There is definitely a shortage of medical personnel nationwide, but the hospitals expect those who remain on the job to just absorb all the extra work of those who are let go.

Does no one know this hospital is in the midst of controversy and lost the love from the public it is supposed to be caring for? They were performing irreversible Trans medical care on literal children and wouldn't stop till we made a law to make them. This is the result of bad business practices and a terrible economy. They lost so much funding and donors when a doctor rated them out. I stopped donating myself. I understand it wasn't a lot but I'm not alone in this. This is just the consequences of their actions. They knew we didn't support it and they still did it.

Hope she wins. This lady relocated from a different state and spent 20k to relocate. Why should individuals give a two week notice while employers can release on the spot.

@@MakeWay4CJ Per the segment she was offered the job but not hired. Per the segment the job was resented while she was doing her medical screening, did she fail that screen? Why sell her house and move her family before getting hired? Is she impulsive, that is a red flag about her ability for decision making. What was the exact reason per the hiring department that they did not hire her, we only hear her side. There is more to this story than she's telling.

@@i420Austin420iYeah, I don’t see the case against the hospital. Her offer letter probably had a clause about rescinding without cause and that her employment was at-will. If the hiring company knew about the freeze, they probably have some liability, but I don’t think the hospital has any liability.

She also did not technically start the job, so I imagine there was a clause about rescinding the offer without cause. I don’t agree with it-especially in this unfortunate situation.

@@wendy833 it’s the same at the hospital in my area. They have 42 Vice Presidents, more than 1 per department. Every few months they create a new VP position to promote someone else to. The hospital is bleeding money. They were even caught stealing the frontline worker bonuses for the regular staff to pay the hefty paychecks at the top. These hospitals need to be investigated

They hardly have any doctors and nurses working its like they have less than a skeleton crew. To freaking cheap to have enough staff working.

Because they aren't. Medicine isn't Marcus Welby of the 50's, or even the Huxtible's of the 80's. Event the good, caring people still in healthcare are tools of the greediest of corporations. Sorry.... I'm all about capitalism, but some things shouldn't be about the money. And capitalism would work just fine if our useless politicians in DC weren't in the pockets of big corporate conglomerates. It's called "crony capitalism" and the republicans are just as guilty of it as the demoncraps.

Is it just me or does it sound like she should be suing the hiring company, not the hospital. Report said the hiring company knew about the freeze 2 months ago and had her continue the process anyways.

How was she able to continue the process when they had a hiring freeze? How was she able to interview with anybody at the hospital? All of that should have been canceled from the get go. The hospital and agency are at fault here.

Believe me, hospital administration is mismanagement on steroids. It seems HR talent management and clinical management are never on the same page. I worked with a hospital recruiter for months on a salary, schedule, and credentialing only to show up and the clinic director said they knew nothing about this agreement and that's not what the position actually required. I walked out and was in a position to find another job but it must have cost the hospital thousands of dollars in the recruitment process all for nothing. Yes, sue the pants off the hospital because they have overall responsibility for hiring, even if using an outside agency.

I moved across the country for a government job and before I moved I accepted the tentative offer and was "hired" before moving. The employment checks such as extensive background investigation, physical and approved onboarding documentation were already completed. There was no longer a job offer to pull/rescind before I moved because I was already hired as an employee. This is crazy to move to another state based on a "job offer" that could be rescinded at any time.

Most of those who are overpopulating TX nowadays are doing so for a "job offer" or what they are hoping it is because they just want to get away from their states. The likelihood of getting the permanent offer once you get the tentative offer with federal job is pretty high, but even then you moving at your own risk pending the security background check, or even position being cancelled.

To say that it’s not the hospitals fault is inaccurate. She still went through the on boarding process at the actual hospital. Throughout the process, I’m sure she was not only communicating with employees of the employment agency, but also employees of the hospital. Neither company could take the time to inform her that she was not getting hired?

This is why you NEVER move your entire life upon accepting an offer in another state. You should be prepared to have temporary living arrangements in the target state until you at least pass your probationary period. You need a plan in case things go south because there is very little legal recourse unless there is blatant discrimination that can be proved. Texas is an "at will" state so you can be fired for any reason at all.

