I mean that if Nintendo wins against Yuzu, then this could set a trend for console manufacturers to go after emulation as a whole. Basically all unofficial emulation dead and gone. If Nintendo can get away with killing Yuzu, then they can definitely get away with killing off all other emulation software. Sony can get away with going after developers creating PCSX2 and RPCS3. The death of video game preservation, effectively. We'll be trapped in a system where games are left to rot the moment they're no longer profitable for the company who makes the consoles to play them. It's not just about what happens to Yuzu, it's all the other emulation software that is killed off afterwards.

Most emulators are open souce, if it does end up in this manner, that will just spawn more. It will just multiply. That's the good ending though.

My wife has no conception of owning a media library. She's fine with shoveling out tons of money for monthly for subscription services, and wonders why my interests and hobbies will outlast hers, and why I have more money at the end of the month than she does. I do not pay for Netflix. I only have Amazon Prime for the shipping.

Exactly. Even people who support digital are getting screwed once the games get pulled from their library. They paid money for access, then the access is revoked. Then they sit there dumbfounded like wtf? These companies want it both ways. Want the money but not provide anything in return. This is also why I think physical will stay.

I think the Switch 2 is gonna be a mild improvement over the Switch and Yuzu is going to emulate it quickly in the first few weeks. That is another reason they see Yuzu as a threat.

Agreed. Nintendo will continue making the same mistakes since the original Wii. If they really wanted to wipe the floor, they could release another powerhouse system at any time. They have the software-side to back that up. But we all know they won't even try.

Nintendo has a dark past which they joined forces with the yakuza mafia making picture cards to sell to them when gambling got banned after an uptake in crime surrounding casinos kicked off in Japan. As a former fan of Nintendo since the early 80's when I first got a few Game & Watch units, I can honestly say with every fiber of my being, they have become a rather shit company in resent times. Most of the things mention in this lawsuit have nothing to do with this emulator. If a game leaks early, why is Yuzu responsible for that? It's people on your own production lines, or a retail stores who got the game early, or the ass kissers you send early review copies to are the culprits(this is the most likely IMO). And I've seen social media post from Yuzu as well as Ryujinx when a game gets leaked early that they will not offer any updates for said games in their emulators until it is released officially. As they mention each time they do not support piracy of any type at anytime, so while Nintendo may havesome receipts, so does Yuzu. This is typical behavior from the bully masters of all gaming, flexing their muscle for no other reason than they can. I would love for a company like Yuzu to fight back, counter sue and have Nintendo pay all their legal fees in the end. Then that would bring an end to all this frivolous BS. But sadly this is Nintendo's MO, and they know most don't have the resources to win these fights, or hell, even stay the course for years, so they never learn the lesson they so rightfully deserve.

Due to using emulators on the SteamDeck, and experiencing titles I wouldn't want to risk buying and not liking, I've now bought an OLED switch and those aforementioned titles and more. All the media that I used to enjoy that went behind a paywall I simply don't consume, I just find an alternative, usually something better. Litigation like this and the goals behind them are ridiculously short sighted.

This isn't just an issue with Nintendo. The Streisand effect can also be applied to Disney, just look at all the movies and cartoons they are redoing, and making an issue out of racial diversity, such as with Snow White, and Little Mermaid. They are creating making white supremacy and issue. Look at Google with their Ai, Google Gemini, they are making an issue out of white supremacy. All of these things are considered censorship, thus the Streisand effect and also apply.

I played through Tears of the Kingdom and loved it. Bought a physical copy of it afterwards. I don't own a Nintendo Switch.

I think a lot of this comes too from an entire generation that has never actually owned any of their media, so they just incorrectly assume it'll always be there for them. They've not gone through the loss of physical, or the censorship campaigns that can happen with digital media (as opposed to optical discs that can technically be pulled from shelves, but your version always remains untouched). Books, movies, games, music, it's never not existed outside of a bubble for them, so they don't understand it can go away forever. Our media is "too old" for them to care about, but they don't realize theirs will soon suffer the same fate. That, or with mobile titles and their lifespans, they've been conditioned to not care. Which is kind of sad, but also really scary for what it means in regards to what information you're "allowed" by corporations and government both to have access too. Something else I feel more people need to point out as well is that games are the only medium that gets up in arms about what machine you put the data into. With a DVD, nobody cares what brand of player is used. I can legally put the disc in anything and play it wherever I want - dedicated DVD player, computer, Playstation, car, doesn't matter. Music used to legally let you rip the files yourself off of CD's and records using Apple's software, allowing for digital playback on MP3 players/phones. Only games have ever tried to control where you're allowed to run the software you've purchased. Games are the only medium attempting to make full ownership, preservation, and playback illegal somehow. So if you're a defender of Nintendo, why do you think that is okay?

