Should the Landlord issue an N4 to the tenant for May rent not paid and follow up and file L1 with the LTB?

We are not permitted to tell you what to do, however the process is an N4 (14 days notice) followed with the L1. To get to a hearing can take upt to 6 months.

Can N12 be served on a residential fourplex?

Unfortunately, we cannot give legal advice. You may want to refer to the N12 instructions that the landlord and tenant board has on their website.

N12 was made on 03 May 22 and handed over to the tenant on 06 May. The termination date is 03 July. L2 was filed on 03 June. Tenant has not paid rent for May and June 2022. Does the landlord still have to pay one month rent to the Tenant before 03 July?

As long as one month rent is given as compensation the board will be satisfied. If you are going to apply a non-payment to the compensation it needs to be in writing to the tenant letting them know its be applied.

If the tenant pays rent on the 1st of the month, then the termination date on the notice needs to be the last day of the rental period for the month. If you gave the N12 notice to the tenant on May 6th and gave them until July 3rd to move as the termination date then your notice is invalid and will be thrown out.

After receiving a N12, can a tenant elect to end their tenancy without a hearing? Would an N11 be necessary in this case, or is a N12 sufficient? In other words, is a hearing always mandatory when a N12 is served?

We cannot give legal advice. You will need to call the landlord and tenant board and they will give you free legal advice.

Typically how much is cash for keys? One month free is what govt requires landlord to give the tenant. How much more is normal?

Each cash for keys is different so its hard to say how much a cash for keys is. Something to think about is, what does the tenant need to find a new unit? Its a negotiation with the tenant to see what their position is.

if I filed N8/L2 on May 1, when we go to court for hearing? is it possible only tenant goes for hearing without landlord? or always both must be present at the court?

What is the average wait time with an N12

The current wait times are 7 to 8 months just to receive a notice for a hearing.

OMG, insanity in Ontario. This is not worth any money to go into real estate in Ontario. There is got to be a better way to make money.

I have renters that pay on time with no issues for three years now. I want to take possession of the property to use for myself now. Will cash for keys work for me?
