I think money is a really big motivator for most things, if you catch my drift. I do hope that means the city and county basically audited the hell out of them. It should. That's... Just spit balling it, a $120k job? Thats city permits they don't know about. I know it's annoying regarding city permits and stuff but sometimes it's safety because of what's underground and stuff. The neighbor probably gave the city his own address rather than OP's address. The city clerk had no record of tree work being permitted at OP's address. The lawyer should have found that out. Unless the work was NOT permitted at all!

The lumber really isn't missing. Removal of the lumber is a pretty standard service that comes with bringing down trees. We've had a few trees taken down over the years and removal is usually part of it. Essentially, it defrays some of the cost

I doubt they were in on it. They would know the law, types of trees, and the costs they would be facing. It would be nothing vs. the lawsuit. The city could also pull their licenses and any publicity would probably cost them a ton of business. Finally, the fact OP (and his lawyer) didn't sue the company also, would lead me to believe that the company provides proof, paperwork, testimony, and details about the neighbor organizing it.

the company I used asked me if I wanted the main trunk, and if so did I want it sliced into rounds or any desired length, or are they taking the wood too. it came out as a standard part of the initial conversation. heck, he even asked if I wanted the stump and if so any height request. like 'yes, whatever height is perfect for stubbing a toe or tripping over. ' lol

@@SidereusOfTheFallen according to google the tree cutting company could be forced to reimburse the victim. not so fun facts about theft: in some ancient locations thieves had to pay their victims several times the value of the items value, i.e the trees were nearly worth $650,000 so in some places the neighbor and possibly the company would have had to pay $1,950,000. others mutilated the thieves by cutting off a hand.

Apart from trespassing on the property, you can find information about the current laws at regular intervals, at least in my home country, and as a house and property owner you will then automatically become aware. However, every city dweller becomes aware, especially when the city is pruning or even cutting down trees. This will be announced on the city homepage and in local news.

It's insane someone could do this in this day and age. Many towns have stringent laws against cutting down mature trees under ANY circumstances, except if they're almost dead or are a hazard or causing damage. Glad the neighbour is moving; otherwise he might sabotage the new trees.

My condolences. I know how it is. I was my mom's caregiver, well basically her arms and legs as she had rheumatoid arthritis, lupus and fibermyalga. One day in Nov 2016, she was kind of out of it and I cleaned her house and every day I gave her a hug and a kiss before I go but not this day because she was sleeping, and went to work. An hour later my daughter called me crying because my mom just passed away at 62 unexpectedly. Still regret not giving her that hug and kiss and going on 6 years this November, it's still hard.

I have kinda a tree law story, but its wholesome. So my neighbor has this passion flower vine growing on his side of our shared fence. It was growing up the fence and drapes over my side and it looks lovely. All green with these big bright red blossoms that bloom year round. But the fence was toppling over, so I told him we could replace it and was hinting at sharing the cost, since its a shared fence. but he said he was fine how it was and if we wanted to replace the fence, he's not going to pay for it. I didn't want to argue since we were good neighbors since then. and if one party disagrees on a shared property, he has the right to refuse to pay for its maintenance. Basically, he didn't care about his backyard and I did, since I had babies then and wanted the yard secure. So I asked him if it was alright if I went ahead and did it if he'll just give me access to his yard to go to work. He was like "Have at it." So I had at it. I had some workers come and we cleared away some foliage on his side but I told them to make sure the not destroy the passion flower vine since we all liked it. but it was for naught, they had trimmed or pulled sections of the vine along the property line to clear space and by the time we finished the fence, most of the vine had dried and died off. I told the neighbor that I was really sorry about the vine and if he wanted to I'd pay to get it replaced. But he said it was fine, the root was still there and it'll regrow after it regroups. Sure enough 12 years later, its taken over the fence again. Its also jumped the government easement to hit the utility pole and has now fully covered the pole all the way up to the power lines. Like one of those plant monsters from a green apocalypse.

Last January, I came home from shopping to find my over 2 story high 30+year old coconut palm, completely erased from the corner of my garden in my unit...5 metres away from the completely brown and dead 30yo pencil pine that was to be taken away. Oh the shit storm that followed was massive and is still ongoing. The stupidity of it all was amazing... and then came the gaslighting blame game with outright lying to my face. Mine was just 1 huge beautiful palm and Im still livid over it, so I cant even begin to imagine all those trees gone, heart breaking!!!

I have a few on my property, and I would be furious if someone cut them down. Take the live oaks if you want, but leave the white ones.

That was probably a criminal case for "forging and uttering" and may have still been ongoing at the time of his final report. "Forging" for making false papers saying the city had ordered the destruction of the trees, and "uttering" for using the forged document.

He may have "settled up" with the neighbor, but he likely can still go after the company that cut down the trees. Sounded shady (har!) from the beginning if they "couldn't find any records" from the city authorising the work, so likely they were in on it with the neighbor. Maye them pay, and pay *big,* for their part in it.

I'm so happy there are sensible protections against the cutting of other peoples trees. Each tree is truly unique and they take such a long time to grow. If I could afford a villa with a yard, I'd probably go for one with a big and beautiful leafy tree. Probably a Birch if it's close to where I live, but oak, cherry, alder, poplar or elder if further south where they can grow large.

