As a former police officer this makes my blood boil. It's a CLEAR violation of that mans constitutionally protected rights. This is no different than "stop and frisk" without probable cause which was ruled unconstitutional in Terry v. Ohio. I hope this man's case gives the DEA the reaming they so desperately deserve. What are you talking about? Terry v. Ohio was the landmark Supreme Court case that said that stop and frisk was reasonable. It opened the door to 50+ years of detainment based on reasonable suspicion of criminal activity. Anyone with half a brain can see the slippery slope there, and ever since that travesty of justice, cops have been harassing people based on their whims which they claim are reasonable suspicion.

@@poolhub89 No, qualified immunity has nothing to do with crimes. It only applies to civil lawsuits. The reason cops almost always get away with their crimes is because the prosecutors and DAs implicitly (and sometimes explicitly) collude with them, declining to prosecute because they don't want to get on the bad side of cops they need to work with, and they certainly don't want to have the police union endorsing their competitor in the next election.

The DEA has no authority to search you when you're traveling inside the nation, the TSA has no authority to look for anything other then weapons or other possibly dangerous items. They assumed he was carrying cash or drugs because he bought a last minute flight out of that dump of a city known as NYC (Truly a rats paradise and that's coming from many different new yorkers); so they assumed they had the right to force him to let them do a search without probable cause or a warranty. It's facially unconstitutional and the airport should be held just as accountable as this DEA jerk. He's DEA he's not a 911 police officer, nor is he TSA/FAA; unless he bought a ticket to get on the airplane or has a warrant he never should have been allowed past the gate. The lack of probable cause should make this a kidnapping, theft, harassment, and possible assault; nothing about this was legal or reasonable. We need to reign in these tyrants.

That is not what the signs in the airport state, there are signs all over advising you can be searched for any reason by the government for just being there. Just got back from an out of country travel, they have bigger guns at the airport in Europe, but mainly leave you alone if you are not doing anything weird.

So sorry to hear this. I had a close friend, passed away now, who went into diabetic shock at a red light. Police threw him out of his vehicle for "resisting" and beat the ever living crap out of him, breaking his shoulder, 4 ribs, and his lower orbital. All because he wasnt able to comply. His wife was screaming at the officers the whole time his sugar was extremely low but they faled to listen. The paramedics arrived 10 minutes after and were in complete shock. 2 of the officers were fired 2 days later but never arrested for thier crimes. The tried lying on their reports sayng he was making terroristic threats. The state settled less than 6 months later for 1.5 million. In my opinion, it was no where near enough because his health declined quickly after that. 😔

One noteworthy item didn’t make it to this story. In the original video the officer says the passenger bought a last minute ticket and whenever that happens an alert is sent to the DEA, that is why he is being targeted - which in itself is an insane premise

Also, I think the solution is to set up a bunch of reverse stings with lawyers standing by and hidden cameras and wait for rights to be violated. Then sue and sue some more. Suggestion: Don't facilitate any conversation by answering ANY question the man asks. I would simply say, "I don't answer questions. I don't consent to being searched." Whenever he asks a question, I would repeat "I don't answer questions". I would keep my feet moving, and walk to my seat. Q. "Where is your bag?" Response: "I don't answer questions."

A couple more thoughts. Even though the dog "alerted" (which was clearly faked by the dog's handler) - this "alert" was not used by the cops to justify searching the bag. They knew the "alert" would not hold up in court. They did not search the bag until given consent by the flyer (5:02). So that means the the fake dog alert was nothing more than another pressure tactic. For me, the most important take-away from this is that one should never participate in any kind of discussion or argument with the cop(s). Answering their questions - no matter how innocuous those questions are - is participation. I would say "I do not consent to my bag being searched", and "I don't answer questions". Keep your feet moving. Let them say whatever they want. If they say "Stop walking", I would say "Am I being detained?". If they do not answer in the affirmative, I would say, "You are not answering in the affirmative, so I am not being told I am being detained". Then keep walking. If they say "You are being detained", I would say, "What is your probable cause for detaining me? I don't answer questions. I do not consent to a search. I want a lawyer. Again, I don't answer questions." Finally, you have to be willing to put the time in, which means missing your flight (which this flyer did). I would record everything. Additionally, I would fly with a body cam.