@@teksyndicate Yeah, I’m sure they’ll be fine. Yuzu has had a lot of support behind them, now that they’ve gone viral again, I’m sure they’ll see an uptick in support. That being said, there’s no outcome favorable for Nintendo here. They can snuff Yuzu out financially, but their emulator will continue to be updated until the end of time because it’s open-source. If you wanted to prevent people from emulating your video games, you shouldn’t have waited 6 years to do something.

If the entire point of the Walkman was to enable playing pirated music and actually enabled competing artists ripping off your music through it and using it to generate sales for their label, then you could, there no reason for Yuzu to exist other than piracy, you can talk "preservation" all you want, but preservation only comes into play after a system is discontinued, not whilst it's still being actively marketed. The only real effect Yuzu is having is that it's driving people to buy Steam Decks instead of Switches by allowing Valve's copycat hardware to run Nintendo's software illegally, i can understand why Nintendo is pissed

@@liquidsnake6879 No offense, but that’s an ignorant take and pretty far from reality. Emulation in general exists for more than one reason, it’s not so black and white. The sole reason people emulate Switch games isn’t to play them for free. If you own a PC that is capable of running Switch games at higher than native res, you can probably afford to buy your games. It’s about performance and user-experience. Play a few minutes of any first-party Nintendo game on proper hardware and you’ll understand. There is nothing wrong with expecting your $60 you purchase to come with a certain standard of performance. A game like Xenoblade Chronicles feels like a different game. It was barely playable on the Switch when it launched. Link’s Awakening is another good one, you can use mods to rip out that ugly background blur Nintendo uses to make some games playable. The last thing I’ll say is that preservation is important and it’s important that developments are made early because it takes a decade of work to finish these projects.

I can tell by that statement alone the type of fanboy I’m talking to, but I’ll break that statement down for you: “By allowing” : Yuzu was already developed long before the Steam Deck was manufactured. There’s no intent there and in fact, running Yuzu on a Deck wasn’t really a thing until they became more affordable and available. “Valve’s Copycat Hardware”: This one really made me laugh. If you looked at the specs side-by-side and you knew what you were looking at, you wouldn’t be saying that. It’s like comparing a bicycle to a motorcycle. “Run Nintendo’s Software” Yuzu is an emulator. Nintendo doesn’t own the software, otherwise why would they be suing them? Yuzu does not contain any proprietary Nintendo code or data.” “Illegally”: … Emulation has never been illegal and there are court rulings to back that up.

Plot twist: Nintendo is suing them because they want that paywalled version so that they don’t have to work on Switch backwards compatibility themselves. Going by their past records of using ROMs and selling them as ports, I won’t be surprised if this is true.

