NASCAR is striking back at the teams of 23XI Racing and Front Row Motorsports. The teams fought back a few weeks ago and NASCAR is refusing to give into them in just about every way, no matter how ugly they make it. For this both 23XI and Front Row will take the unprecedented steps to race without charters as top tier organizations and maybe just sell the entire 2025 NASCAR season when it comes to running for a championship. NASCAR is striking back.

Ahh see I hate Denny, as a driver. I like him as an owner. I also hate the people he hires. But owner wise, he's alright. And since all my guys are out of the playoffs at this point. Id like to see him get that championship just to get the chip off his shoulder.

Michael Jordan might be the most competitive person in history. Even if they lose I can see him burn 100s of millions of dollars just to prove a point. And I'm glad he's in the sport. He's the only owner that in a position where he has the money to stand on principle.

Im no lawyer, but my wife is a paralegal. To me this entire lawsuit hinges on whether the judge sees it unreasonable and monopolistic to force teams to sign the contract under auch a strict deadline AFTER normal business operation hours. This statement from NASCAR has nothing to due with refuting the claimed unreasonable contract deadline and instead gives the plaintiffs more ammunition by saying that NASCAR is already planning on taking potential earnings from 23XI and Front Row and allocating those funds to other teams. Again, it all depends on how the judge sees this, but Imo it looks like NASCAR saying "you didn't want to wave your legal rights to sue us if we screw up? Then no money for you." Which is a HUGE no-no.

Better statements for NASCAR would have been more vague. Instead they clarified roughly "yes we did that, so what?" It's very much an intimidation but that probably was a bad idea when some of the people you are fighting don't need you. Of course the courts will limit what NASCAR could ask. No matter what was in the old charter, the courts would not allow NASCAR to say you have 30 seconds to sign this contract we just emailed you. So the question is "how unreasonable was this?"

Unless the judge has been bought off or is an absolute idiot no rational individual would think 6 hours, beginning at 6 am, would be enough time to review and sign a 300 page contract. If anything it would fall "unless duress". I'm glad this happened because it's shown how dirty NASCAR management really is. I'll be done watching for at least a few years after this season is over.

The thing is, Nascar is technically a private business. They can theoretically do whatever they want, and make whatever rules they like. None of these teams are being forced to run in the series. They can pull out any time they wish. So if there's 1 or 2 teams annoying them, they don't have to really do anything. It'd be really cool if they did, but it's not required. I don't see this playing into FRM or 23XI's favor at all.

The Charter system needs to go. Besides, they need to make it so you have to EARN a charter. This can be simply being in the top 30 in points, and should you ever fall outside the top 30 you run the risk of losing your charter at ANY point in time during the season. For reference, Rick Ware's #15 currently sits 36th in points (last among the charters), while 23XI's Tyler Reddick is running for a championship. Makes no sense.

It's all about control. NASCAR wants to keep as much TV money as possible. The teams want to get more of it because they're the ones that are financially in the riskiest position. NASCAR created the charters to help mitigate the financial risk for the teams, but now are using that (revoking the charters) as hammer to keep them inline. It's easy for people without a cent invested to sit here and criticize 23XI and FRM.

Talking about the teams missing Daytona, Front Row will lock in on Wednesday so it's no issue for them. Toyota needs to fix their qualifying trim though.

The lack of common sense in the comments section is amazing. EVERY charter expires on Dec. 31st. 23XI and FRM willingly chose not to sign a renewal agreement, therefore their charters disappear. There is no way it could have ended any other way. The lawsuit is immaterial in that respect.

As an Indycar fan in addition to NASCAR, this is eerily similar to how Indycar bullied Prema (a new team from Italy who will be entering Indycar next season) into basically signing their charter agreement that will start next season. Prema wanted to enter Indycar as a chartered team so that they could get all of the benefits that come with that such as guaranteed spots & revenue sharing so that they would be competitive right away. However Indycar threatened to deny their entry onto the grid for 2025 if they continued to ask for these demands. Prema basically had to back down from their demands & agree to the terms laid out in the charter agreement in order to be on the grid. Even by signing this charter agreement, Prema isn't guaranteed spots on the grid & have to qualify for every single race while teams like Andretti, Penske, Arrow McLaren & Ganassi have guaranteed spots. Prema is also excluded from Indycar revenue sharing for the first 3 seasons they are in the series (if they make it that long) simply due to the fact that they are a new team. I find it absolutely mind boggling why Roger Penske would introduce the charter system to Indycar when he has clearly seen the effects of it in NASCAR. Indycar should be pushing for more teams to join the series & by implementing charters, it discourages new teams from joining.

This all feels very slimy on NASCAR's part. This filing explicitly states that, because 23XI and FRM didn't sign, there will be larger race payouts for both chartered and open teams. WTF? They bewilderingly stated that when a team signs a charter, it reduces the race payout for all teams. How does that abide by contract consideration laws?

Here is what I think could happen. Scenario 1: if the judge grants the injunction for 2311 and front row then they will continue on racing in 2025 as charter teams and the lawsuit will continue. Pretty basic. Scenario 2: if the judge does not Grant the injunction, and 2311 and front row lose their charters, then they will wind up signing the agreement by December 31st. The reason why I say this is because they damn well know they will go bankrupt if they do not receive the purse money from the charter agreement. NASCAR knows this as well. So what I think we'll end up happening is NASCAR will extend and all of Branch to both teams and allow them to sign the charter agreement if they agree to drop the lawsuit. The teams are also not going to skip the races, even the exhibition races, because they have sold sponsorship to these races. If they skip races they are breaching contract with the sponsors and will either get sued or the sponsors will drop them or both. This lawsuit could only have worked if all 15 teams stood together against nascar. But they didn't and NASCAR has 2311 and front row by the balls. You're either going to sign the agreement and drop the nonsense or we're going to put you out of business. NASCAR can survive without 2311 and front row, neither team can survive without nascar.

As much as I dislike the people running NASCAR, they never forced any of these guys to start a team or compete in their series. 23XL had over 2 years and multiple offers from NASCAR but continued to turn them down in hopes they would just fold and give in to their demands lol. They just spent close to 100 million building a "state of the art" shop and buying another charter they didn't need to begin with yet they keep bitching that they don't make a profit.. You don't continue to invest and expand in a sport or business if your not making money. Then to hire a lawyer and have him go around doing interviews to put them on blast and rile up their fans in another attempt to get what they want is making me hope it backfires and they get shit on from every direction!

difference I think it's history. F1 always had 20 or a bit more. There was even a good chunk of period of making the race on time, the 107% rule (lap time of the 1st place in Q1 is 100%, any car 7 or more percent slower than the pole would not qualify for the race). Actually, the rule exists today, but nobody has been left out of the grid based on the rule since 2012. The deals that keep F1 together state for a maximum of 26 cars, 13 teams with two each. Most I've seen in my life is 24. Nascar always had a field towards 40. Being in that number is not bad, but their constructions have been totally different.

23XI and Front Row are going to fold. NASCAR isn't telling them they can't race. They just said that if you want a higher piece of the pie, you have to agree to our rules. There's always someone who thinks they deserve more money. What's going to hurt 23XI is Denny basically admitting that they were going to always sue unless they got what they wanted. That's not negotiating in good faith. Actions Detrimental may be a great podcast, but Denny's inability to keep his mouth shut (and traits I share😊) is going to come back and bite him.

I feel like everyone is overlooking the fact that Nascar isn't taking any charters: they don't exist for 23XI and Front Row without the new deal. They expired. Yeah, its not the best look, but they can't just give the two teams something they didn't sign for.
