Defense attorneys call more witnesses to the stand during the morning session of Day 15 of the Nancy Brophy murder trial.
Nancy Crampton Brophy was arrested in September 2018 in the shooting death of her husband Daniel Brophy.
Daniel Brophy, 63, was killed as he prepped for work at the Oregon Culinary Institute in southwest Portland on June 2, 2018.

This niece is coming across to me as a liar. She never finishes a sentence, she keeps stopping herself and as if you’re not going to remember discussing who might be responsible for her aunts death. As if you can’t remember your aunt owned a gun when her husband was shot to death. Just tell the truth ! These people who lie and are evasive just make things so much worse for the people they’re trying to protect.

What happened with the shower door just exploding into little pieces? His hands and feet were all cut up? How does this just happen? No one ever investigated this? It was “an accident.” I’m not saying that Nancy did it somehow, but it seems suspicious to me. Anyone else?

For me the defence strategy is backfiring. Showing how "hoarding" Dan was, all his collections and projects just highlights more motive for Nancy. It shows her growing intolerance and jealousy of her much talented and loved (by others) husband. He had to go and the money was her ticket.

I agree. Anything negative about Dan is gonna backfire: he's racked up a huge amount of sympathy in this trial, as have his parents and step son. Trying to sully his reputation will heighten the animosity against Nancy.

@benjaminperez1149, yes!!! I cannot believe how young her hands look! I thought I was the only one! I’m in my 60s as well… poor Dan was the one who did all of the work around there (inside and outside the home). He worked two jobs, did all of the cooking at home, did the laundry, and worked tirelessly on the garden, etc. Nancy sat in her bed sipping Starbucks and writing her awful, trashy books that nobody wanted. She had a lovely life, a lovely home, and a lovely husband but didn’t appreciate any of it. She burned through money faster than Dan could make it.

Hearing their schedules it seems Dan was a lot busier than Nancy, I'm shocked he had time to do the laundry. They had a maid so exactly what did Nancy do in the house????

Nothing. She did absolutely nothing. Dan worked two jobs, walked the dogs, cooked all the meals, and even hand delivered Starbucks to Nancy in bed, EVERY DAY. While she did nothing but lie in bed and spend all his money.

I will admit to some bias ( based her van being near the school) but all the defense witnesses are doing a better job for the prosecution, in my opinion.

I disagree. The 2 defense witnesses saying they worked at BMW didn’t provide much, the officer destroyed the idea that there was a random person on the roof, and the earlier witnesses that did yard work were terrible. The landscaper couldn’t even remember his niece’s last name and the niece was a terrible witness because she lied in the stand.

I completely agree the prosecution used a graph that the defense made in their closing. It made me laugh a little. But she's obviously guilty and so unlikable they don't have a lot to work with. Nancy should have never taken the stand. Her laughing and jokes were so inappropriate it was shocking.

I cannot understand why the witness box is so close to the person on trial. All the defense witnesses look over at 'that woman' in such a friendly way, it is like they are just there to have a chat and do not appreciate the serious nature of this trail. I also find her two lawyers to be trying to make it also a casual event, with all their chatty ways. When one of them asked that the male prosecutor not come near, implying that he still had Covid, that was disgusting and the judge was far too weak in the way he dealt with it. The defense game is to drag Tom, Dick and Harry as witnesses never mind they have nothing to say.

This Susan witness is a variant of Nancy: snake with an overlay of nice. Talky, even though she says she's reserved. She talks to control the conversation. Gives me the creeps. She also keeps rolling her eyes during cross and sending facial messages to defense, and you can tell she's trying to manipulate the answers. Prosecution needs to make her stick to short answers and answer precisely unless they have a plan to hoist her on her own petard, which is very possible. So manipulative. Very coached. Nancy gave Susan enough $$$$ after she murdered Dan to buy a car? And Susan says she did 2 months of work, so much work, so a car was compensation.... I don't live in a universe where 2 months' work buys you a car, and Susan doesn't seem very skilled. If I recall, Dan's folks did not like Susan, though they were diplomatic..... I completely get it. I am creeped out by the nicey nice and soft voice larded over lies and deliberate vagueness. Prosecution should fatigue her by keeping her in the hot seat, and see what happens. Maybe that's why they let her rattle on. At some point, fatigue will take over and she'll lose her temper (it's already flaring), show her true self. Nancy clone.

