But what is the rule of thumb of just having an Ebike capable of going ove 28 MPH in the United States, can that automatically generate a ticket just for being in posession of one or do you have to physically be caught going over 28 MPH ?

UK & EU limits are 250W motor / 15.5 MPH / no Throttles. Lobbying from petrol scooter manufactures Vespa / Gilera / Honda & the rest gave us the LOW limits to stop Electric taking there market share. If your caught with anything other than bikes within the limits they take them off you & charge you with motoring offences so depending on your age you could get points on your driving licence b4 you even old enough to get the licence. You can have a high power bike but its use is restricted to PRIVATE LAND with land owners permission only

Cops aren't impressed because of what you got. There are much more powerful and faster ebike out there though you won't be carring them down steps. "Modified Sur Ron, Talaria, Super73, Onyx, and of course whatever the name of that insane scooter that gets up to 100mph in 3 secs. If you want to go fast no problem just be aware of your surroundings and certainly don't do it in front of a police officer and always be courteous to pedestrians. Ebikes are fun though no matter the speed. They are amazing.

This guy is riding on the pavement at night. What if a child walks onto the pavement. This ebiker should be targeted by other respectful ebikers and educated, if you know what I mean or he will cause big problems to respectful ebikers.
