A nominee is a person with whom the Housing Society can deal with in order to decide legally the final Owner or Owners of the said flat. A nominee has right to the flat until it's legal Ownership is established.!

Nominee is only a TRUSTEE & NOT OWNER. Ownership can be transferred after death ONLY & ONLY through 2 ways. ...1) Probate of WILL 2) By sucession certificate in absence of WILL

Surprising that co owner loses precedence to nominee ? Not sure if what's said is correct !! Bye laws can't be blind to joint owners.... Anyways, senior citizens can nominate the second owner name and vice versa for safety.

2 Joint flat are subdivided into 3 flats for 3 brothers but earlier 2 flats had 2 brothers as members in society only. NoC given by 2 brothers to make 3rd brother a member in the 3rd new subdivided flat with separate entrance and meter. Society refusing to do the same even if there is letter from authority to proceed for 3rd membership. (No sales deed executed till date on any 3 brothers since property purchased. Also, all 3 brothers and their parents contributed in purchasing the flat via cheque to society in 1970s). Plz advice . Thankyou

Sir i have 2 Questions 1) our society is on collector"s land & one member has expired years back but has filed nomination in favour of one of her son's. But the Nominee has not Applied for Membership. If he Applied for Membership can we Grant him membership As Provisional Member being the Nominee. Without Any NOC from Collector.? If no till such time whom the society Should deal with As there is Arrears of Maintenance for the last over 20 years to the tune of Rs 13 Lacs Approx. 2) one person has purchased a flat from the members of society in the year 2021 & his Application for Membership is pending for want of NOC from Collector. & This purchaser of flat has now Stopped paying Maintenance Bill r issued in the Name of previous Member who has sold this flat.can society issue Demand Notice or Bill in the Name of purchaser whose Transfer Application is pending for Want of NOC from Collector..pls guide us .
