What a lot of companies don't get is the people that emulate or even pirate, they would never buy your product anyway. You have people that have a Switch, people that have a Switch and emulate and people that only emulate. That last category isn't going to suddenly buy a Switch if you take away their emulator. They just don't play Switch. Those people don't hurt Nintendo. It's neutral.

Yeah. Hell, I'm one of those people who is so far in the third category that I not only own a cartridge dumper, I'm very careful to only eBay games for my cart dumpers where, if someone considers the copy I took off the market interchangeable with an eShop copy, they already bought it. (i.e. Making absolutely certain I don't show up on Nintendo's balance sheet in a legal way.)

I hope Nintendo doesn’t succeed in ending emulation. If they do, I will never support them ever again. Doing that is just as bad as going after fan made games and locking online play behind a paywall.

I've used NEStopia for years. And I have emulators for SNES and many other systems like GBA and Genesis. Only way to play many games and the ones that are so ridiculously over priced now.

This is one of the reasons why I don't pirate currently supported software. It draws attention to the emulation scene when a brand new game is leaked and people are posting videos before the game is released. I'm not saying this to defend Nintendo. In fact, I think this is very bad for videogames overall. We all know that if one of these companies leads the charge against emulation, it's going to be Nintendo. They are also the company that is most likely to see success in changing the legality of emulators. I emulate/pirate all kinds of games from 7th Gen and back. When we emulate games, we're supposed to be using our own game backups. Because nobody had a legally obtained game to back up when TOTK came out, they could argue that 1 million copies of their game were being played illegally. That might be enough to change how emulation is viewed in the eyes of the court, which would be very bad. My personal stance on emulation is that if it's for games preservation, you should be playing games from legacy consoles and not currently supported hardware. I want these game companies to continue to make games, so I support them by buying the games I'm interested in. If I can't afford to buy a game, I guess I'll just wait to emulate it until it's no longer supported.

As a general software dev, this new pisses me off so much, I can’t help but feel nintendo thinks either A. They know they are full of shit, but they want to poke the bear. B. Even if they are genuine, if this matters only to ‘send a message’. We have gone beyond “Okay yeah, that makes sense protecting your IP.” to “1984.” I might out of spite learn how to develop emulators like I am doing for virtual machines and compilers, because NO WAY IN HELL am I letting the last bastion of preservation and media ownership be snuffed out by nintendo.

@@EdingardSIGMA I disagree. The PS3 along with the PS4 had some of the best JRPG games. The Xbox 360 also had really good JRPG like Blue Dragon and Eternal Sonata. Halo Reach was also really good. The PS5 and Xbox Series X are a different story and have no good exclusives.

In an unbiased debate, it shouldn't matter if Nintendo is a multi-billion dollar company who doesn't need defending, or if we're consumers who benefit from emulation. Is Nintendo justified? Whether or not they have a legal case, I always felt Yuzu was flying too close to the sun emulating a still-relevant console while also profiting off doing so.

Nintendo's last 3 systems have been emulated within their lifespans and it really feels like Nintendo is suing yuzu now so that the same wont happen for the switch 2

Thanks for covering this. I genuinely don't know what Nintendo is thinking with this. I mean, they hooked us in as kids with their legacy titles (Mario, Zelda, Pokémon) and when we get older and maybe want to revisit those older games, because nostalgia is a powerful sales tool, you would think that they would be eager to make a method to access these games tied to their console. I'm a big Pokémon guy, I've always loved the series. It seems like every Pokémon day, the comments are full of people saying "please bring the first 3 gens to Switch online" and of course, it never happens. Ultimately, I don't blame people for going the emulator route when Nintendo has shown time after time that they don't really give a shit.

If you don’t see the issue with emulating games 2 weeks before they even officially release idk what to tell you. This isn’t a game preservation issue it’s a piracy one. Ask any developer big or small if they like people pirating their games. No matter how pro emulation they might be they won’t be ecstatic about it.