Listening to NB's niece. Testimony has blown apart with the fact she signed all of Dan's Life Insurance policies and thinks they were years ago.

@@StellaFl Totally. Susan wasn't even the one cleaning the yard. That kind of job takes hard labor-no company was even able to do it until they finally got the old guy and his niece, and Dan certainly wasn't able to do it. No way Susan cleared the yard. It's unclear whether she did anything at all in those 2 months, as far as I can tell. She didn't pack boxes, she didn't move boxes....nothing. Just like Nancy: never lifted a finger and thought she deserved big compensation.

Prosecution got Susan good when it backed her into a statement that if a family wanted a whole pile of insurance more than one company would underwrite, they could potentially do a bunch of policies in order to get all the desired coverage. Need-based. Nancy's need was $700k+ insurance on Dan. Bingo, per Susan, she had to get many policies even though this was not regular.

'That woman' niece thought she was there to do an educational course on the Insurance business. I am also so confused about these Blackberry bushes because she and her boyfriend spent days to clear them, yet the old feller paid to clear their back-yard was also clearing these before the murder. Then his niece, after the murder, got a nice sum of money for work, including the bushes. There must have been acres of the dam things, smoking mirrors here!

Oh yes, the Himalayan blackberry is an invasive species in Oregon. They are thorny shrubs that can grow up to ten feet tall and will take over anything and everything they can grow in. I'm pretty sure they're a problem in New Zealand and Australia as well. My grandfather's favorite nostalgic dessert is blackberry cobbler because of the ridiculous amount of work they had to do as children to keep the blackberries from taking over.

I finally realised who she reminds me of: check Dan Markel's ex wife Wendi Adelson in the recent trial. Same wide doe eye look trying to appear innocent, same expression of not understanding a question or being surprised by it being asked. Also Susan's feeling let out when she expressed defensively how she felt like it was so normal to get so much money to buy lexus after helping a family member ..she feels entitled and I think she is a user like Nancy. And she is lying here. Nancy herself admitted that later on the stand saying " her niece was confused". .

She seems untrustworthy to me because she won’t simply answer the questions. She consistently gives more than is asked for which is typical of being deceitful. It’s like she’s trying to convince the listener with superfluous detail. It ain’t working.

These defense witnesses are laughable. I’m sure the prosecution is thinking, ‘why is this person even here?’ I guess when you have no case, you must attempt what you can for your killer client.

Wait. The witness are doing a good job trying their best to provide evidence in a murder trial under a lot of stress, except maybe the experts. They are not laughable. We don't know the defenses reasons for bringing in their defense, weak as you may think it is. She is not a convicted killer. Please, be respectful of the process.

In the defense's head they do serve certain purposes. For example the TWO mechanics were there to support the narrative that Dan was killed by a burglar. They were obviously called to instil doubt by saying there were frequent break-ins in the area and stuff was stolen. However, in Dan's case nothing was stolen and it's not like he was killed during a fight with an alleged intruder. The man was shot in the back. The lady with the dog testified the door was open (same intruder narrative). Nancy could have left the door open behind her too though. And the question the male prosecutor asked her during cross "Did you feel safe?" was clever. The police officer blew the "footsteps" theory (same intruder narrative) and the niece was a character witness to tell the jury what a wonderful person Nancy is and what a wonderful marriage they had. But facts are facts, there was no way she could circumnavigate the facts she was the witness in all SEVEN of Dan's policies. That made her look complicit imho.

