Appreciate your very definitive emphasis on Agent fiduciary duty. The consumer is very vulnerable without a fiduciary. In Florida, for example, in 1953, the Florida Supreme Court even exempted realtors from the unlicensed practice of law in the preparation of legally binding purchase & sale contracts between Buyers and Sellers. But standard realtor practice (at least in Florida, now supported by Florida state law) does not (I repeat, does not) have a fiduciary component. See Florida’s Transaction Broker default status that even removed common law fiduciary duty.

I was in and out of the room for the MLS forum. I had to pop out a few times, but I didnt see any of what Rob Hahn wrote about. I also spent a lot of time that day, and the following days with people who were on the panel, and not a single one of them mentioned anything about what Hahn claims to have happened.

Good point about financing commissions. Fannie and Fredie won't allow financing of furniture or personal property. They sure won't allow financing of fees.

Rob Hahn speaking as an authority on the practice of real estate is a fool's notion. Those fortunate enough to actually work and train with Anthony Lamacchia witness every single day the processes and resources (= money) dedicated to aligning with the law and MLS /Board regulations. For anyone to suggest that Anthony would teach a "master class" on breaking the law is lacking in knowledge, brain power, or both. To see Hahn in such a comfortable place with these shortcomings while wielding a microphone or keyboard is on par with his brand; much like the droning white noise humming from the app I fall asleep to every night.

How do you handle in-house transactions when you have one agent in your firm representing a buyer and one representing a seller?

This is why I don't do dual agency, and it's discouraged in my firm. The conflict of interest isn't worth double-siding.

Great commentary Anthony!! It seems to me that there is some verbiage in this settlement that absolves the defendants from any future lawsuits. That's why these other plaintiffs are desperate to stop this settlement from getting approved - no money left for them!! 🤣🤣 I cover it in more detail in my most recent YT video. I agree - we need MORE people talking about it.

I wish that individual agents who have violated their ethical duties or who have violated anti-trust laws, or steers, were fined or kicked out of the business, rather than the whole industry paying for their behavior. There never seems to be factual information about how many do the reprehensible behavior. Too many general accusations rather than facts. Anthony, we appreciate you and your passion for this topic, and for agents and the profession.