For anyone curious about what the legal argument is, I think I can summarize it pretty well, including why I think the argument should lose: First, there's copyright, which I think we all know pretty well by now. The main thing to consider is: The games have copyrights associated with them, and the game consoles have copyrights associated with them - and these are different things. It's generally agreed that downloading games violates those associated copyrights. There have been rulings in the US that if you own a computer program, then you can make a copy for your own personal use - games are part of that. There have been no rulings on downloading a game that you already own just to save yourself the trouble of copying it yourself, and a ruling on that could really go either way. As for the copyright on the console, people often say that this is a grey area because there's no specific rulings on consoles, but there is well established law on the copyright of computer devices/machines. If you just manufacture and sell the exact same machine, then you will undoubtedly be in violation of those copyrights. If you make a new machine that accomplishes the exact same purpose (plays that specific format of games/programs), then in principle, it's completely fine, but there are some complicated laws about how you manage to accomplish that - you just have to be very careful. If you make a computer program that emulates the behavior of the machine and accomplishes the same purpose of the machine, then that too is fine - you still have to be a bit careful about how you go about doing it, but it's slightly easier, legally, to do that since they're very different mediums. So, emulation can not be made outright illegal (unless a corporation buys out judges and politicians to overturn legal precedent). That's all just backstory really, the new legal argument has to do with "circumvention of copyright protection technology". Basically, if you own a copyright, you can protect it by using some form of technology in the copies you distribute that hinders the ability of the buyer to copy it - this includes encrypting the data of the copy so that a cryptographic key is needed to access the contents. So, bypassing that technology is "circumvention of copyright protection technology". If you bypass that technology, make a copy of the contents, and distribute them, then you have both violated the copyright and circumvented its protection. If you only bypass that technology, then you have circumvented that technology even if you haven't violated that copyright. There are two key details about this: 1. Cracking an encryption is not itself a "circumvention of copyright protection technology". The encryption has to be protecting copyrighted material. For example, I can encrypt a random string of characters, and since that has no copyright associated with it, you can break that encryption without any legal issue - otherwise homework in a cryptography class would be illegal. 2. The copyright owner has to have sole control of that "copyright protection technology". I use this analogy: Suppose you put your stuff in a locker and lock it. If I crack your password, then that's akin to "circumvention"; and if I take your stuff, then that's akin to "copyright violation". Now suppose you put your stuff in a locker, lock it, and tell your password to your friend Amy, then Amy can tell me your password, and if I unlock it that is NOT "circumvention" - I still can't take your stuff that would still be akin to "copyright violation", but I can unlock the locker because you didn't have control over that "protection technology". Interestingly, the way the law is written, I don't even need Amy to tell me the password, I can crack it myself, because the law isn't written in a way that the protection technology has ownership that needs to be transferred - it's only about whether you have control over it. This is why the lawsuit shouldn't work - why it doesn't have a legal basis. We all agree that the game program is in a format that has an encryption that requires a key to run the data. 1. But what copyright is that key protecting? Spoiler, it's not protecting any of the copyright of the console itself - most of that copyright is in the machine architecture, and you can't encrypt physical objects - so the emulator is completely unaffected by this, legally. You could argue that it's protecting the copyright of the game program, and this may be true depending on the specifics of how it's handled, but that would only apply if the encryption is used to prevent violations of the copyright of the disk's contents - NOT if the encryption is used in order to RUN the disk's contents. At that point, the encryption is no longer protection technology - it is merely part of the format that the disk's contents are written in. When I open a JPEG on my computer, my computer has to understand that "this string of bits is the header, this string of bits is file attributes, this string of bits tells me that these pixels should be these colors based on this formula". None of that protects any copyright of the image I'm looking at - it's just the file format. 2. That alone closes this case, but it gets worse for them. We're talking about a common key. If every game uses that same key, then none of those games have control over that key. This is just by definition. You can pull up the legal code and there's a definition for what constitutes "copyright protection technology", and because of this simple fact, it's not "copyright protection technology". So circumvention isn't even possible in this case BY DEFINITION. If our legal system is in any way still functional, Nintendo should not win this lawsuit, because the law isn't on their side. The only way Nintendo can win is if they delay the case for so long that Yuzu can't afford to continue, or if judges decide to back the larger corporation out of sheer ideology. The law is clear - this lawsuit is baseless, but also technical enough that most people won't understand who's legally in the right and just let their ideology tell them who SHOULD win regardless of the law.

3:23 I'm all about supporting Yuzu and emulation, but just a fact, the only legal way to play games on emulators is dumping your own games. So even if you bought the game, downloading a ROM of the same game you bought is still illegal, not just because Nintendo says so, but rather because copyright law says so.

The saddest thing about this entire thing is the lawsuit proves Nintendo has a potential audience on PC. They claim one million copies of Tears of the Kingdom were emulated. That alone would warrant doing PC ports as that's potential sales they could've had with an official PC release on Steam or a Nintendo launcher. Instead they would rather force you to have a worse experience than what the pirates offer

Two things: 1. Unless you're an investor of Nintendo, why is ANYONE "defending" them when they have a well documented history of anti-consumer business decisions and snowflaking over other people (specifically KZbinrs) engaging in FAIR USE of their IP while whining about violations of copyright law? It's as if they think the rules should only benefit them! 🤔 2. It's amazing how many people have missed the fact that the Switch's hardware has gotten OLD/outdated, which makes the later and more complex games LESS enjoyably to play. The fact that you play an actual Switch game WITH SUPERIOR performance THROUGH AN EMULATOR should be a giant clue as to how much better the publicly available PC hardware has gotten and that many people have voted accordingly with their wallets! The Switch 2 (if that's what it's going to be called) STILL isn't available, so what did Nintendo and their "defenders" think the smarter consumers were going to do?

