I came home and found that my hay field was completely dead. Now I may have to start all over. Someone got on the wrong field and sprayed herbicide on my Hay Field and killed it. What am I going to do now? Will I get paid for the damages? Do I have to replant the hay Field?

I can’t even imagine how upset you were. I could hear the edge of tears in your voice. As farmers we put our blood,sweat,and tears into our land, as well as our hearts and souls. Stay strong, God has a plan in ALL things.

We bale 7 acres and get average 1200 bales for the first cutting, 150-170 bales per acre . Dont short yourself at 50 bales per acre. You would have got more than that. I'm so sorry! Hope you get the reimbursement you are deserved!!!

Sir, I do feel your anger and frustration. I'd encourage you to take a step back and handle this with a reasoned and stable approach. You do, in fact, have a very solid case for compensation from someone, either the company that sprayed or the client that paid them and didn't personally oversee the operation. Here's how I think the best path might be for your. First, get busy gathering records and making sensible and honest estimates of every single thing that you did in terms of labor or money you spent for fuel, equipment rental, seeds, fertilizer, and everything else that went into getting a hay field up and growing. Be certain you don't forget things or undervalue them but also don't go crazy and over value anything either. Second, clear the field in some way right now, perhaps by controlled burning, and start over right now with preparing and replanting something in that field even if it is only a cover crop or some other fast growing crop that can make some type of forage. Add up all those costs too. Fast growing crops like sunn hemp can produce edible forage that can be made into animal fodder in only 45 days from planting. Why you want to do that is to mitigate your loss and lessen the amount of hay you have to buy in the market place. But if you do need hay, buy all you need and add that to your costs also. Don't skimp on the amount of hay you buy. Get enough to support as many animals as you were planning on over wintering and then buy the animals. You don't want to lose your income and set yourself back further by stalling out your plans. Everything you are doing right now is just a temporary stop gap action to reduce the financial impact to your farm. Your real expenses will come next spring when you do a full, new replanting of a good quality hay. Add those costs to the list too. Sometime next year you should be back up to a decent hay field similar to what you had before, assuming weather cooperates and they don't destroy it again! At that point, you can tally up the entire cost and pursue reimbursement. Meanwhile, send a certified letter to both parties advising them of their actions having destroyed your field and causing you financial loss. Send them whatever costs you can put together today and ask for a FIRST payment on the total damages bill that will be amended as you restore the field. Let them know they will face costs for probably another year being added to the bill. Give them a time to respond, after which you can take further action if they don't respond. Send a copy of the certified letter to a good lawyer you contact and get to agree to handle the case if it goes that far. Put the law firm's name in your letter and let them understand this isn't going away until all damages are settled in full. I farm organically as much as I can on my own land and avoid using roundup or any other herbicides whenever I can. However, Roundup has a short residual life and will largely be gone with no lasting impacts after about two weeks time. Be SURE however that is the chemical they used. If they used something else it could be a long lasting residual in your soil. Long term contamination of the soil would simply be more financial damages. If it was roundup, then there is no reason not to replant and move on to develop a better hay field than you had before. At least they will have killed all the weeds in the field too at no expense to you so you will have a clean field to plant. I don't like using chemical and don't like Roundup particularly but it isn't the end of the world nor does it have to be a permanent set back. Should you have to go to court, you likely will easily win a judgement against someone and can then proceed to collect your money. Good luck. Hope things work out well for you.

You’re handling this with great class. I hope you are recording every conversation your having with ag business and the farmer. You have the upper hand in any negotiations. If you’d take them to court they would surely lose, and have to pay costs of your lawyer and theirs. Cheaper to give you what you want.

It seems like the person who sprayed it could see that it was a beautiful field of healthy grass with no weeds should have been able to call back to headquarters to inquire if it should be done or not definitely a total Lac of communication starting with your farmer on Down the Line

They should have insurance to cover the damages caused by their mistakes. You can also file a complaint with the USDA office. But if they don't stand good on their screw up it may end up being a civil law suite. Put signs up at all possible entrances to stay out.

Dang bud. Don't sweat it. Other KZbinrs I watch have had worse luck. Ones son just got killed by a semi and a hay farmer i watch passed away. It could always be worse. This is just a minor setback and you'll bounce back. Maybe fence and gate that field off so it doesn't happen again.

I'm so sorry, this sickens me. I can understand how this could happen because that farmer was renting it in the past. The folks who spayed for him had probably done this for years and never thought farther than that. I know the hard work, the pride and the cost that went into this field, not to mention the same work that will have to be done again. Praying for you guys.

I just saw this. I can’t believe someone would walk onto that field and not question if there wasn’t some misunderstanding. Anyone who knows anything about agriculture would realize they were killling hay field in the beginning of its production life. It must have been the first time the guy ever sprayed anything. I hope you received a good settlement.