You have to be notified before any action is taken on YOUR property. If you're not in the city/town, they have no jurisdiction and it's the call of the county officials. Sue for all you can get.

Regarding the pigeon story. While it is expected, i do recall that bird poop is highly acidic and that can cause damage to the car's paint in a similar way to egg and the egg yolk. So i can understand why the neighbor didn't want the birds to shit on his car.

At least in my area, which is on the other side of the country, the town will sometimes trim branches hanging over the road, especially if there are power lines involved. They'll only take down a tree it it's actually leaning. It's really rare.

Treble laws means that if the court agrees it was so egregious that they pay triple the cost, so OP could plant 3 times the trees then were there before. Not sure why they exist, but I'd guess they were meant for the state and for wildlife sanctuaries primarily, that way people REALLY have to think about if it's worth the risk. That Neighbor might not have been too wealthy. He might have been upper class Rich, but 100% sold both his Summer home, and his normal home. Plus that company could go under, as they committed multiple crimes either willingly, or negligently, meaning they were either accomplices, or they were just too stupid/lazy to do their due diligence.

Implied in the story is that the neighbour forged documentation from the city saying that the trees had to be taken down and the company believed it was real. Also implied in the story is that the neighbour was criminally prosecuted for both forging the document(s) and using them. ("Uttering" is the legal term, I think) The tree company would only have been in trouble if they had reason to believe the documents weren't genuine and ignored their suspicions.

Oh my Lord, that half a tree was such a bad idea. Surely they could have done something else. Poor tree got a bad haircut, it looks like when a barber's hand slips with the electric razor. I get it bird poop is annoying especially when you just cleaned the car but the tree was there first and can't move. You can park further up or down the driveway.

The city or county (in the U.S.) will never give someone else permission to cut a tree on your property without notice, and never a neighbor. They'll post a notice, or mail one, if a tree is causing problems and give you time to remedy it yourself. It'll be something like you have 90 days to trim this tree back as it's obstructing traffic. At the end of the 90 days, not even on day 91, just whenever they get around to it. They'll send/post another notice saying they're sending someone out to take care of it and it's going to cost you X amount in fines.

I never understand people who cut down trees not their own. As for the pigeons in the last story, we have one we affectionally call Sunday Dinner. It is a fat pigeon. Always after the bird feed. Round the garden, sitting on the shed watching and waiting.

I know exactly why I like tree law stories, because it usually starts out as a "r/LegalAdvice please help!" post and usually ends with the AH neighbor getting smacked down hard. It is like a pro revenge story that is actually true. I mean, sure you could try to fake one. But to do that you would have to play the long game. Mess up the pacing once and the sharp folks at Legal Advice will notice and you end up on r/QuitYourBullshit.

Oaks are so majestic when mature, and just scream 'shade and a cocktail'. (Is that just me?) I love how you get so excited about certain subjects like neighbours and tree law! How is your neighbour who peeks over the fence? I'm dealing with a bit of a tree law thing myself.. a junk tree (not anything nice like oak) is dead next to my house, but it's not on my property. It's partially on my neighbor's, but mostly in an alley not even my city owns (I checked!). Unfortunately nobody seems to care that the tree could drop a limb on a car or pedestrian any day now. But I also would never, ever pay to get it removed myself. The owner of the property it's partially on probably doesn't even know it's dead because he's a landlord and barely visits it. Since the city doesn't own the alley, they won't even send an arborist to look at it. Veeeeery frustrating.

I work at a power company, and the amount that I have had to tell people that no, I cant take the light the neighbor is paying for and is on their neighbor's property down unless your neighbor says so... or even ask us to cut someone else's trees. Unless the tree is dead, fallen on the lines or an imminent threat, we cant touch it without the permission of the property owner... And also people get mad that we dont take the wood away if we do cut a tree on their property... no winning on that one

Mature White oak trees are the most expensive trees to replace. Primarily due to the tree's root system (very deep and wide spreading, cities adjust underground systems to accommodate them) (after cutting them down roots must be dug up before new trees to be planted).

The neighbour who saw the trees getting cutdown said they were shown a city ordinance, so did they have a fake ordinance? I was thinking the trees were along the property border, but they were along the property that bordered the road, so that’s even more audacious than cutting down trees on a shared property line.

Reading between the lines, I'm guessing that the neighbour forged the documents and probably now has a criminal conviction for what is known in legal terms as "forging and uttering" to go along with his multi-hundred-thousand-dollar compensation bill.

In Australia there's a law that whatever tree branch/branches, tree roots and plant have grown over to your property, you can cut it back to the fence line If a tree has grown over by several metres, you can cut it back, especially if they have invasive roots

The story you told about the neighbor's tree is what happens to all of the trees downtown. The city cuts them that way to keep them off of the power lines. I live in Arkansas, city of Conway, I guess it doesn't kill the trees if it's done right.

Tree law! Tree law! Tree law! I hope that neighbor got slapped with the ring-bearing hand of the law for forging government documents. He probably had to go out of his way to find a company he could trick into cutting down protected trees, which is why OP had such a hard time finding them.
