It has already starting to affect consular processing I filed my daughter I-130 back in 2016 everything approved and she had her interview a few days ago and they denied her because they say I don't make enough and might become a public charge even though I have a joint sponsor they don't count that person so crazy.

Rapid Visa, I have a question about household size. What if you live at home rent free with your parents? Or what if you share an apartment with a roommate? Would you have to list your household size as 2 or 3 then? Or does household size mean the same thing as "dependents" meaning people that you are responsible for and support financially like a wife and kids?

We coming out of our pocket paying for this whole process if we get denied we should get our money putting the embassy out of business... for this is unfair to the U.S.A citizen basically we are being punished for being human for needing some type of public assistance....

So to be clear the law will still be 125% for AOS but 250% is considered favorable? So with a income that exceeds or meets 125% will still be acceptable?

Hi, so I’m waiting for my Green card application outside the United states ever since March, 2019, assume I got into phase 2 at the end of this year and the new public rule kicks in, as a beneficiary, do I need to show I’m making 250% above poverty line outside of America? ( my petitioner husband makes way over 250% but I’m just not sure if they would consider my income as well, which is low.. household of 2)

Thanks so much for the information. How does this pertain to parents in the situation that I as a sponsore far exceed the 125 or 250% requirements but my parents are partially retired. Do they need to prove income levels or is my sponsorship generally considered good enough (obviously every case is different)

I personally wait tables for a living. 99% of my income comes from credit card and cash tips. I average around $25,000 per year. (Which easily exceeds the poverty guidelines for a one person household). I also have close to $100,000 in savings. I have my W-2's, 1099's, and tax returns. However, I'm worried that as a "tipped" employee my income will be scrutinized more then a hourly waged employee or a salaried employee.

I've heard that $5 in cash assets is considered $1 in income.

Thank you for the new info. My $100,000 in savings is spread out thru 3 different banks which I've gradually accumulated over time. And my Certificates of Deposit have gradually matured over time. I think the UCSIS is looking for a mystery deposit of tens of thousands of dollars within a few months to one year prior of myself filing for a K1 Visa. That would look suspicious.

For me and my husband the USCIS guidelines say 21,137 ,but why does a lot of utubers say have to earn 62 thousand for 2 people?

Just got married in the Philippines September 18. Waiting for the marriage contract within 3 weeks. I paid to expedite it. I'm back in the states now. Do I have to wait for my wife to change her legal name on her passport and ID after she receives the marriage certificate before I start my application process for a spousal visa?

No you do not have to wait the marriage cert is the legal paper showing you are married and is what is required to file.

@@franciscamart5932 Yes public charge will be applied to your case. But it would not necessarily affect your case if you meet the income requirements. As long as your income is significant enough to show your spouse and you would not likely seek public assistance in the future, then you should be good.

No it wont affect you, just make sure to file before October 15th, so you dont get judged based on the new rule
