Knowing what a collection agency can say or do, when and where they can and can't call is priceless. The FTC does NOT allow them to call you at work. I have informed more than one agency that they're breaking the law calling me at work. They can only call during business hours at home. I've gotten calls as late as 10pm and again informed agencies that they're breaking the law. I'm 58 and have had more than one account over the years. I also never fail to file formal complaints with the FTC about companies that are breaking the law with the names of those who called, dates and times and what was said on the phone.

Santander sold my debt to another company that is now calling me demanding payment I got loan with my daughter 2017 car got repossessed 2019. And a month ago August 2020. a new company is calling me saying they bought loan from Santander it was 11,000. But they only want 9,000 and they are reporting debt to credit Bureau will this letter help with the new collection company

Glad I found this. I was thinking about my debt. This video stands out. Based on what you mentioned, I think I did something’s right. Back in my country, I owed a debt for a car, the car was repo for the balance( I gave back the car). Debt collector went to my old address looking for me. I got a hold of the letter, emailed them asking to clarify the debt, explaining the balances, surprised! They never responded! I felt this was some third party trying to get some commission money through a fake debt collector company. I had no knowledge prior but common sense told me to ask questions and request documents. Wow! They never come at me again. I am still waiting to hear from them lol with this new armor of knowledge. Thanks

I'm going through the same thing, gave back the car about 8 years ago & they're still trying to collect the balance. I got hit with a motion to claim exempt form from the sheriff I called them & the balance had doubled they say its from late fees interest & court fees.

Ive learned so much over the years when debt collection calls me you tell them that if they don't stop calling your phone for a debt that was over 7 years tell them you would sue them they are not allowed to harass you at no time and make sure you check your report frequently because after 7 years if its still on your report then u have to dispute it and they will take it off

I had some collections back in 2008 when I first found out about credit and reports. I worked my ass OFF to pay them collections and my score was around 720. I got I. Trouble with my score again I believe it was from vehicle though. When things are good they are great and when things are bad they are hell. I just now finished cleaning it up again. I financed a 550. Vehicle because I had to have wheels. Everything is looking great again except for my perception because having bad credit prevented me from renting an apartment even with a decent paying job,

The Credit Repair Shop I have, and they also refuse to believe it’s paid because the account was in their office. I just sent them a certified letter along with the proof of payment. I wish I would have seen this video back in February. I landed a healthy Art contract. When I got paid I went to my collections... LOL I was guilty as charged all that debt was mine I created a spreadsheet and call log. I called everybody and I negotiated the prices. I paid everything. Prior to this, my credit score was so low it would not register a score. Experian said that I could possibly be dead... LOL. At first I regretted paying the creditors because I did not expect this pandemic. But today I am happy to see my credit score and I am proud of the decision I made to be responsible for my collections.

I had an account go to collections. Instead of paying the collections company I paid the actual company. The company cashed my check. I then informed the collections company I paid the company, the collections company had to take off my collections.

Very informative video. However, could you better explain the "statute of limitations" meaning in greater detail? I think a lot of us get confused by this term. It is my understanding that the statute of limitations for when a collection company can sue you for a past due debt differs from the length of time a collection account remains on our credit file. So when you say that if the statue of limitations for my perspective state has passed, therefore a letter can be written telling the collections company to cease and further efforts to collect the debt, which statute of limitations law are you referring to?

People need to also know their state's laws about collections. I don't deal with collection agencies. I learned about what my state and the fed laws said, and I was able to stand up to them. I've gotten a few of those letters somehow conveniently missing the info about the creditor. I was homeless and was still harassed without mercy.

There are a few recommendations in the comments about credit repair companies. Remember you have to pay them for their services. Why create another bill when those funds could be used for collections & charge off. If its a large debt such as a repo, it could take a couple of years to pay. The longer it takes the more you will pay the repair company.

This is a great question. This is my answer...I've always told people credit repair is about changing themselves at the same time they are repairing their credit. The root is the person not the credit reports and scores. That is the end results of the decisions that person made in the past, present and future. Most people are not of the mindset to handle too much at the same time. They have family to care for, work, time to relax it can become too much. Credit Repair is a job and it takes time to get it done. We all have to prioritize and make decisions to get things we need and want. You and I both know that if they don't repair their credit they will pay more for the same things people with good credit pay less for. That takes away money they could have put away for savings. And if they don't change their habits they will end up with bad credit again. Thank you for your question.

I've always tried to pay my bills.ive tried to work something out with western Dental.iam on a fixed income.buying upper denture's .$3000.00 dollars.people with no insurance could get on medicare.late fees got me to a place where I can't pay this off. I wish it was just a matter of thinking positively... but I am at a loss for how to go about finding out if I am and should have been part of this Santander settlement. I believe I fit all of the criteria: I received an auto loan from them in March of 2015, I had my credit under 600, the interest on it was 15% (that should give you an idea of my credit-worthiness), I did not have full-time work - I was a freelancer just working on occasion. I got the car in order to drive for Uber. I did not get the financing through Uber. Anyway, I defaulted 7-9 months into the loan, the car was repossessed a few months later, and two years after that I received a notice in the mail that I was being sued for $10k deficiency debt. I did not even know this existed. After reading the court papers and believing that it said I could respond in writing, I went to get free legal advice on how to draft my written response, only to find out that the instructions were deliberately written to be misleading, and that since I missed the court date I now had a judgment against me. 😡 Anyway, then I heard about the Santander lawsuit, and read the criteria. I called the hotline that they originally had on the first website, but Rust Consulting had no record of me, and said to call Santander. So I called Santander, and THEY didn't even have record of my loan. How could that be? Someone told me it was probably because they sold it to a collector. But shouldn't they have record of the original loan? I am at a loss as to how to go about finding out how to receive a waiver for this deficiency judgment. I don't care about restitution payment, I just need this huge debt judgment off my back. If you have any suggestions or can direct me to someone in Chicago who can help, I'd be so grateful!!!

@Kiki K Darling -- You should be aware of a term called *_sewer service._* Process servers get paid a flat fee (at least in my state of FL) say $50.00 and they must be smart enough to not waste their time. If you've successfully dodged them, the unscrupulous will just mark the papers as *SERVED* and toss your copy away in the trash, or _sewer._ After I lost a process server in traffic, yes, he tried to follow me as I entered my car, days later he came to the door and left the papers outside in the rain. Not legal service but I knew better than avoid the hearing. Three years after my daughter-in-law moved to FL, a slimy process server left papers at her old NYC apartment. A default judgement was entered and the collection agency found her here. You can't just cry fowl and expect the court to reverse its judgment. She had to hire a NYC attorney and the case was dismissed _with prejudice,_ meaning, the collection company was prohibited from refiling a new case.

Thank You! I regret that I didn’t see this before I paid a hospital bill through a credit collection agency and I ask for a settlement offer. They said the hospital doesn’t do selltlement offers. This was bullcity collections and credit corporations. And the bill was 2,600.

Hello Sir, thank you for your videos! Is the dunning letter mentioned @ 6:26 always delivered via mail? I would like to believe that a signature be required to verify that the person the collectors are reaching out to actually received their notice. Similar to subpoena

The Dunning letter is a legal term for the 1st letter the debt collector sends. Because its not really a bill. They are giving you the opportunity to dispute the debt for any reason you fill is valid and they must respond to that request.
