It would be classified as a Contract for Deed. Usually it can be repossessed if the payment isn't made within 10 days. Buyer loses all monies.

@raykrv6a, I can't speak for all states, but in my state repossession requires advance written notice and an application with the state for a repossession title. She would then need to apply for an eviction, which usually requires 30 days notice for it to be a lawful eviction. If she didn't meet the necessary requirements, he has a solid case. You can't just sell someone's primary place of residence.

Keeping a roof over someone's head is not enabling an addiction, i mean what good does throwing someone out on the street do? Most people living on the streets are still addicts, being kicked out didn't cure them. What are the odds that kicking someone out just jogs them into getting things straightened out? 1 in 10 maybe? Usually they just find someone else to mooch off of.

Well, it was more than that. That is the mobile home cost. But you also pay a lot fee for the spot the trailer is parked in the Mobile Home Park. Plus all the utilities. That would have been quite a bit more than $100 a month trailer payment. Something else is wrong here when he can't get a real job. He seems to have a drinking problem. Maybe she just doesn't want to give him a bundle of money because she knows he would drink it away!!!

Oh and in addition, you get a foreclosure on your credit report as well, no matter how much money the bank made on when they sell the property. That's why someone in the position of the scenario you outlined above needs to sell long before that happens.

@Sith'ari Azithoth The trailer was in a trailer park (probably rent controlled), his mother only bought the trailer, not the space it was sitting on. In the Seattle area rents are rising and trailer parks are decreasing. That is why the trailer was able to be sold at a profit, it had nothing to do with the value of the trailer itself which is probably worthless.

I disagree. She voluntarily offered up this arrangement. After his second DUI, she *FELT* ripped off and took what she considered to be recourse. But, if they had a pre-arranged contract that he would pay back the full price of the trailer (and then some), she wasn't ripped off. Fact is, neither of them got a bad deal. They both came out ahead.

Even after ten years, it was worth more than she had initially asked for it. That just shows how generous she was being initially.

If mom was able to sell it for $16k, it was probably worth double that when she cut her son that super cheap deal.

Some of these trailer parks have no space rent because they are on public land. In the state of Washington there are tons of parks that are on public property. It is technically illegal, but nobody enforces it.

From the sound of things, this may have more in the story. A trailer should have heat and lights. I presume the trailer was on Mom's property and plugged into water and power. There is no way to keep the heat on for under $100/month in Seattle in the winter. All payments went toward utility costs, so this was a 10 year money drain on mom, who probably could no longer afford it. Sometimes you have to read between the lines.

The mother paid $8000 in the beginning for it so the original mass in the first third of the video was wrong on the callers assessment So she invested to help her son out and he took too much time to pay it off One single missed month is breach of contract so she has the right to do what she did and no court room will see differently. He is living in a trailer and thinks that the trailer gained in value over time. Trailers depreciate with time. This whole thing doesn’t feel like 100% truth.

Judy Mckee He didn't buy it, his mom did so the fact he lost his money through being a loser is irrelevant. The mobile home was bought for $8,500. 10 years later sold for $16,000 (so actually 7,500 increase - almost doubling in value.) Putting that same $8,500 money in the bank would get 2% at best which would compound to $10,300 in 10 years. The mobile home returned an equivalent compound interest of 7%. The funny part about that is it's the EXACT same return that real estate property gets in the long term which totally negates Dave's assertion that trailers lose value.

So much bad legal information here. #1, if the bank forecloses and sell your house, you get the equity beyond the banks mortgage amount. #2, if the caller went to court (and the lease agreement is valid) it would probably be interpreted as a contract for deed. Caller would get the profit from the sale, and Mom would get the outstanding amount from her "mortgage" to the caller. That is, assuming he kept up his payment obligations.

My question is, who's property was this trailer parked on? And who was covering the lot fee or property taxes for the land used under the trailer? Because that is also a big factor. $7500 barely covers a single year for a cement slab in California.

I am a drug counselor and this is a situation where he has a serious drinking problem and mom is sick of paying for his habit and enabling her son to ruin his life. Mom is in the right on this one. This guy needs help with his drinking problem first, then he can work on how to handle money. In my field , if you dont work on your sobriety every thing else does not matter.

It sounds like a "rent to own" deal to me. Quite common with trailers. Sounds like mom was way lenient in it. Most "rent to owns" You agree to pay so much a month for so long and then at the end of it, it is yours. You miss just one payment or back out, you lose the whole thing and then the landlord does the same deal with the next guy. I know trailer park owners that do these all the time and they end up "selling" the same trailer several times over before it actually changes hands.

It was still harsh of the mom. If he has a problem how is homelessness going to help ? If he’s weak he’s going to fall down harder. Some people call themselves Christians but have no mercy in their own. Charity begins at home.

enabling a druggie is a cruel thing to do, you have to let them fall it is the only way to get the motivated in 99.9999 of druggie cases. If this guy is a druggie he brought this on himself, druggies tend to burn bridges and use up family and friends till they get to tired to deal with said druggie.

He should have had this paid off in 8 years and 4 months on time. I understand getting laid off or whatever but it's 100 bucks a month. You can make that dog sitting and recycling aluminum cans. You got enough money to go get a DUI but you don't have $100 to make your trailer payment? Mom is sick of your mess, boy, because she knows the part you're not telling. She probably foot the bill for those legal fees too.