This is heartbreaking to watch. I killed about 30% of my front lawn this summer trying to keep the neighbors weeds at bay. Maybe 150 sq. Ft. Burned. I was devastated. I can't imagine what you're feeling

Man Evan, so sorry that happen to you. You deserve to vent. So glad that the company has acknowledged the error. the hay field was so beautiful to see so you know that all the effort you put in did worked. How long does that liberty product remain in the soil? Soil testing again to make sure it is out completely.. You have video of the seeding of the field so the company should make you whole and go over it like you did. Organic hay from your own field for your livestock. That would have been wonderful. We look forward to next year.

Wow. I am so sorry. I really feel your pain. As a fellow farmer, that is a real kick in the gut. They should have to make you whole again, no Better or worse. They do definitely owe you for lost hay, to completely reseed, and all the time and labor involved. Hire an attorney if they do not agree to a reasonable settlement. Oh my goodness! I am so very sorry that this has happened to you. It was a little wrenching to watch you be so angry that you were near to tears on this. I would have been furious and would not have handled it near as well as you did. I sincerely hope that they really do make good on their mistake. At least they admitted it. You have every right to be angry. That rep from the agri company is try to bs you. Don't let him Ask him how much he's willing to spend on legal fees. Let them know that you won't be bullied or taken advantage of. Plus, your out future time. not only are you out hay, you're out livestock income because of their mistake. We once sprayed the alfalfa seed on a field. So work it run a cultimulchger , have them furnish the seed and spray it on . Was the best field of hay we ever grew. Life’s full of set backs but you are showing great poise. Just do your best. Great content 👍.

JudithB--So sorry this happened. Fix your fencing and post it this winter for the future. I would talk to USDA and have them estimate hay crop and what needs to happen to repair your field. Good luck!

Ack... this was three months ago...I hope you can look into seeding it with a nitrogen fixer, so the weeds don't grow. Then you can plant your hay in the spring. Gabe Brown of Brown's Ranch is a farmer in North Dakota, he farms no till and no spraying. I'm sure he'd take your call.😉

OMG, that is SO BAD!!! Your pain and suffering has value as well!!! I would retain a lawyer, I'm not big on sueing but that company needs to have the fear of God in them. Will that herbicide poison the soil??? Don't settle for less than you're worth, the settlement has to be painful for the comapny so they won't do this to someone else!!! It's good you have documentation! So sorry!!!

Offering some practical advice from one who has been there, done that more than once, though it was damage from chemical drift across my corn field in one instance, another time it was a fertilizer salesman's failure order application of the correct rate of fertilizer . Ag chemical companies have liability insurance policies to cover this type of accident issues, however on a flub up this small will probably elect to pay you out of petty cash. Somewhere in the mix of this mistake is a huge failure to communicate within their own company. Find out who gave the job order, as well as who ran the application rig. The prospect of this ag chemical co contracting the replant job with someone of their choice (@ a discount?) is fraught with potential problems, but if you hire the replant, you can have the operator do the job however you want (crisscross pattern). I know you aren't ready to do all the legwork, calculations, etc again this soon - but I must caution that I would not depend on ANYONE this outfit hires to do anything. Too many opportunities to skimp on seed quality, cheat on seeding rate application, plus you lose control of the whole process taking place on your land. That's a no-go in my book. BTW: I have a PhD from the School of Hard Knocks. More work for you, but what does prime farm management cost in your area? Keep an itemized account of your time, including research, phone calls, consultation time. Soil Conservation Service will be able to advise you on an hourly or per acre rate to charge for your trouble. Regional USDA economist are able to quickly come up with feasible numbers, including things you haven't thought of at this point. SCS can also advise on future projected regional hay cost more accurately than most individuals can ascertain through the community rumormill. Some herbicides (Liberty may be one) that leaves a residual carryover in the soil that can effect the subsequent crop. In your high rainfall location this may not be a problem but I believe it can be in low rainfall areas. Go to the Liberty product label to search for phrases like residual effect, carry over, or lists of subsequent crops in addition to effectiveness time parameters. Your SCS office, USDA Regional Research Center may be a more appropriate source than the local chemical companies who will cover one another's backs, because they all have these issues from time to time. Taxpayer funded sources are more likely to give unbiased information to novice farmers. DO NOT allow any part of the replant process to begin before you have a full settlement. Foot dragging is sometimes a calculated tactic in these instances. These situations commonly conclude with a half hearted effort to fulfill a small portion of a verbal agreement, then end unsatisfactorily when the guilty party claims YOU misunderstood their offer. Having a witness present during negotiations is highly advisable. Finally I will conclude with more unsolicited practical advice. Farming is fun, despite frustrating issues that are most assuredly going to recur. You're not a real farmer until you understand that farming is little more than problem solving 24/7/365. Some people are just not cut out for the continual disappointments. Others thrive and prosper in the environment of freedom offered by creating money from dirt. All the best to you in your farming endeavors.

