This is basically like the world wildlife federation going after WWF when it ended getting really popular then they wanted to sue them for the name WWF. The issue is that 90% of the Nintendo buyers are Parents or casual people. Parents are buying it for their toddlers because Nintendo only contains kid games , and Rebecca buys it so she can play something on a 10 hour long flight. As funny as the video is, the reality is that they aren’t trying to claim there is a copying of character design (even if that’s the originating reason) they are litigating patent violation, which from their side is a strategy that makes it easier for them to “win”. Their goal is to reach a settlement, and effectively bury pal world to eliminate competition whilst simultaneously making some money to recoup through a settlement. Nintendos resources are MUCH higher than pocketpairs, making this tactic evil and doable, but beneficial to Nintendo, and so it’s used.

"No, sheep is an animal in real life." He's making it as a joke but like, that is actually a thing of how copyright works, at least in the U.S.. You can own your expression of an idea, but you don't own that idea wholesale. In this case, Nintendo owns Wooloo, but Nintendo doesn't own, "fluffy, round, sheep-like creature." So when someone else makes their own version of that idea, yeah there's going to be similarities to Wooloo, but those are similarities that can't really be upheld as copyright violation. There would have to be actual, undeniable _proof_ of direct, one-to-one copying for there to be any copyright violation there.

Not true. Copyright is civil law in the US, and the standard is "preponderance of the evidence", not "undeniable proof" (which is stricter even than the criminal "beyond a reasonable doubt" standard). The two sheep characters are similar, and that for each similar character coupled with basically the entire lineup being the same provides extremely strong evidence of intentional infringement (and even accidental infringement is still unlawful). Whether you think that _should_ be the law (I think it could be toned down for sure) or Nintendo _should_ chill out (yes) has no bearing on whether it's actually the case.

There are in existence two completely separate intellectual properties titled, "Dennis the Menace." (One is now usually referred to as, "Dennis and Gnasher," to differentiate them.) Because one was made by the creator having absolutely no knowledge of the existence of the first one, so it was ruled in court as non-infringing. Also some more examples of, "you can own your thing but not the idea wholesale.": Every single modern tactical first person shooter ala Call of Duty or Battlefield, and none of them infringing each others' copyrights. The entire existence of Marvel Comics and DC Comics repeatedly making characters that have the exact same set as powers as a character owned by the other, and it not being copyright infringement. It is also this principle of copyright that allows for parodies, homages, and spiritual successors to exist without being copyright infringement. Everybody and their mother who has ever heard of Spaceballs knows that it's a parody of Star Wars and rips several design elements from not only Star Wars but also Alien, yet it's not copyright infringement.

Im not disagreeing with your point, but I would like to point out that nintendo/pokemon ISNT suing for copyright, they are suing for patent infringement. Specifically how gameplay or code is designed, not over someone infringing on copyright for their intellectual property such as monster designs. Patent would be either A) actual game code was taken (highly unlikely) or B) they have a patent for (i will use the example people are thinking is the most likely for an example) throwing a ball/sphere shaped device at a creature in order to capture it, which the creature is then stored in the ball/sphere, which the player later throws again to release the creature in order for it the battle on behalf of the player. - the key words being ball/sphere, thrown, and stored in. This explains why they could go after palworld, but not something like nexomon, coromon, dragon quest, cassete beasts, or shin megami tensai. In either coromon or nexomon (i forgot which one lol) you use a pyramid shaped device, Or in cassette beats, you use a cassette tape. In dragon quest, you just simply tame the creature. In SMT you just convince them to join your team by talking ti them. but you dont capture any of those in a ball which is why they couldn’t consider it an infringement of the ball/sphere patent. From my understanding it has very specific language regarding the way its thrown and called back and things like that as well. There are also some other patents that may be possible. Another one is about promoting good sleeping habits to the monsters in your captivity, which both games do, albeit differently.

"patented" like throwing a ball and having it spin 3 times or whatever. anyways whats funny about that is there is a TON of stuff in the new zelda games that would fall right into this category more so than palworlds of them taking gameplay mechanics from ubisoft games like assassins creed and far cry most notably.