Nintendo is being very short sighted. They want to control their products with an iron grip in order to maximize profits, but if they just developed a fully endorsed emulator for PC for roughly the price of a Switch unit, and allow us to digitally download games in a store, they could actually earn a customer out of me. I think there would be more money for them if they just enabled things to happen rather than crush them. These things happen illegally for free because there is not other way to make it happen for some of us.

I still buy physical copies but once that is gone that is it . Once everything digital goes to streaming and monthly subs only you won't own anything you spend your money on. Plus if it's internet only then goodbye gaming offline. I don't think anyone should trust any company pc, console or otherwise as the push for anti consumer is more than maintaining titles but also redistribute old titles via profit . Not for preservation . Alot of the old cats notice these things for the last 30 years or so moving forward. I agree though the gaming companies could have done a way better job handling legacy titles and giving us access across libraries multiple generations.

the limit of downloading stuff comes down to costs, I stopped storing stuff on my PC since the cost of HDrives was higher than media subscription, at this point the media is getting again at the edge of me to have to rethink if it worth paying subscriptions or hustle with Tbytes of HDs.... once the unbalance is obvious, ppl will go back to piracy again.

Hopefully the Yuzu devs can beat this because if Nintendo wins I definitely think they'll start targeting other projects too. Imo it seems like the massive Patreon and keeping a version behind that is what made Yuzu a target for Nintendo.

You probably shouldn’t be flexing that you never opened the game, I mean there’s legal archival and then there’s piracy. And it’s really hard to back something up without ever opening it. Some would even say impossible.

Nintendo was one of the first real companies that I can think of who had s stance against emulation back in the late 90's. But the problem is that emulation is not illegal, and goes well beyond game consoles to just hardware development in general.

Thanks for the video. AAAARRRR we run up the flag for freedom. Have had no need to pirate GOG keeps putting the games I want to play on sale. GOG buy your games download to a storage device and play the games offline on what ever you like. Windows is no longer on my main gaming pc just on my tv pc, using my tv pc to mod Fallout NV and then copy the modded game to my linux pc and it just works, now I can play my fav game where ever I need to, can not sit at my gaming pc for to long body is to messed up so 50 inch tv and lazyboy makes for fun gaming.

Great Video! I haven't ever watched any of your content, and I think you do an excellent job getting your point across. The legality as you mentioned needs to be out to the test inside a courtroom again, but Nintendo will never let that happen. Thus, this will all stay safely in the gray zone where corporations like Nintendo want it to stay!! I am not a fan of control over choice. People need to realize that this is a very dangerous and outright manipulation of the market. This is what happens when governments care less about freedom of their consumers and more about the freedoms of their donors. I came back to say, "Drink up, me hearties, Yo Ho!".

With the current laws Nintendo can't kill emulation for their games, obviously emulation is about a lot more than just playing games but I will put that aside. As long as you own the game you are in your right to play it with an emulator, now or in the future (if the hardware would break). However, if Nintendo wants to make emulation more difficult, then here a tip: use another architecture than X86, with ARM only the Apple-users (

I think it'd be funny if all the emulation sites and internet archive took down anything Nintendo and people who weren't diehards just lost interest over the next few years. Their games are still worth playing but their consoles are super not worth buying, and I wouldn't be surprised if we're going to see consoles die off as a whole sooner or later, so I'd laugh really hard if they fuck their best chance to retain market share by being stubborn old suits, losing PC players and then having to scramble to win them back when the console market dies. You've got us now, so either port your games now or quit messing up your part in the inevitable future

Genuinely this is a little bit Yuzu's fault. It's a current gen console, even though the tech is stupidly old at this point. Old enough that Switch games are being played on essentially high powered phones, but you can still go into a big box store and buy switch consoles and games brand new. Okay whatever, Nintendo let it go for 6 years Then there's the Patreon paywall to get the newest builds of the emulator. Fine, devs need money for their time and it was just a timed update. The actual emulator was still free Well then TOTK came out and the devs were getting even more money on their Patreon because their newer build could play the game right at launch At this point if they didn't feel Nintendo's eyes on them I don't know what to say And THEN, supposedly, Yuzu was working on a build that would let players play switch games online with each other, entirely bypassing Nintendo's online service I hate that pay to use your own Internet nonsense too, but those subscriptions are definitely a chunk of their profits, and that plus TOTK was probably the last 2 straws for Nintendo. I've got 60 switch games, I get it, I want to back them up, too. I want to take my games on the go without having to worry about having $3000 worth of tiny game carts lost or stolen, but YUZU flew WAY too close to the sun on this one. Citra getting pulled pisses me off the most because the 3DS is a full on dead system. Doesn't shock me considering Nintendo bricked a bunch of modded 3DS consoles AFTER shutting down the eShop though.