When I was growing up my dad grew hay. We would get between 4 to 5 ton to the acre. Just figure 5 ton per acre and use the cost you would pay for alfalfa hay. In the late 70s we would get $80 to $120 per ton. Right now I'm paying $400 to $500 per ton from the feed store.

Sorry to see this sir. First thing that I wonder about is, will anything even grow in the soil now. You have great patients sir, don't shrug it off to thinking it's just $2k or even $10K. I would think you have more than a year push back with roundup, and what it affects next year.

The herbicide doesn't have residual effects. We will be able to replant the field this fall. It has just set me back about a year. It is very frustrating.

Not the type for a lawsuit. though I'd say if they don't want to reimburse you for the total loss of all, future revenue as well, take them to court. GPS should have told them they were in the wrong field. Also as the one who is spraying a soy field when your not seeing any soy your in the wrong place. I'm not a farmer but I can see the difference between hay and soy.

Two things! 1. ........ Nobody got hurt! Everything else is minor in comparison. 2. ........ You should be compensated to the extent that there is no difference between the compensation and the position you would have been in if they hadn't sprayed! If you talk to others about what you could reasonably expect to have you will have a good starting point for what you want to be paid (everything seems to come down to money)! Was your plan to be Organic .... if so how long until your field recovers? Will the herbicide have any residual effect? Will you have a reduced crop in the future due to this? How much have you invested in the field it money time and effort as well as aspiration? When you have thought this out you will have a ball park idea of what you want off them and how they can "put it right" .... this may simply be cash, someone paid to do the work again and drop off hay (or a combination of both). THEN you can talk about the level of compensation and Why it happened! Remind them you want to make it easy by not litigating and increasing costs and bad publicity! Even if they are of the opinion you are trying to pull a fast one it may be worth their while to simply smile and pay up so as not to get bad publicity! I would also be thinking about the future and how to avoid repetition! At a minimum I would post notices and chain the gateway! I would have a "Cost of Damage" posted at regular intervals too! That would be punitive in scope ..... Say $50K .... and record this on your channel (as well as notifying local companies) That way there is little argument about it happening again! Having said all that once it is sorted you need to let it drop ...... for your own benefit! Don't let it cause more damage than it has to!

Round-up breaks down fast. The Agri-business had better cough up or the whole area will be talking about how they cannot be trusted. They need to replace the whole lot and provide you with the hay you would have harvested. You can go to Small Claims without a lawyer, btw.

So sorry. You can sue them because you have everything documented. We hate RoundUp in Pennsylvania. Our farm has never seen it.

Another old video I’m replying to but…. I don’t know why I didn’t comment then. Because I don’t have the equipment to ready a hay field I had someone come in and do it. Approx. 21-22 acres Timothy/orchard grass mix. Field was worked and prepared meticulously. A buggy was rented with seed/fertilizer mix and broadcast over the field. Then seed was incorporated into the soil and a cultipacker was used. Didn’t get the rains I wanted but got decent germination over most of the field. I had our extension agent to visit for advice on what he felt needed to be done next. Then a few weeks later the field turned golden yellow. I originally thought maybe Timothy/orchard grass might do this at this time of the year. I called the extension agent again and he had no idea but thought someone had sprayed herbicide on the field. I assured him that didn’t happen. He took samples as corn had been planted in the field 2-3 years prior. He said a chemical used on corn can stay in the soil for 3 years. The test was negative. I contacted a wildlife biologists friend and sent him photos. He contacted some other professionals in this field but we still have no answers. This spring I rented a drill and did it all again. Got my fingers crossed. I watch all your videos of you and Pete. Keep them coming. Cheers!

@2:17 Oh Evan, I'm so sorry. I'd be sobbing😭 and red with rage.😈 Then I'd blow my nose and I'd start educating the renters on organic no till farming. The ones who are interested and want to make the switch -- I'd keep. The ones who are not would find their rent raised substantially to cover the costs and set backs I suffered thanks to their harmful practices. Hopefully forcing them to find somewhere else to, eh..."farm." Nothing personal, just business.

Show them how much seed you put down... run the machines till that amount is used up

I certainly see why lawyers are so rich, almost every comment was how you should sue that farmer. Get this amount , get that amount! Mistakes happen because we are all human. I do understand you need the hay to be replaced. But what I also know is that those involved feel absolutely terrible about what happened. Maybe a lack of communication between the farmer and the company that spread the herbicide. I hope everything gets resolved, I am sure it will all work out in the end.

🤨Mistakes happen, I hope that your land don't have any residual effect from the Roundup. The spraying company has to have insurance to cover the mistakes that they make.

I hope they make it good. More like 100 bales of hay per acre. They better reseed also. The farmer paid the company and he should make it good, the company should pay the farmer. Worth way more than 2000 dollars.
