If you’re buying it without the games they can’t do anything to millions of people. They can sue the sellers but that’s it. The only buyers who would be in trouble are the ones with prebuilt pirated games. I have a couple modded switch consoles. I have a few r4 cards for my NDS and I have a modded 3DS. Pretty soon a modded GameCube.

There's no way they can really go after everyone who bought it. They'd have to somehow prove that we're using the device for malicious purposes - and repeat for thousands of people. Yeah... good luck with that.

One way to get me not to subscribe, is making crap like this. Yes, lets see Nintendo make flashcarts illegal, like they haven't tried before. And then retroactively go after everyone that owns flashcarts. Subpeona Amazon for anyone and everyone that ever bought a R4 cart or similar as well as anyone selling Everdrives... The lawsuit is over the fact the one reseller was selling modded consoles with games ON them. Nintendo is just throwing the MigSwitch cart into the lawsuit to try and get a ruling on flashcarts cause they'd love to be able to make them entirely illegal in the USA. Stop the drama. "I'm not into drama". Yea you are.

Gary, its totally okay that this channel isn't for you. I don't expect people to subscribe to someone telling them something they don't want to hear. You do not want to hear that right or wrong - Nintendo will forever be trying to eliminate from the marketplace devices that, regardless of what YOU want to believe is their primary use case, are ultimately used primarily to facilitate piracy. This is not a message you want to hear, and that is totally understandable. There are content creators that will tell you how awesome flash carts are and how totally impossible it is that anyone would ever find them afoul of copyright law (whether that is fair or not) and never make you feel uncomfortable. You should focus your KZbin watch time on those creators. All the best.

I wish Nintendo put this much effort into fixing their crappy EMMCs in the Wii U. Mine along with many other's are bricks and Nintendo wont do squat to fix it.

I think your hit the nail on the head. I've always wondered about the devices that sell 6000 games. And whether it was legal to own. I wish the US gov would shut these down before innocent people get fooled by their availability.

Nice talking point dude. I agree with your point about these setups(RetroPi, Everdrive, etc..) being piracy. I think it would be very hard for them to go after the average users for using them though. Could they key in on a big tuber or someone with clout who promotes them? 🤔 I don’t think that is out of the realm of possibility. If litigation was brought said person could probably fight it and win but Nintendo has the money that I doubt they would care about losing as long as they make an impact by possibly putting a spotlight on the issue. Piracy and counterfeiting will never go away. Lots of countries around the world don’t even enforce the laws regarding it. Too bad Nintendo doesn’t try to stop all the counterfeit games that are made and distributed all over the internet as hard as they fight against this.

Is it piracy to download games that no longer exist on the market in new condition from the manufacture? Should the only way games be played is on the original carts? So if I want to play Conker Bad Fur Day, I HAVE to go buy the original cart for 100$+? Nintendo isn't getting money from second hand sales, they don't care. They also don't sell that game any longer on any market in a new condition. So does downloading that make it wrong? Also then, what is the difference between games preservation and piracy to people like yourself?

@@katoutsugi1633 In "planet" Japan it is illegal. In the USA it's not. However selling a modded console with games on it that can only be played by modding the console will result in legal action. As is what this lawsuit is about.

Then this is about the roms that were illegally distributed. And not anything else. Nintendo just makes up a bunch of charges that don't exist so if they win, they codify a precedent in courts that favours them and their desires. Modding isn't illegal here in the us. Here nintendo is trying to compell their target to provide evidence against themselves by simply saying that they ought to, which is patently stupid because nobody can be forced to do that in a court of law in the us.