I could see why Nintendo are against Switch emulation since Switch and its games are still available, and since many use Yuzu to get free games. Older systems have a much bigger library than what is available on the Switch, and those older consoles die even if you take good care of them.

Nintendo is just Ubisoft at this point. At this point I'm very reluctant to give any more hard-earned cash to Nintendo, even for the upcoming Super Mario movie sequel. The fact that people still buy Nintendo products just confuses me. Nintendo literally manages to scrape by making terrible consoles by making all their games exclusive to them. The reason they hate emulation is because they know the worst way to play a Nintendo game is on official hardware. So given that why would anyone buy it?

Nintendo aren't pro consumer in the slightest. All they care about is control and money. They don't want you to be able to play a game on Dolphin at 4k 60fps for free, they want to force you to pay $60 for their "remaster" which looks and runs infinitely worse. I don't care about piracy, but when they'd rather remove the competition rather than improve their own product to compete, that tells you all you need to know. Any reasonable person should hate them at this point. They treat their own IPs terribly and treat their customers worse.

I just finished TOTK, Xenoblade 3, and Bayonetta 3 all on Yuzu this year instead of on my launch Switch or my TOTK Switch OLED for the simple fact that the resolutions (not graphical fidelity) and frame rates of Switch exclusives are close to unplayable. Like other users have said, Nintendo really needs to step it up with their hardware anymore. I’ve had no desire to buy PS4 and PS5 games on PC because Sony’s exclusives run like butter on PS5 and look incredible. Switch is an entirely different story. This just feels like Nintendo being mad at the PC crowd because emulation offers a superior experience at this point than native hardware.

LMAO, WTF are you doing to Xenoblade 3 to make it run like that, though? It runs perfectly fine on standard hardware with zero framerate drops. Same for TOTK, for that matter. I've never seen a single framerate drop on that game, so at this point I have to assume you guys are either lying, or you're doing something extra that the game isn't designed for.

I think its also some people are too loud about it and it had nintendo notice it more. Its why you have to be creative when showing emulation etc especially with the switch since its still a current gen console making money for nintendo. Like Gabe Newell said, "Piracy is almost always a service problem and not a pricing problem." Give me the convenience of playing the games I want where I want, and I will pay over and over. Gatekeep your games on an uncomfortable handheld at 720p 30fps and that can ONLY play your games, and I'll do what I can to play them on a better device and keep them in a collection with the rest of my games.

Essentially, I blame mainstream media. If they didn't keep pushing emulators forward, it would have stayed a niche thing in the shadows. But due to that, it has also revealed that some of those emulator devs have started to get some interest in chasing that clout. It was fine as it was before, so stop playing with fire. The only reason I can't fully side with Yuzu is because people warned them for years it was a bad idea to have a Patreon, but they didn't care just like the Dolphin devs with the Wii keys. I don't think it's a hot take or even stupid argument to say that you should probably listen when people warn you that something is a really bad idea, and that's already the second example in roughly 7 months that proves it. I'm not condoning Nintendo's actions, but if you keep giving them the weapons to take you down despite being warned about it, I won't buy the "innocent" argument.

The emulator itself was not distributing anything that would be considered a copyrighted work owned by Nintendo. "The switch is a handheld and home console that made it the most successful console of all time" The Switch is the THIRD most successful console of all time, not the first. "just play the games on the current console, and we all know most people are pirating with emulators. This isn't a backup it's stealing" You do realize that games run better on emulators then on official hardware right? If you bought a game, dumped it and had the option to ether play it on an emulator at higher fps and resolution or on Switch which would you chose? Most people would go for the emulator for the better experience. Why is this so hard for you to understand.

Remember Day One when it struggled out of the gate to run its launch games? Yeah, Zelda: BotW... it couldn't even run at a constant stable 30FPS. That told me that their tablet 'console' was DOA from the get-go. And 7 years later... it is nothing more than a repeat of the original Wii. Lousy-ass hardware, but decent-ish enough games. But don't expect anything more to come out of the system in more fidelity. This ain't the PS2.