I completely agree with you here. The sad reality about Nintendo is that their IP's are so immensely engraved into society, and characters like Mario, Zelda, Kirby, etc. are so iconic and define gaming in such a big way-- so much so that Nintendo could do all kinds of terrible shit to consumers and developers alike and get away with it without any real consequence. It's just like you said in the video-- as long as they're making money, they literally don't care about you at all. And as long as Nintendo has lawyers and is not technically breaking any laws, they're fully allowed to make an anti-preservationist/anti-gamer/immoral move like suing an emulation company and potentially destroying an alternate avenue to play many games that would otherwise be lost to time.. On the other side, you have Sega. Sure, they've messed up royally in the mid-90's with all the back-to-back hardware releases like the Sega CD, 32X and Saturn. Since then, Sega's left the console market and changed their strategy for the better, but even when they seemingly try to do things the right way, people take shits all over the Sega brand, simply because they're "Sega". At least for me, that's what it seems like when I browse the internet and gaming news sites (especially IGN :P). That's why I never really liked Nintendo. Aside from finding Mario annoying as a character (though the gameplay of Mario games is really fun), their consoles are always really subpar, and I always disliked Nintendo's sense of monopoly/corporate attitude. Just take a look at Nintendo Directs and listen to the narrator for each game-- he literally narrates every flat-out obvious detail that's being shown on-screen like it's the greatest thing since sliced bread, as if all of the viewers watching it are some kind of mindless lab rats. Such a turnoff for me. Anyway, I'm going off on a tangent here. But to sum it all up, I won't be buying any more of their consoles unless my future kids were to beg me for one.

I bought a Version 1 Switch with the hardware exploit upon release... I bought over 250 games before exploiting it a couple weeks ago. This makes me wish I hacked it ASAP. I will not delay next time. Nintendo has lost all my good will by going after emulation to the degree it has.

Someone pointed this out in another video that I forget at the moment, but why does Nintendo feel the need to do this... now? Seven years into the Switch's lifespan and THIS is the time where they want to attack a Switch emulator that's been around for awhile? Most folks who talk about the Switch, nowadays are either waiting for its true successor to come out or have just moved on to PC gaming handhelds.

I propose the following: 1. Following on the heels of the recently released N64 recompiler tool, create recompilers for other Nintendo consoles / ROMs. 2. Apply some reasonable optimizations and enhancements to recompiled Nintendo games. 3. Derive WYSIWYG game makers from recompiled Nintendo gamed so that everyone, everywhere can easily make their own stand-alone Nintendo games to be distributed far and wide.

Yuzu is actually doing nothing wrong in this case. They should be going after the pirates who are genuinely doing the illegal things and sharing roms, firmware and prod.keys. To legally Emulate a game, you must have 2 things. A legally owned console AND own the game that you are wanting to emulate. You have to dump the firmware from YOUR legally owned console and the rom file from YOUR game. THEN you can legally emulate Zelda or whatever game that you own. If you don't own the game, you cannot legally emulate it. But why go after the people actually stealing from you and instead go after the program that makes it possible. It's not like they can just MAKE ANOTHER ONE AND CONTINUE DOING WHAT THEY'RE DOING. Nintendo wants control and nothing else.

Emulation has already has a legal precedent and every time the emulators win. Tears of the Kingdom sold over 18 million copies despite the million people that downloaded the rom.

Despite all Nintendo's flaws they are the most innovative gaming company around. The 3DS, Wii, Wii U, and the Switch are all innovative products. Microsoft and Sony focus on raw power while Nintendo is looking for ways that set themselves apart from the competition.

Fanta, you forgot to mention that the games on their online service are emulated💀 It's illegal for you to emulate dumped games that you own, but it's legal for nintendo to charge you monthly for the right to do the same exact thing. Nintendo sucks for this, but they are really only going after Yuzu since it's their current generation console they are "trying to protect". Nintendo has had a more or less had a hands-off approach with emulators for older consoles that they don't make money on any more. I've never believed Nintendo had a strong argument against emulation, but it has to really be seen in court before we know what's up. This lawsuit has the potential to set many future precedents on emulation for good (or bad) in this case.

@@NostalgiaNet8 To be fair I'm guessing that the majority 97% of people are downloading the roms illegally and not dumping them like they are supposed to. I played a ton of roms from older consoles that I just downloaded online. I would have no idea how to dump my PS2 BIOS to my PC. When the Switch becomes obsolete and I can no longer buy those games legally or they are being sold at sky rocket prices, I will be downloading some of those games as well. Unless you are tech savvy most people are not going to be dumping the roms, Keys, and what ever else you need to emulate their console.

Nintendo is really a double-sided coin, they make awesome first party titles which is what kept their company a float. But for some reason they don't want to give any other titles to any kind of legibility and what I mean by that is projects. And AKA emulators aren't illegal If you go to any emulator website they specifically note use your own games that you own. I absolutely adore emulators I've been using them for I'd say 20 plus years, hell I remember playing my PS2 games in 4k When 4K was new and a big thing, back in those days developers weren't even thinking about 4K and how good it remasters the games. So yeah I don't get Nintendo