Absolutely nothing of what you said applies here. You're blaming this woman instead of the hospital which is the only party that caused this issue. This hospital is going to lose big against her. And I promise you that they will try to settle out of court because it was THEM who are at fault here. Not the woman. What the hospital should've done is to issue a relocation package AFTER she had been hired and AFTER she had earned her first paycheck. That's how its usually done by professional and responsible institutions. What this hospital did was scummy and unprofessional. And that is why they will lose this case in court. So wouldn't she have a case against the recruiter rather than the hospital? The hospital notified the recruiter but the recruiter decided not to inform her (likely hoping the hiring freeze would be dropped) She wasn’t working with the hospital recruiter but rather a 3rd party recruiter.

Exactly she has a grounds to sue to the recruiting company that failed to tell her about the hiring freeze at the Hospital. This is the one thing people missed in the entire story. If the recruiting entity knew about the hiring freeze, they had obligation to inform any potential people they were trying to recruit for the hospital. So the Job Offer was more from the recruiter than from the hospital. A misunderstanding at the end of the day.

Moved myself from CA to NV for a job. Didnt take the whole family or even rent a room for myself till orientation was completed and a start date was given. Than after that i just rented a room didnt bring the whole family and get a home till training/probation period of 3 months was completed and i was assigned my own route and an official employee. We are lucky though to have plenty of family in both states. Wife and kids stayed at MILs during that time same town we were living at and she helped me get a room from an aunt who is a real estate agent.

This is sad. I'm glad she was able to find another employer quickly. Children's hospital's around the country are money pits, so please be mindful when applying to them specifically to work with children. All of them are operating in the red.

That is NOT what it said AT ALL.... Nothing about "contingent upon medical screening" ( while I agree the story would lead a "non listener " to jump to that conclusion....it was an unnecessary red herring...that helps half-paying-attention types to get "lost in the weeds") It said she was told there was a hiring FREEZE (nothing about a damn medical screening ) that the 3rd party headhunters they were using did not rely the data properly That is a communication gaff between who THE HOSPITAL works with to fill positions and the hospital....NOT the applicant. It appears SHE got caught between whomever in HR and management didn't update that whatever allocations they thought they had got cut or something But nowhere in that piece did it say her offer was contingent on passing medical screening ( which some gigs are) nowhere did it say she FAILED a health screening. Health screenings aren't at big a deal IF asked for....any sane person could fly from John Wayne to Houston for a health screening and fly back the same effing day....that wasn't the case .....that she did all that where it was "only" about a medical screening did you 👂 🙉 listen

She needs to sue not only the hospital but also the hiring agency too! Both were trash for doing this in the middle of the hiring process! Thank God she was able to find another job at a much better hospital, but what about all of the other innocent people who were hired? They also applied and more than likely had their job offers taken too even after relocation, they should all file a lawsuit too.

I would say the Recruiting Entity is more at fault than the Hospital. We don't have any information how much the Hospital HR Department was involved or when they got involved in this process. Regardless when the Recruiting Entity contacted HR, requesting for Medical Examine and other onboarding process, should of pumped the breaks, an re-inform the Recruiter about the hiring freeze, so that the Recruiter could tell her that there was not a Job Offer on the table. Just because the Hospital has more money to get from law suit doesn't mean they are valid party to go after in this case. It appears the Recruiting Entity is the one who should shoulder the responsibility of covering any part of the 20k she spent for moving her family, especially if the misled her in believing that the Hospital was moving forward with the Offer they supposedly secured for her.

The news story does not clarify if the hiring freeze affected people already in the process. Also from the news story it seems the hospital was still actively going through the motions of hiring. Information is missing from the news segment, but either way, this family made large financial decisions based on the expectation of employment, and that the family did their part, but were mislead by either the hospital, hiring agency or both.

How can you say it bait and switch, we were never told how far along the Hospital knew about her "Job Offer". If the Hospital HR knew anything before she moved, then yeah they would be open to law suit. If the Recruiter didn't inform the Hospital until after she moved, then it on the Recruiter only.

Not surprised at all. We moved from McKinney to Ft Worth as part of a requirement for a job he took at a law office (Keith Law Firm), then 2 months later the attorney fired all the new paralegal hires who had each moved for the jobs, 3 in total. Between moving there and then having to move in with my mother we lost all of our savings, $14,000. Then he was told Not to sue to get it back because he would never work again if he did. Years later we still haven't recovered.

Never relocate for a job, NEVER. This happens more often than you can imagine. Top tier people get to sue because it's worth it for a law firm to take the case. Lower tier people don't stand a chance.

Texas is an at will state, maybe anyone relocating should only do so if company pays for the move and has a contract in place if they do an RIF. If all this is not in place, I wouldn’t relocate and accept all liability and risks.

