‘My jaw dropped’: Sydney Uni student identifies herself in exam question

Sydney University Law student Freya Leach has expressed outrage after an assignment question included a character whom she and her peers believe was based on her.
The question in a criminal law assignment included a scenario which described a character identified as ‘Freya’, a right-wing student who has unprotected sex while HIV positive.
“To be vilified in such a graphic way, and for that to be distributed to 400 peers, makes me wonder what is going on,” she told Sky News host Chris Kenny.
Ms Leach said she became aware of this when 20 to 30 of her peers contacted her about the use of her name in the assignment.
“It wasn’t until I opened it on Saturday that my jaw dropped and I realised it was actually me in that assignment."
According to Ms Leach, two characters who also share names with students from the course were mentioned in the exam.
“At worst, it was malicious; at best, it was utterly incompetent.”

Yes. I know a few Uni lecturers. It took me 30 minutes to explain how to use a hose 'snap lock' fitting. I think many modern day lecturers paid for their Phd/degrees on line from Arkansas Uni down in Banjo plucking country!

That is not what is being taught in this exam. The fact that this student either couldn't, or wouldn't, discern the difference between the aspects of the question which were material to the matter in issue, and salient to the question, speaks volumes about her capacity to act as a legal practitioner.

As a university Professor myself, and having moderated hundreds of exam papers at other institutions worldwide, I have no doubt there was malicious intent behind this. None of the observations presented by Freya, in such an articulate manner, are justifiable and the academics behind this (definitely more than one) must be held to account. Our universities really are in crisis.

I could see that the names might be a coincidence - peers would not be expected to see malicious name use(but why not use "fictional" names such as "S. Peeder". Politics in the way presented can not be justified though. Especially the lazy political stereotyping.

I want to know how university teaching staff can get such personal information, and think they can flippantly throw it back on a student, or anyone for that matter, without being noticed or without consequences. My guess is that improprieties were committed possibly by a jealous classmate, and/or hacking of computer or phone. A deep investigation needs to begin to check into the misdeeds of a malignant person(s). Would-be attorney, sue their _$$e$. ⚖️

We in the United States know (sadly, from experience) that "internal investigations" go nowhere. If you want change, if you want action, if you want retribution... you must sue them and everyone associated with the exam and the school. Sue the ever-living crap out of them for everything they've got: for libel, for damages to reputation, for political targeting, and for potential lost future income (as this could be a seed planting in the back of minds of clients when it comes time to get a job as a lawyer).

Suing them doesn't help either. Ignoring it could Freya large amounts of money, they can torpedo her career, they could stall this for years, etc. Even if they lose, some insurance company pays, their rates go up, and they charge more next year. Given how much universities in Australia are funded by the government, the taxpayer ultimate ends paying for this.

I think the examiners deliberately attributed right-wing and left-wing to the characters to see if the students can objectively analyze the case despite their political biases. Nonetheless, it was kinda wild that they put the name of an actual student in there, that's where they messed up.

Yeah its a bit weird. Maybe its just the politicisation of the questions and because they used the same name as her she felt some extra need to speak up, or perhaps she does have HIV or there is some story where she ran over someone or there is something going on with Daniel and thats where the actual interest comes from. Can't think why her friends/classmates otherwise would be texting her about it, its not like people see a friends name in a movie or TV show and text that friend about it..

I'm with you on this. There is not enough information here to claim malice. To expect all names in a test to checked against 400 student names is absurd. It is a valid test for anyone to be confronted with people who share their names and have to cope with that. That's what happens in real life. . Also, I see a valid reason why you would want to test someone's ability to separate out the unnecessary info. It is entirely possible that a court case would have someone's political leanings brought in to question, rightly or wrongly. I would only see an issue with this if EVERY question spoke about the political leanings.

I do however think that people who are mature do need to communicate more and a bit better and have more respect for themselves. As soon as people get out of school they think school is everything when it isn't and they forget that they are paying for a service and they are no longer kiddies at school in a situation of glorified babysitting for too long. If this was the attitude things would change vastly and more respect would be created and encouraged at these universities by the people who run them. It's got to a point where I feel universities need to become obsolete and the businesses need to train their own people because they need them, not training people at university for a maybe job in which they've paid thousands

Even if they do conduct a formal investigation, you want to be able to see who did the investigation, who they investigated, what their conclusion was, and why they came to that conclusion. I was in my freshman year in college, and boy the culture shock I experienced when I saw our accounting exam had our names in the questions. My friend was involved in fraud, and I apparently filed for bankruptcy. It was inevitable to be teased, but we would forget it in a while, until another exam comes along. It's a vicious cycle.

You can use they/them correctly as a pronoun for a singular person though. It usually occurs when you are aware of a person but unsure what sex or gender they are usually due to lack of knowledge of the actual person. In that case a singular person becomes they/them, correctly. I haven't seen the question, but it may be valid grammar.

The university is implying to students that conservatives are mean and nasty people, while lefties are society's good and caring people, and are victims of mean and nasty conservatives. Similar insinuations occur in the case studies in clinical psychology post grad training and in gov funded facilities in-service trainings. Those with drug, violence, insecurity, criminal tendencies and antisocial personalities, are often inferred to be conservative or to come from conservative families, when in reality in clinical practice it is mostly the other way around.