To be actually serious (not that this hasn't been plastered everywhere by now): Nintendo can't go after the designs, so they trademarked the concept of Pokeballs, or "devices that capture and store creatures" and is suing for patent infringement of that instead. If this goes through, they'll have grounds to sue Temtem, Cassette Beasts, etc. as well.

To remind people: This is Pokemon Company doing this, they are separate from Nintendo, but use Nintendo as a shield for criticism. Most of the scummiest things "Nintendo" does, is because Pokemon Company wanted it. Nintendo and TPC both share the rights to Pokemon, so that's why people think its all Nintendo, but TPC is exceptionally scummy and share the lawyers with Nintendo. Nintendo wouldn't do this on their own, they literally promote "ripoffs" of Zelda on their store for instance (I say ripoff in terms of its very distinctly referencing it in multiple ways, including its look/designs and even its marketing. But also to reference how people see Palworld as a ripoff, so its a clear comparison).

I don’t like the idea of forcing them, but I definitely would keep them satiated. Regardless, the theme is similar, but much different. Pokémon has trainers capturing, forcing submission, then battling creatures against their initial will against each other. That theme may be similar depending on how you play Palworld. Which means… Pokémon is based on Stockholm Syndrome Slavery, which I shall coin SSS, and Nintendo is mad that players can CHOOSE to engage that route, or choose a more peaceful resolution. Maybe instead of pushing a lawsuit, Nintendo can address their game and how similar it is to certain labor laws, which is eerily similar to the PRoC.

In the end, it is the intention. The game is not taking itself serious to a point of willingly being a childish meme. While everyone can use anything, in the end they did take a bigger portion of assets from Gamefreak / Nintendo and then walked away thinking it won't harm them, while making a huge bank reaching the top selling game on Steam, i do not think this is as innocent as people act around it. If it was an accident i would absolutely back the Palworld but this is just ridiculous. Anyone else would be burned in 5 mins, they are lucky it hit them after few months and being able to pay for damages to be honest.

The patent was set up 6 months ago. After the release of Palworld, and the mechanic that also appeared in Pocketpair's previous game, which predated Legends: Arceus, which is allegedly the game they made it for. Problem is, a game company shouldn't be patenting individual mechanics and agressively going after them when they want, because someone is inevitably going to create the same mechanic without thinking "oh, this is a mechanic that is in this game." It's like if you specifically put a patent on the first four notes of Megalovania and then trying to sue anyone who uses those four notes, regardless of the way the notes are used.

They also immediately broke the contract by reverse engineering the boards to produce the boards themselves essentially stealing Donkey Kong from an outside source. They were sued for this.

do you choose to ignore the existence of any other monster catchers for your bad joke or are you just ignorant? since cassette beasts, temtem and more already exist haven’t been sued have more quality compared to palworld but palworld had more shock value. hell palworld barely was any competition with it only being praised because of people’s hate boners towards pokemon and then being forgotten until it got sued.

It has always been done again and again by Nintendo so this isn't exactly their first rodeo on this. You asked why not sue creature-catching games like Temtem or Cassette Beasts that you mentioned . . . isn't it obvious? It's because they're *small* and there's no money Nintendo can squeeze out of them. In the last few years that Palworld has been in testing and announced Nintendo did *NOTHING* , why? Because obviously they didn't think Palworld would go big and PocketPair was only a small indie studio, there's no money for Nintendo to gain even if they sue and squeeze them out. But they were wrong, when Palworld got released it blew *BIG* time so now there is a benefit to suing them with dumb and ridiculous broad patents now that they have money that Nintendo can squeeze out. You might think, there's no way that was planned out, it could be a coincidence right? But if you check the news a few months back some patents relating to creature catching mechanics were filed by Nintendo just this year only *AFTER* Palworld was released and then suddenly after a few months a patent case was filed against PocketPair's Palworld. Coincidence? I think not. Pokemon has been out for decades and they decide to file a patent for those mechanics only after a competition blew up? Ignoring small games like Temtem or Cassette Beasts because they didn't blew up? This was all a planned lawsuit for money that can potentially kill competition ONLY after they saw the competition became a big hit. If any other creature-catching games blew up, Nintendo would've done the same and that's what's dangerous if Nintendo wins this case. You mentioned Palworld not being a competition. Are you living under a rock? PocketPair beat every selling record of Pokemon version in the last half decade and they broke it in 2 months. Heck, it took 2 years for Nintendo's latest Pokemon game to sell the same numbers as to what PocketPair sold in 2 months. You must be blind if you can't see that Nintendo sees them as a competition especially now that Sony Music and Aniplex are partnering with PocketPair for a music and potential card collectible for the Palworld IP.

