This is absolutely horrible, dude...Copyright strikes are legit my biggest fear as a KZbinr, and I'm so sorry you've had to go through it with such an amazing series that was filled with such obvious passion. I don’t get why KZbin doesn’t give out warnings first before a strike. On eBay you get a warning if you use copyrighted material. No strikes no nothing. Just the item in question being blacklisted until resolved.

Different standards due to eBay only giving money on the sale. Doesn't work that way with videos that might have monetization before the claim happens. The strike is a severe response, but legally, any company could directly file a Cease and Desist, followed with a lawsuit if any and all related materials are not taken down within a limited timeframe. It *is* technically copyright violation until a judge determins if it is fair use or not, unless it is licensed. KZbin is at a bigger risk for potentially paying people who infringe, whereas eBay doesn't, unless it happened in the past on something sold. In addition, most stuff on eBay is reselling, which is legal, including use of trademarks as displayed on the product and packaging... as long as you're not claiming to be the company that made it or that sells it offline as an official vendor. Waaaay different from KZbin.

@@rodimusmagnus5586 Typically, most say 'for private use only', because you can't rent or sell tickets to a showing of the film, without licensing, nor can you show it in a public venue, such as a lobby or lounge in a college, university, or academy dorm hall, etc. That is copyright infringement. However, first sale doctrine means that you absolutely can sell it either before watching it yourself, or after doing so, just that you aren't allowed to keep any copies made from that particular copy, which, yes, you may also do for archival purposes in case the original is damaged... but if you sell it, you have to also destroy the archival copies. It is a bit strange that companies can legally put any 'you cannot resell this' warning on packaging, and to be honest, I've *never* come across that myself (but I have with the 'for private use only'), however, it doesn't violate any law to state that you can't do something you legally can do. It should be, but there are a lot of licenses companies make that have clauses that make the license void with jurisdictional laws, yet unless you want to take it before a judge, you're taking a risk, etc. If you do see any disc that has a warning that says that, unless it is classified information or internal company use only... go right ahead and sell it if you want, if you're in the USA. Other countries may be different, though a cursory Google search couldn't provide me any website or image with examples of such a warning label, so I'm not sure what you're referring to precisely.

This isn’t just a monetization thing. It’s been happening with any KZbin channel that gets a copyright strike. I got a Copyright Strike from LEGO of all companies when I uploaded a clip of the Ninjago series, and I had to delete it to avoid getting terminated.

I gotta be honest, I start to dislike Paramount after each month more and more. It's like they don't know what to do with their own property. ROTB felt like a Bay-less Bay-Movie. Especially after the new path Bumblebee build. Like they can't give up the past, despite not even Bay wanting to direct TF anymore. Using the cheap Megamind 2 and show animation team for their exclusive Earthspark season 2. Completely screwing up TF One marketing. It having 2 release dates depending on region. Releasing TF One soon on Paramount+ and some cinemas already pulling the movie out after 1 month. Did they even believe in TF One succeeding? Now screwing over fair use content about a 17 year old and a 15 year old movie? Because of bits from a 7 year old movie? Again, it does feel like they don't know what to do with their own property anymore. I honestly would be happy if any other studio would buy up the franchise. They are like the most stereotypical Hollywood corporate studio now. Cutting corners and screwing up fans.

That’s just awful man, KZbin has had a really big problem with its copyright system for a while now. At this point it feels like I’ve seen countless videos on both creators I do and don’t watch having some kind of copyright nonsense happen to them, and not being able to do anything about it. KZbin really needs to do something about the whole copyright system and how badly it works. Anyways hope the best for you, fingers crossed the strike gets reversed

The issue is, even with all the changes to the work, it still is using copyright material, and until either the US Supreme Court or another Bearn Convention occurs to change it, fair use in the USA can *only* be determined by a judge. You can *hope* that it is fair use without that, but if a copyright holder doesn't explicitly license your use, you're taking a risk. They can't go after everything because it takes time and costs money to pay for automation or people to do it, but just because it isn't noticed for a while doesn't mean it is safe. Taking down the videos, much as I enjoyed them, was absolutely necessary for the safety of your channel, and as much as I wish intellectual property rights were more lenient in the USA, they aren't, despite being more lenient than a lot of other countries with stricter options (including some with no fair use or fair dealing provisions at all). Now, yes, it may not be as entertaining or valuable for viewer retention to entirely lack the original audio, video, or even freeze frames, but before KZbin and other platforms, review often were sync tracks, solely audio discourse, or written discourse, which are all things that can't be copyright claimed. For a long while, a lot of people have done reactions without transformative work such as you have done, and then been surprised when they finally had to try something different. I'm glad at least that you found another way to share the work, on a platform that can at least cut out the automatic strikes and the like... but do keep in mind that behind a paywall it increases risk if ever there is a copyright claim cease and desist that arrives, or a lawsuit. Be careful, and keep creating awesome stuff.

My best feelings to you, fellow videocreator, Ive suffered from similar unfair censorship here too. Not to make it all about me, but Id like to share my last unbelievable case of non procedent strike and total lack of aid from KZbin: My review of "Godzilla x Kong: the new empire" was blocked worldwide, as you said, for 12 ridiculous seconds of footage. I asked Warner for my content back via KZbin studio, justifying that using reference clips is not showing the integrity of the feature and copyright laws allow to show footage for review and analysis, the usual claim. Not susprised that Warner denied, but the actual injustifiable shamefull act is that the denial came back with a strike. This is olympus level BS because KZbin studio itselfs clarifies that DENIED CLAIMS ARE DO NOT EARN A STRIKE. They literally stricked me just for contacting! But wait, it gets better. When I contacted KZbin's community help forum to explain all this and asked for the unfair strike to be removed, one mod answered saying that "legal issues are not the plataform's business, the owner of the copyrighted material can decide wich content to remove". This is BS combo x2, because Warner didnt stricke me, the plataform did, and under a cause that its very own system confirms is unreasonsble. They block and strike me in the name of the owner, so its KZbin who has to deal with the BS. And for the last joke, when I messaged back justifying this, not only I received a copypaste response, but there was also a text under the the last 2 emails that read "the following answers to this email wont be published". So KZbin not only ignores my complaints but also makes sure that the cant be seen. Wonderfull rogue business. Sorry for the long anecdote, but I really feel in sync with your trouble, its a constant burden for people that only want to have fun making vídeos and talking about movies. We don’t even have Earthspark season 2 translated and TF One was released almost a month later. I also think that TF ONE is an Australian movie? Could be wrong tho. Which is why they don’t do the terminating. I used to have a Transformers meme page on Facebook which was terminated this august due to copyright and mimicry EVEN THOUGH the page was inactive since 2016?!? And had like 2 TLK memes on it. I also believe that some random person reported me rather than paramount. In my country I am not allowed to sell fanart. I would LOVE to sell my TF art but I simply can’t. I see so many artists who sell TF one pins and other fanart prints and products and I’d love to do that too but cant
