I just moved in to an apartment 3 days ago under a 13 month lease and I’m not happy. I jumped into it too soon. Is it too early to break my lease?

Same here:.. just moved in on 12 month lease and now realize the extreme noise from my neighbors and regretting my decision because of constant noise from upstairs tenants at all hours of the night. I’m so bummed

@Sofa Time talks wit Quelz aww I’m so sorry! That sounds so stressful but also your child is just being a child running, jumping, playing etc. Have you tried talking with the property manager below and just explain the situation and tell them your concerns about the noise they might be hearing? It may not even bother them. My neighbors stay up really late and stomp around until 3am sometimes, but I don’t mind the noise as much during the day. It’s when I’m trying to sleep after 10pm that I get irritated lol I can totally understand the walking on eggshells though not knowing and slow maintenance sucks. I hope it turns out ok for you. I may move to another unit eventually :)

You can call the police, if they continue to make noise after 9/10 PM. I believe it’s called a noise (Nuisance) Law, curfew limit. Most people have jobs they need to wake up for after a restful sleep.

If you don't feel safe in your apartment due to a newly moved roommate who is threatening/dangerous, is there a way to break the lease and get away with not paying fees?

Thanks Driss, that's a great question and you might need to check with the requirements based on your state. For example to break your lease in QLD please check out: www.rta.qld.gov.au/ending-a-tenancy/ending-a-tenancy-agreement/ending-an-agreement-early-breaking-a-lease

I'm actually trying to break my lease because I want a new start but they're are a lot of things that going on in my place that has not been looked at at all and I've never seen the landlord since I moved in don't know wether they are man or a woman they're we're supposed to come in July never happened

I understand you're facing some issues with your current lease and the landlord. It can be frustrating when maintenance concerns go unaddressed, and communication with the landlord is lacking. Here are some steps you can consider: Document the Issues: Make a list of all the maintenance issues and problems you've encountered in your place. Take photos if possible. Having a record of these issues will be helpful. Contact the Landlord: Try reaching out to your landlord again, either through email or phone, to request a resolution for the maintenance problems. Be polite and clear about your concerns. Review Your Lease Agreement: Go through your lease agreement to understand the terms and conditions regarding breaking the lease. There might be penalties or notice periods mentioned that you need to follow. Seek Legal Advice: If communication with the landlord remains unproductive, you may want to consult with a legal expert or tenant's association in your area. They can provide guidance on your rights and options. Consider Negotiation: If you want to break your lease, try negotiating with the landlord. They might be willing to allow an early termination if you both agree on terms. Provide Written Notice: If you decide to proceed with breaking the lease, make sure to provide written notice as per the terms of your lease agreement. Keep a copy for your records. Find a New Place: Start looking for a new place to move into, ensuring it meets your needs and preferences. Remember, it's essential to follow the legal procedures and keep communication respectful throughout the process. If you have any specific questions or need further guidance on any of these steps, feel free to ask.

Leaving a lease early in Queensland (QLD), Australia, without following the proper process can have several consequences. It's important to understand the potential impacts: Breaking the Lease: This is considered breaking your lease agreement, which is a legally binding contract. The specific outcomes can depend on the terms outlined in your lease and the Residential Tenancies Authority (RTA) guidelines. Financial Responsibility: You may be responsible for paying rent until a new tenant is found or until the lease period ends, whichever comes first. The landlord is required to make a reasonable effort to re-let the property quickly to minimize your financial burden. Lease Break Fees: You might also be liable for reasonable costs incurred by the landlord to find a new tenant, such as advertising and re-letting fees. Bond: Your bond (security deposit) could be at risk. The landlord may claim some or all of it to cover unpaid rent, damages beyond fair wear and tear, or other lease break costs. Rental History: Leaving a lease early can negatively impact your rental history. Landlords and property managers often check an applicant's rental history when considering them for future rentals. A history of breaking leases could make it more difficult for you to rent in the future. Legal Action: In some cases, the landlord could take legal action to recover any financial losses exceeding your bond. Always seek advice from a legal professional or contact the RTA for guidance specific to your circumstances before making a decision.

I'm truly sorry to hear about the challenges you're facing. While I understand this must be a stressful time for you, especially concerning your baby's health, I'll do my best to provide some general guidance in relation to your situation. Open Communication: Keep a record of all communications you've had with the property manager. This includes emails, text messages, and any other forms of communication. It's essential to have a paper trail in case you need to prove anything later on. Know Your Rights: Each region has its tenant rights and responsibilities. While I'm more acquainted with Australian regulations, Canada also has tenant protection laws. It's important to familiarise yourself with the tenant rights in Edmonton, Alberta. A local tenants' association or legal aid centre might be able to provide guidance or resources. Seek Legal Advice: If you feel your rights are being violated, you might want to consult with a legal professional in Edmonton. They can provide advice specific to your situation and the local laws. Medical Documentation: If your baby is having health issues that you believe are related to the apartment, consider getting documentation from a medical professional. This could strengthen your position if you decide to pursue any legal action or negotiations with the property manager. Alternative Solutions: While it's understandable you offered your security deposit, you might want to explore if there are other options for negotiating an exit from your lease. This could be a mutual agreement to terminate the lease early or finding a new tenant to take over your lease. Mental Health Resources: It's essential to take care of your mental well-being during challenging times. If you're feeling overwhelmed, there may be local mental health resources or helplines available to assist. Remember, it's crucial to approach this situation calmly and methodically. I hope this guidance helps, and I genuinely hope things improve for you and your family soon.

Thanks for watching Mr. Spring. Great question and please visit: www.sa.gov.au/topics/housing/renting-and-letting/renting-privately/during-a-tenancy/Subletting-or-assigning-a-lease "Assigning is allowing another person to take over the lease agreement. It can be done if there is a fixed term lease and the tenant needs to leave before the end date. When assigning a tenancy to someone else, the new tenant takes over the existing lease agreement. They become responsible to the landlord for meeting all conditions listed in the agreement. All information should be clearly detailed on the lease agreement and signed by the tenant, the landlord and the new tenant. If the lease is assigned without the landlord's written consent the tenant will remain responsible for the lease agreement. This includes if they’re no longer living at the property."
