I believe a new law should be made where any product no longer being officially sold becomes defacto public domain and the IP owners can't legally go after anyone. In the name of fairness, if the product is sold again, any acts of piracy after that point can be sued. This forces companies to actually do something with their properties and allows the public to properly preserve them.

The thing that pisses me off the most about videos like this is that everybody seems to forget to mention that the patents were filed AFTER Palworld came out. So they saw a game being competition to them, realized they couldn't sue them for copyright infringement and got so pissed they invented a bunch of extremely vague, industry destroying patents after the fact to retroactively sue them. This is literal deranged psychopathic mobster behavior and it feels like nobody is freaking out enough about that. Imagine living in a world where you can make something cool and a corporation says "Hey I like that, I will make up a patent now to sue you into oblivion and steal that idea for myself". If Nintendo wins this legal battle in any capacity it's fucking Joever for us.

Yep. the filing date is after palworld and craft topia. But they are parented by a patent back in 2021. Which is still younger than craftopia... The only hope is that the judge that sees it gets to see that this is just the patent lawyers trying to make a genre controling attempt at the games industry. Which may open them up to other companies that may have older patents or such, depending on which patent(s) stick. Cause the fact is they have not declared which patent was violated.

If we end up in a battle royale between all the biggest corporations in the world to see who owns what patents to determine who gets a lock on what BASIC GAME MECHANIC the entire industry is cooked. OK not the big money part of the industry of course, they'll make deals with each other, but indie and other non AAA studios will just be at such a colossal disadvantage it'd basically be the end of video games as an art form.

Nintendo just put themselves in that terrible position where they HAVE to keep making really good games unless they want people to start bringing up their horrible legal practices. They're toeing the line to becoming modern Disney or pre-crazy modern Kanye. A couple of missteps and they'll have people saying "Man, I miss *old* Nintendo" while others dig up their dirty laundry to air out for another PR hit. Can't wait, honestly.

Fun fact, Nintendo is actually BREAKING Japanese Patent laws by trying to Patent these mechanics because turns out POCKET PAIR CREATED THE OPWN WORLD MONSTER CAPTURE SYSTEM~!!! AND on top of that, The Mechanic itself is Public Domain as Pocket Pair didn't patent it after THEY created it. Petitions and cancellations happen frequently for much less significant matters, yet outright violation of fair use is perfectly acceptable just because they know how to weaponize nostalgia and decent game design? There's decades of examples to choose from, and some examples aren't even related to video game fair use, just having a character painted on a wall for charity or a child's birthday party gets that person sued into bankruptcy Disney-style. But targeting the leader leaves a much stronger message to everyone under them that, if even the head of the legal team can be punished for their actions, they're even more vulnerable in comparison for their idiotic legal actions when mobile games blatantly using their IP and assets to make a quick buck roam the app stores without fear of backlash. Not only that, but if the head of legal is canceled online, how do you think Nintendo themselves would react to the public outcry in their terrible legal action behavior throughout the decades and especially within the past decade, all culminating with the clear violation of fair use and overall creativity with the lawsuit on Palworld for using their ridiculous gameplay patents *that they only published months after Palworld released* and how that outcry could potentially hurt upcoming Pokemon sales, aka one of their beloved cash cow franchises?

banning emulations as whole would have unintended consequences OUTSIDE the gaming industry. emulation is not used exclusively to run video games. it is also used by the people who maintain old equipment in hospitals. banning emulation as a whole would cause the hospitals to buy new equipment which they may not always be able to afford. there may be more cases of non-gaming related emulation that I don't know of.

The reason Nintendo never attempted to shutdown any mods or hacks of MOTHER games is because of the fact they don’t fully own the IP. Mother as an IP is owned by their own company. And said company is fine with fan works. In short, Nintendo owns the games, But not the IP itself.

Could you imagine if Nintendo tried to sue GPD win or Asus for patent infringement because they quote on quote copyed the Nintendo switch even though GPD win had the idea and actually created a Windows gaming handheld console sometime before the Nintendo switch came out or even the fact that Asus in 2001 created the first ever Windows handheld prototype in 2001 Asus and GPD win would them very hard and as a result they would have went out of business and have to shut down or deactivate every Nintendo switch related product

Yet everyone magically forgot every bad thing other companies do and bootlicks them the second THEY do good things. Remember Bloodborne Kart? PVZ3 What Could of Been? *Fact check 1*: Only emulation itself is a legal gray zone, not extracting a ROM file. Copyright makes it explicitly illegal in both the US and Japan. *Fact check 2*: Copying a game so long as it is your own being legal is a myth somehow being parroted by a lot of people on reddit with no legal basis in law behind it. It is illegal, but is impossible to practically enforce. Others assumed its lack of enforcability as being legal with asterisks and more misinterpration led to the myth. In my opinion on extracting ROMs / backuping games from researching the available law documents, there is additionally no chance any exception to keep those widely available will ever be made considering companies including non-game companies everywhere on the internet would rather argue to have brand control with an iron fist. It sucks and continues to suck like always.