@@SliceLeedice pocketpair didnt go big with palworld thats plain delusional, palworld was forgotten about until this case happened and brought it back in the public eye also I highly doubt your claims about palworlds sales numbers since scarlet and violet sold the most out of any prior pokemon games and it hadn’t been 2 years at the time and palworld simply has less broad market appeal, btw also there are more people with a pc than people with a switch and even then high amount of sales doesnt mean a large amount of revenue since palworld is a cheaper game they need to sell significantly more games to make the same amount of money. and you seem pretty ignorant on this little fact companies don’t such petty reasons they care about direct competition which palworld is not since it doesn’t have much staying power it got its 15 minutes of fame due to people’s hate boners towards pokemon and the game released a buggy mess (which of course was sweeped under the rug) and then after it died down was forgotten due to not having any kind of thing to keep player’s attention like pokemons competitive scene or raid events until it got sued and everyone remembered the game existed it had 2 months of fame but that was it, and honestly the pokemon company probably doesn’t care about the game itself its a company it has no feelings all decisions are made by a group of people its nots capable of being petty but there is one thing that a company like nintendo hates and fears more than anything and thats damage to its brand which is something that palworld definitely does because its a game with bootleg pokemon designs with realistic guns nintendo really really wouldn’t want their kid friendly franchise to be associated with firearms and animal abuse. you are delsional if you think that a company has such cartoon villain motivations a company only compares about its brand, also palworld isn’t as successful as you think it is.

It took what 2 years for Scarlet and Violet to reach 25 million? Now go search how long it takes for Palworld to reach those numbers, go ahead. . . What Nintendo's "best" selling Pokemon took 2 years vs got beat by Palworld in months? 🤣 Yeah, stop smoking that "not a competition" copium You think that Nintendo does not have motivation for these actions means you are definitely IGNORANT because Nintendo brand itself is paired with lawsuits. @@SliceLeedice palworld is cheaper as a game so even if it sold more it makes less money also its on more platforms which gives its an edge. also pokemon still has dlc sales and I looked it up and palworld costs 29,99 (which is still honestly quite expensive for an indie using characters that look bootleg) half of scarlet and violet so if palworld sells the same amount of copies it made half the revenue and i’m not even including pokemons dlc sales in this and this is ignoring the fact that pokemon is a franchise that makes the majority of its money from merchandise sales and not the actual games so if you compare Pokemons real revenue including the spin-offs and merch sales with palworld, palworld is but a grain of sand. and currently since the novelty factor of pokemon with guns has worn off palworld basically plateau honestly how much it sold doesn’t mean much if it doesn’t continue to sell also you read wrong i’m not saying that nintendo never ever does lawsuits i’m saying that the reason you think they do it is incredibly ignorant and something that only a child could think of the reason why nintendo sued palworld isn’t because they are some cartoon villain who only cares about money its because they are a company that cares about money, in my opinion nintendo probably doesn’t care about the money they get from the lawsuit what they probably truly care about is removing a stain on the pokemon brand that is palworld, because its not a good look to be associated with a game where pokemon lookalikes kill eachother with realistic guns, pokemon has a childfriendly image to keep up and palworld is not really helping that, so if there is any reason for nintendo to sue palworld its their brand not to steal a frankly miniscule amount of money. corporations are cold not petty their brand is what sells not the games. also like i’m pretty sure japan has a law that basically requires you to protect your trademark by suing otherwise the trademark will expire hence why nintendo occasionally deletes a bunch of fan games. but yeah great job for palworld for making half of what the smallest source of pokemons revenue made