Who is James Denney that the prosecutor asks about? Susan says she never heard of him. Later edit: he's the landscape gardener nancy hired. Oooh, good one. That prolly means she wasn't in Portland helping Nancy when she said she was.

Defense is awful, were they court appointed? It’s obvious how much contempt Ms. Maxwell has for Male witness’ , she becomes engaging and soft with female . Her hands in her pockets with her gut hanging out is pretty unprofessional.

I was wondering that too. Dan worked 2 jobs, tended to the animals and his garden, did the cooking and cleaning. What on earth was she doing? By looking at the insurance on each of them, it appears Dan was the main breadwinner so she can't have been working THAT hard.

@@StellaFl I don't think Nancy was doing any kind of work. The prosecution is putting that out there. The bulk of the insurance biz was 2011-2012 with Susan. She was spending more on Starbucks per month than her entire income. She shoulda taken that cook job instead of making Dan do it. She shoulda been working at Walmart, like normal people who struggle to make ends meet.

Omg he did his own laundry too?! Probably threw a load in on his way out to Starbucks for Princess Nancy before he left to work a 10 hour shift, feed the homeless, and return home just in time to put on a 3 course meal & clean it all up. Oh and care for his chickens!! Dude was AMAZING 🤩

That niece imo is hedging,lying! She stammering, hesitant,mmmm,uuuh,nnno, doesn't answer or will finish answers. I'm surprised the judge let's them answer with a head shake,or uh-huh,yep,yeah. And can't remember, can't recall,starts answering the prosecutor before he's finished with questions! She makes me tired, watching, listening to her!! Worse than nb!!

This prosecutor has an awkward way of asking pointed questions that lose the impact of their importance to me. The female prosecutor has a better style and is more effective. He needs to be more focused and less “hesitant”, in my opinion.

The male prosecutor seems to ask questions where his point is contained in the question, not the answer. We found out a few things this way that weren’t in evidence. For instance, Today he emphasized the 7 insurance policies in several questions. No matter what BS Susan answered, a jury would remember the 7. @@barbaragrove6097 I think that, too. He seems so plain vanilla, boring almost, and then he'll ask a question where the question is what he wants us to know. I get very impressed by this. It's often some key tidbit that we haven't heard before. The highlight is the question, not the answer. I think this prosecutor is very relate-able, even though I wish he was more exciting because that would be more fun.

2:31:28 The prosecutor is SO disgustingly rude. He is not artful enough in his questioning. So he gets agitated and is almost yelling at the poor woman because she is not making statements that fit the narrative that he's trying to weave. This woman did not kill Dan. Nancy Brophy killed dan. So the aggression is not warranted. So he's making this woman look sympathetic. I can see why his law firm failed. probably lost a ton of trials.

I don't understand all the hate against the niece. Nancy and her defense lawyer are positively _insufferable,_ but I don't see anything the niece did to deserve all the vitriol she's got in the comments. She seems pleasant enough to me. 🤷‍♀️

I think you just need to re-listen to the niece ....this POS is lying on the stand under oath.While doing a horrible job at it. Yes most if not all of the defense witnesses lied alot, but this chick, she lied AAALLLLOTTTTT...and doubled down on it. There is no way that she was with Nancy when Nancy asked for the letter from the police. Nancy was actually with Dan's son when she got that call. However this POS is lying like no other...perfect example 2:41:49 This idiot expects the jury to believe that her and Nancy never talked about the police. Which everyone knows is absolutely ridiculous. If your super close to your aunt(aka your birth mother) there is no way that Nancy would NOT have told her everything about that morning seeing as how Nancy loves to tell stories.... The prosecutor doesn't have to be a jerk to all of the defense witnesses. He's incapable of asking simple, non-compound questions. And then he gets frustrated when people don't respond the way that his little script says they should. There is no doubt that Nancy is guilty as sin. But the prosecutor would have trouble convicting in a case where there was actual reasonable doubt. He makes a ton of tactical mistakes and, like Nancy, he thinks that he's smarter than he actually is.
