I don’t get how this is a question. If you’re on the land, you’re trespassing. If you’re not on the land, you’re not trespassing. I don’t get how this requires a hearing of any kind. This is one of the oldest kinds of laws in existence that we inherit directly from English common law.

Because most people don't care to understand and it also goes back to Spanish territorial law as well. People nowadays in society don't want to take up the time by looking at laws and regulations.

If I owned land on a waterway, I would probably just open a trail on the bank, then you can put a cattle guard at the trailhead. Stay on the trail, don't screw up my land, and you can hike and fish to your heart's content. Those kinds of people are usually respectful to nature, anyway. What's the BFD?

Yea la Luz canyon in Alamogordo n.m free the creek Charles Mulden you have locked up that creek for 20yrs he owns the Alamo Apts in Alamogordo n.m and a dive shop too!

People will exit on banks on private land, if they can't then be ready for wrongful death lawsuits when someone tubing for instance loses their tube and has to swim to shore or drown.
