to a person that you loved and gave you children. It's absolutely awful that these are the people who make decisions not only over a father's life but also over children's lives. They don't care what's right for any of them. Just how much money they can make off of everyone.

Most judges would've swept this under the rug so that it doesn't get found out. I'm honestly surprised that he did this. He didn't exactly correct the mistake that was made but at least he acknowledged the discount going forward. What a mess.

I must admit I had a chuckle with this one. Mom's lawyer just knew she was right and was going to prove the child didn't live with him, although that would have been irrelevant whether the child did or not. She wasn't prepared, she didn't even read the orders beforehand. So glad this dad did what he needed to do to get a fair shake. So many times the mothers get away with lying. The mom was visibly pissed off and is just bitter. Smh

This mother is a nasty piece, you can tell she's used to getting her every way. As does her lawyer. The lawyer should be embarrassed, she should do her diligence, her JOB, and this wouldnt happen. And its not about not getting her client the best outcome, its about upholding the law and doing her job CORRECTLY. But you can tell this whole thing was planned by the way her lawyer kept trying to cut the father off, she knew she effed up.

The OAG has a bias. If a man has two kids, and one is covered by Title IV-D and the other is not, the OAG has a strong interest in the kid who is covered. That other kid can starve in the streets as far as they're concerned.

13:25 the question isn’t “no responsive” he’s trying to say he didn’t want his ex to have his address and by providing his sons paperwork proving the address it would give her his address. If the would just shut up and listen they’d have the answer.

I think she was just being petty with the objection. If it's a yes or no question, they can object to non-responsive after yes or no. I think the judge told him to not embellished answers because he knew she would continue to object. Dad's a smart cookie, as he actually did exactly that after, when I see most people have trouble not embellishing their answers. I've also seen a judge overrule that same objection & the attorney freaked out! One of the better attorney freakouts I've seen actually 😄 anyhoo, the judge says it's at his discretion, because attorneys tend to try to trick them with questions that are not yes/no & need to be clarified. Blahblahblah. Tmi, sorry 😅

Another attorney in the Attorney General's office that has no clue what's going on and no idea how to ask a question. He has another child and they all act like they don't know what's going on. Obviously the Attorney General's office believed mom during the teleconference and they shouldn't have done so. This was very shotty work.

Mom is pissed… i think it sucks that they don’t give credit back to dad. The state doesn’t mind taking retro from dads so why aren’t they responsible for overpayments they charge the dads? That makes no sense and dads should send a bill into congress to get passed.

None whatsoever. If the lawyer and the judge had thought about it, the only time that there's no court order for child support when the child doesn't live with the parent is if the parent is on disability. And clearly he's not on disability. It should've been glaringly obvious to the courts that his second child is living with him. Especially since he's married to and still living with that child's mom. They could've asked him for proof at any time for this. And in fact, he did provide proof. They ignored that proof from the previous order. This is blatant fraud on the court's part. Mom gave them the excuse by claiming the child doesn't live with him. And because there's no child support order they assumed he wasn't paying for the second child. The judge and the courts did this because it gives them a higher percentage in interest to collect. That's a scam. He should sue the courts for that. And for the other lawyer to claim he shouldn't get that 2.5% because he's not exercising his overnights with this mom's child is ridiculous. For one, that has yet to be proven. And two, that amount was based on the lowest tiered bracket for child support. 20% is the percentage for 1 child with no other children. That's whether you use zero hours or if you use the standard visitation. The 17.5% is a discount to acknowledge that he's paying for another child. It's disgusting how moms take advantage of the court system like this. And this court should be investigated for fraud.

It’s like saying that because a single mother has 100% of the rearing, that is offset by requiring her to do 100% of the providing And that if a dad doesn’t want to pay support for two children, no worries! The attorney should be asking the AG office why it’s different not the dad. AG messed up on the calculations. Why does it go down such a small amount? 81 dollars, That’s it? If the child support is 20 percent then it should be split between the 2 kids, not just go down 2-3 percent. Mom looks pissed she is going to be losing 81 dollars a month. The mom acts like a control freak. No wonder he wanted out.

I’m confused! If the other kid’s mother ever wishes to place him on child support. She can and will be awarded retroactive payments for any period of time in which they lived separate. So, living together or not shouldn’t matter. Only proving that he does have other minor kids that he is legally responsible for should!

I think some commenters are misunderstanding Dad’s payments. He’s been paying under the 2018 order. This hearing is about a proposed modification (i.e. not in effect). Dad refused to sign it because he objected to the elimination of the credit for the other child. So, even though the judge agreed with him, he’s not owed any credit because the new order was never implemented.

I noticed this also. You are correct. This is a modification to the 2018 order, which has not taken effect yet. He refused to sign the order during their negotiation conference because he was not in agreement and so the case was filed for court to address his concerns.

You don’t need a child support order to support your child. Most people support their children without going through the child support office. So the moms lawyer is saying if you don’t see your child regularly you don’t have to pay child support. Terrible lawyers all around.

This child support worker is absolutely painful to listen to. I’ve seen her on a couple of videos and I feel like she is incredibly nervous and doesn’t have a really clear understanding of what she is supposed to be doing. I think she’s definitely trying, but it makes it exceptionally hard for her when the judge pushes back in any capacity.