For something like that, always get a signed contract. Hire a lawyer, spend a couple thousand to get those situations covered in writing. Don't spend a single dollar for the new position until that contract is bulletproof.

I've heard of this happening so many times, but usually in tech companies and related start=ups. Generally speaking there is nothing an applicant or new hire can do about it, as long as it is a bona fide business decision and not aimed at the employee specifically. In this case, since it was known that the hospital had a hiring freeze in place, the woman has a reasonable right to expect to be informed about it by either the hospital or the recruiting company. While the outcome of no case is guaranteed, Scholl and his client seem to have a much better than even chance of prevailing in court.

I believe this is normal here in the U.S. since they have at will position. Technically they can let you go anytime even a week after you get hired without any reason. Even if they say it’s permanent position, it’s not really permanent. We should make the changes, we should never accept any position out of state so they can change the rule to become like Europe where they have better job security.

😮😮I worked for state government. We would interview. Then, I would call back the best candidate for the second interview. At that time, potential employees were finger printed. The actual offer would not be made until AFTER a background check was completed.

Howdy, I'm Mrs. Pedram's attorney. You're right. This 2 minute video is merely a snapshot. If you have any questions, I'd be happy to answer what I can here. First, she had a written job offer with a firm start date, hourly rate, and a slew of other paperwork. This was after over two months of interviews. The decision to move wasn't impulsive. It was a long drawn out process with multiple panel interviews, background checks, drug tests, health screenings, references, and more. They were in contact with her through text messages and emails the whole time. They knew she was moving from California. One text message wishes her a safe flight home. The whole thing is outlandish.

I actually heard about something similar last year when tech companies started laying off loads of their employees: there was a person who had already signed a lease for an apartment in California to start their new job but right before they were due to start they received a notice that the job offer was rescinded because the department the person was to work for had been downsized. It is BRUTAL to do that.

Howdy, I'm Mrs. Pedram's lawyer. My client diligently mitigated her damages as was her duty to do so. Even though she found a new job, she has to wait another three months for hospital privileges. She is going 5-6 months without a paycheck.

The CEO makes $8 million per year. I'll give him credit for being CEO since the 1980s, though. However, I've seen the hospital in my state become an extension of bloated administrative salaries under the guise of "competitive". These executives job hop from one governmental institution to the next, often making everyone that works there focus their energy on making the executive look good so they can continue to climb the ladder, and absorb massive salaries while pushing the functional people out. It's not about helping people, or making health care more functional, it's all about appearing to make money or save money on paper.

It says the job offer was resented during her health screening. I wonder if she didn't pass the screen. The report says she had a job offer, not that she was hired. It's not the hospital's fault she jumped the gun, sold her house and moved her family across the country. That's a decision she made. Maybe get hired first, then make major life changes. If she was already a resident of Houston and this happened would it be making the news? She chose to apply in Texas while in California. She chose to sell the house before being hired. She chose to move her family 1500 miles on a job offer, not a hire

I had a tentative offer quietly revoked with Department of Justice after their rather weird CFO meddled and jumped to incorrect conclusions about my background. The deputy CFO had the audacity to make disparaging comments about my professionalism in his response in the complaint when I did follow-ups checking on my on-boarding progress. Yet, from the findings of the investigation they had already determined not to hire me before that and didn’t tell me. In fact, they lied to me about my continued candidacy three times. Speaking of unprofessional behavior! Filed an EEO complaint, and they settled. Ironically, they ended up doing me a favor for other reasons than solely the way they conducted themselves.

Texas is an "at will employment" State. At-will employment allows employers to end employment at any time, for any reason, and employers don't have to give notice or state a reason for termination. (You can thank Republicans for that).

Unless it's actually stipulated as a condition of work , with a signed contract . You are under no obligation to give 2 weeks notice in any state . Even if contracted most employers will not try and enforce it due to costs of legal services.

Howdy, I'm Mrs. Pedram's attorney. I appreciate your feedback. Yes, while Texas is an At-Will Employer state, the matter at bar concerns issues in the realm of contract law, not employment. The main claim here is called Promissory Estoppel. TCH made a written promise. Mrs. Pedram relied on that promise to her detriment. The reliance and detriment were foreseeable. She was not yet an employee. Her employment had not yet vested. She wasn't fired. They failed to uphold their promise.

Agreed. It’s also employment at will. You can be fired at any time and can quit at any time. The time between jobs is when you’re most at risk. Just move on with your life. Nobody wants to hire someone who has sued former or prospective employers. This isn’t Kally-forn-ya. You’re not entitled to a job.
