I have no doubts he is being represented by a trash tier lawyer. That's what you get with a public defender. Unfortunately the judge knows that's how it is and there's nothing he can do about it and on top of that also probably doesn't care.

@@daveidduha true there are great public defenders. I think the point is that their case load is so large that they can’t keep up with the demand. So while they would like to treat every case with due diligence, they just can’t give them the attention they need

This guy is trying to set up a mistrial or establish an appeal ahead of time. He's raising a complaint every defendant has because they don't know anything about how trials work. By talking about witnesses that will not be called he is floating the idea that they really exist. But since they are not going to be called, there is no way to tell.

I mean great speculation and a possibility. I've seen that happen too many times from experience but there is one issue with this. You are assuming something instead speaking factually from evidence you've obtained. Anyone that "thinks" they are intelligent enough to pick apart a defendants actions through pure speculation from a 10 minute video on YT, using only what they assume to be the reason why for the defendants actions, are the stupidest f***ing people on this planet.

The defendant did the right thing by saying something than making the mistake of trusting the motive of the court. If the defendant feels he justified in his innocence or level of guilt, then it is his purgative to air his concerns.

I feel that When I was 17 I had a court appointed lawyer. I got really bad deal With time and 5 years probation. My lawyer tried to take more time and 10 years probation and I said no a few times. I had another court-appointed lawyer when I was 19 and she went back to the DA to try to get me more time. They both also said they would come and talk to me about the case and never did. I went back a few times over that probation. Then I turned 24 and paid my own lawyer and got off with doing one more day in jail. If you don't have money to pay the lawyer. They work for the state and sometimes even if you do pay them.

11:45 - i find it interesting that GA added a rule in Jan 2013 that made it permissible to include a defendant’s prior bad acts, crimes, etc whereas those kinds of things are usually litigated on the record between all parties beforehand since, on appeal, that evidence can be argued as having been overly prejudicial to a jury. While prior bad acts are definitely relevant in some cases to show an escalation or pattern of behavior and should be included, sometimes prior bad acts really don’t have anything to do with the facts of that case. For instance, a woman in her 20s went to jail a few times for drug possession, shoplifting, petty shit but then maybe 30 years later she’s on trial for her husband’s death. The fact she went to jail for petty crimes 30 years ago shouldn’t be used in her current trial bc they aren’t at all relevant to the facts of the case. GA seems to have just decided that this evidence is now permitted to be included regardless, which i’m sure sends more ppl to jail had they only been tried on the facts of the case itself. Good ol’, reliable ass Georgia. 😉 (i’m in FL though so no judgment- i’m convinced ppl come to FL to die either via retirement or bc you can count on us to give you the death penalty lol We got Bundy, after all)

He should fire the lawyer. They are ramrodding him in accepting what they want than his right to 'zealous defense' as he is entitled by law. What he will more than likely get if found guilty is a retrial granted by the appellate court based upon his right of defense. The judge may run the show but that man has a right to his own defense. He needs a new lawyer.

I do not believe he has the right to a new lawyer unless he pays for one. I do not think anyone with a public defender gets a zealous defense in the USA. If there is a problem it is universal problem, this guy is definatly not an exception.

Plus some witnesses he wants to call , might have issues known only to the State & DA found during the investigation that could then shred to bits what they say during cross-examination. Or ppl whos testimony can be refuted and then used against him in the worst ways! All simply because it's not as simple as this guy seems to think . Other witnesses could say things or be accused of things in front of the jury alienating them & therefore this defendant that literally ensue a GUILTY Verdict. As he stands there flapping his fat mouth.

The system is clearly broken and laws are poorly written too. Appealing rarely helps and actually just wastes time while someone rots in prison. The judge should've been pulled from his office after that display. The trial should've been mistrialed if you have no physical evidence or equal sharing of evidence from the opposing council which means there's literally no evidence to the case. The system is a farce of justice.

Unless I am mistaken he has the right to a lawyer, not a specific lawyer unless he pays. He has only two options either have that guy defend him, unless he is clearly incompetent, or to represent himself. That is the judicial system in the states, but I am no expert.

Constitutionally false. You have the right to an attorney. You must hire an attorney of your choice unless you can show that you are indigent and cannot pay for one. If you are indigent, the selects your attorney, and you have virtually no choice in the matter. (Gestures to my new shiny criminal justice degree)

if you don't have any money to pay for a lawyer you don't get to pick one unless you can actually prove that they did not do their job properly at which point you would have to take that up with the public defender's office

@@jennagentles1836, you can appeal your sentence based on your PD not handling your case properly or misrepresentation (blanking on the actual term for it). You can also write the state supreme court to reprimand the attorney and there's too much extra red tape it adds. Most judges will give you a new attorney once or twice, from what I've seen.