From my standpoint, I feel the point is being missed here. This maybe a decision around time constraints, as far as the examiners are concerned - they crib questions from previous papers, to save time compiling the current examination - a common practice in education. However, because the similarity between a real-life person and the individual described in the question is beyond the realms of statistical possibility, it is no wonder that the student complained. I do find it strange that the University is unable to supply the question which it "re-cycled" - that is a red flag for me. What is so secret? By not publicising the relevant papers, it leads us to believe the University is either lying, terrified of litigation, or just plain arrogant! After that lengthy preamble, my point is this: Who at that University, has the thought process which results in compiling a question involving a "right-wing" car driver, who runs over a political opponent, then goes on to have promiscuous sex with a man, knowing she has "AIDS" but not declaring it to her sexual partner? It seems that the question is a product of a warped mind - that of a degenerate. That is the point for me - who on earth dreams up these scenarios? What depraved mind thinks of all the possible political possibilities and current talking points, then includes them into (crams them into), a question on a Law exam paper? I guess we must be grateful that the mastermind behind this question did not throw "Roe v Wade" into the mix! If ever there was an advert for not going to university, this was it! They teach nothing, other than political apartheid. After 3 or 4 years, they hand you a copy of Mao's "Little Red Book" and the red flag, bumper sticker and basebell cap, all with the hammer & sickle logo on them.

I have some experience with exam question writing issues. Writers actually do use names and reference people they know as "inside jokes" thinking no one will catch them. A publisher had one in a school book in the US and a person contacted the publisher furious that her name, town, and occupation (all rather unique) were all listed. The publisher found the complaint very hard to believe but upon investigation found that an employee wrote the question as a "tribute" to a friend (note there was nothing negative or political in the question. It was a straightforward story math problem). The employee never told their "friend" they had done it or asked permission, so the publisher had to apologize and remove the problem. There wasn't anything derogatory in there at least, so it was resolved amicably as far as I know. It seemed to really be an innocent mistake. My point is, this actually happens, whether the school admits it or not. Find out who actually wrote the question and then check that person's social media. Question writers are often kept anonymous because they don't want people harassing them for answers, but the school knows.

To successfully sue for defamation I believe you need to show they knowingly made false claims about *you* and also demonstrate $ damages. Not sure how she’d go proving that the question was about her, and that the obviously fictional scenario was to be taken as fact (let alone the damages)

The question(s) is 1. Did the people compiling the test know the class personally and 2. Was this done after her arrival. If yes to both, then you clearly have some bitter ultra progressive who doesn't know how to keep politics out of their daily lives, wanting to tear this woman down. You should call out the name/s of the faculty members responsible for those questions. They should be publicly shamed if not sued.

I've done these assignments before when I was studying criminology. They are supposed to use names like Smith, Jones, Doe, etc. and leave politics out of the assignment entirely. What the actual hell? Sue the school. Sue it. Sue it for every dollar they have

So the uni has had papers in the past with the name Freya in it so it’s clear they just recycle names. Also, because she leaked the exam to the press before it had finished, the entire cohort has to resit another exam at a later date (it was worth 50%).

If not, rest assured that the same old exams are trotted out year after year, albeit with slightly different details. It’s not personal, it’s laziness.

When I enrolled into first year law, we had a university professor who was incredibly petty and used to bully the girls in the class. This is honestly the type of thing I'd expect him to do. Just to give an example of how petty and nasty he was, he used to walk up to overweight girls in the class and start making jibes about them in front of the whole lecture theatre instead of teaching us law, which is what we were paying him to do. I'm wondering if he's now teaching at Sydney Uni?

I think they mentioned a Freya who drove a Mercedes and is HIV positive, which matches the real Freya, so it’s identifiable and not likely to be a coincidence. At least that’s what I’m reading into it. More info on how she made the association that they are talking about her would’ve been useful. The exam is weird, though - the actions described don’t appear to be politically motivated, so all the political talk seems unnecessary. Different story if they were talking about a political murder or something.

@@lionelpinkhard6509 I hate to say it but we need to know if she has HIV or not. If she does, it’s public shaming. If not, but she does drive a Mercedes, it’s a false accusation. On a side note, if she does have HIV and is having unprotected relations with unknowing partners, she should be educated on the dangers of her selfishness and deceitfulness in a more appropriate and structured way.

I thought this was a situation in which she actually does have HIV and intentionally slept with someone, etc, and the professor/s knew and used it as a case study. It’s just a same-name thing?! I think there’s some overreacting happening here.

The names used were of the people in the class list, but the problem lies with the aggressive political framing of the questions USING the names of the students in such graphic scenarios. Not to mention the tone of the questions. It's harassment in form of exam questions. Imagine if this was done in a high school setting? This is academic power tripping. Even worse is the fact that these are law students, future law makers and workers of justice being taught by professors who DO practice law. The utter lack of integrity is astonishing.

I doubt the exam writer was targeting her directly. But it doesn’t make sense why they include political leanings in the question when it bears no relevance. I do remember those outrageous exam questions scenarios though. They were always pretty ridiculous 😅

@@punisher5558 true but a law exam is never going to ask you what the offender’s motivation was for a murder cus it’s not relevant… unless it could come under a hate crime offence. But I don’t think political beliefs fall under those provisions. It’s more just to make the scenario more engaging for the students, but I think they went overboard on this occasion

They include it precisely because it is irrelevant. A student is supposed to be able to sort through all the irrelevant information about someone and pinpoint exactly why they are or aren't criminally liable.

This is utterly appalling. You should also file a complaint to the law society regarding the individual persons responsible for the question. This is a clear breach of the code of conduct for lawyers and they should be disciplined.
