Sir, if device was in the charge of "A"at the time when print out of eviedenc was taken and the certificate is required to be produced after 2 yrs, when the device is in the charge of B ,in that case who is authorised to give certificate?

My question is, Can there be more than one 65B IEA certificate in a given case like if books of accounts is outsourced to third party then third party can given 65B and email and whatsapp communication with concerned party then sender/receiver party can themselves give 65B IEA certificate. Further if the electronic documents are under different person control and possession then all those different person need to give 65B IEA to prove the electronic document with regard to their possession and control of electronic document

Your question is contextual. However, the certificates can be given by the different person depending upon the dominion and control but if there maintained on the shared server/computer, incharge of such server can issue a consolidated certificate.

USA courts are accepting Google earth images in courts no certificate is required. What is the status in India. Google earth images we can take historical old images which are necessary to prove land encouragements. Latest jurdgements July 14th. Says the person who poses original can step into witness box with his laptop where he took images from. The latest jurdgements which overruled shaify case which made certificate again Mandatory and provided exceptions. One of the exception is, The Bench also ruled that the required certificate under Section 65B(4) would be "unnecessary if the original document itself is produced." "This can be done by the owner of a laptop computer, computer tablet or even a mobile phone, by stepping into the witness box and proving that the concerned device, on which the original information is first stored, is owned and/or operated by him."