If you ask me, the PLA haters mean SV because of how horrible the engine was even after two waves of DLC and an epilogue. I gravitate toward the Pecharunt fight in particular because it's the last fight in the plot, after patches, and yet Terastallizing your Mon can lag the game hard. *Why.* By comparison, PLA was enough of a shakeup (Especially in comparison to Let's GO, which I skipped!) that it's the best gen-8 title and I need to get back to it one of these days.

To he fair with Yuzu, they absolutely 100% deserved it. They were fine until they suddenly spilled all their braincells on the floor, got ahold of Tears of the Kingdom before it's release, and tried to *sell* the ROMs to people. They flew way too close to the sun for that, Nintendo had every right to shut that down.

I always figured it's because of their previous expierence with the entire King Kong vs Donkey Kong lawsuit which resulted in Universal losing the rights to King Kong so Nintendo as a result has been since that lawsuit clawing onto their intellectual properties they've acquired and going after everything that dares not to have their seal of approval so they can retain control of their IPs. It also rakes in extra cash as suing a bunch of people also happens to be good for the bottom line. Other gaming companies meanwhile aren't usually this shaken and just find it easier to just let these fangames be or even work with the people behind them to make better products and reinforce their reputation. What good is suing some random guy in the basement whom in the future could bring more fans and be a useful asset. Not to say other companies don't go after fangames, but when they do, there's at least either a jusitification beyond copyright infringement or the company in question gets dogpiled by their supporters. In simple terms, Nintendo is overprotective of their IPs as to avoid losing their intellectual works to a lawsuit and it also pays them good money as a bonus, other companies don't really have this fear ingrained into them and with their supporting consumer base would rather ignore or work with their fans in a defacto mutual-agreement to support the performance of the company or something along those lines.

If you tried to dispute the claims you’d just immediately get the video back

Back then people did take advantage of piracy because they were either too lazy or too broke to buy nintendo games. But this was before the switch even came out. Now a days, nintendo doesnt even want you to get a hold of their older games and would rather have u pay a NOE or $60 just to play the older games they ported to their current console. which is just a scummy move. so yea, piracy is now a days 100% legal and no one can argue with that

The funny thing about the palworld lawsuit is that the patents literally exist for the sole reason of sueing. If I remember correctly, the patents were filed only *after* palworld released. Which means nintendo is trying to abuse a loophole in the legal system to destroy a legitimate game. Its literally the equivalent of "Stop being good or I will make your life a living hell".

My own point about Nintendo's Copyright problems personally, considering the fact that they've been around for, no joke, 135 years, is that they should be simply concerned of anything but the games the fans made for them. And yes, I do mean 135 Years. They witnessed both the World Wars, Survived 2 bomb blasts, and even the birth, coronation, and death of the Queen. And the true reason they're standing still to this day is because they were able to make such stuff that only focused entirely on not graphics, but fun. So my point is that they should be worried about Fun, not Fangames. And also, Don't bring in the Greed's excuse, cuz that's just a completely different thing i'm not bothered to address.

4:22 AM2R is not just improved visual and fixes. It is a comeplete overhaul of the game, with some of the map staying similar. AM2R adds a TON of new content outside of visuals. They added a lot of new bosses and abilities. Also, AM2R is a legitimately a REALLY good game. It really feels like an official metroid game. If you haven't played AM2R, find a download and play it.

Nintendo should not only allow fan games (and smash bros competitions) like their former competitor, Sega, but hold a competition each year to crown the best one annually. Winners would get a chance to work for them on side projects to bolster against main title droughts or get a cash prize along with their fan game getting a seal of quality to help out the devs in future projects. Nintendo could learn from these fan games to innovate their stagnating franchises while enriching their fanbase to cultiate the ever elusive and dwindling good will companies like them have issues with.

A few things to note: 1. AMR2 was shutdown before Samus Returns came out in 2017 for the 3DS 2. Mario Battle Royale was shutdown for Mario 35 which released in 2020 (and should honestly comeback) 3. Yuzu was shutdown due to emulation of Tears of the Kingdom before it was out as well as the Pateron (Citrus should not've shutdown though) 4. Similarly, Ryujinx was shut down due to emulating Echoes of Wisdom before it was out. 5. For Pokemon, you picked the spinoff (Legends Arceus) with some innovation for the franchise instead of the main ones standard ones (Sword/Shield & Scarlett/Violet) with the bad trees & glitches galore.

Honestly the only time I feel emulation isn't justified is when you emulate a console still on the market. Retro titles that aren't easy to find or buy for that matter are when I feel emulation should be encouraged cause let's be honest I seriously doubt anyone's gonna rerelease something like Klax on modern hardware. But consoles and games still on the market are where I feel emulation is understandably something I can agree shouldn't be allowed to an extent. It's a bizarre grey area this topic is in isn't it?
