Then, after 3 minutes of that, he clearly cut and later edited in a section saying it wasn't entirely over. But failed to mention any information that is relevant to the situation except the "nexon lost" part. If you go read his comments section, you can clearly see how many people wrote on that video that now believe it's all over and nexon lost, Ironmace is in the clear and has clearly been misled. This seems parr for the course with OnePeg. He's an overly passionate hothead who leaps before he looks it seems. I had an experience with him last year when Star Wars Jedi survivor released that made me stop wanting to watch his videos. I had been seeing some reviews of the game that suggested it wasn't very well optimized and it ran poorly even on high end PCs so I was waiting before I purchased it. I then saw that he was live streaming it on Twitch and I hopped in to watch and asked him in his chat how his experience was so far. He answered in a very negative way, something to the effect of, "You can SEE that I'm playing it right now and it's running fine for me. I don't give a f&ck what others are saying and your question is stupid". He later recanted and answered the question more constructively, but only after several others in his chat defended me with things like, "He was only asking a question dude." As you might imagine that left a bad taste in my mouth and I don't like him as a person because of it.

Not to defend that behaviour, because it is pretty poor. But just a bit of perspective as a content creator and someone who likely dismisses people and/or is short with them at times for "no real reason"(from the outside). It's entirely possible he was just having a bad day, or something recently triggered him in chat, or maybe an accumulation of negativity, toxicity or anything else that made him feel some kind of way, and you just so happened to be the wrong place at the wrong time. It sounds silly, maybe. But sometimes you're the 101st comment a creator has read, and maybe of the other 100 before you, many were negative towards them. Making your benign and simple question, if worded slightly off, or even just on a topic you've been going at for hours, that elicits a negative reaction in that moment. I know for me, I struggle with that a lot. I'm subject to a lot of negativity throughout my days, typically, and sometimes, one guy says something that is mostly fine and just catches a stray. Not saying this is true for him, don't know him, never spoke to him, never watched his video and my only interaction with him leaves me with an impression I'll never do so in the future for many reasons. But it's only fair to let you know that there's perhaps something to consider. It is not an excuse, but it is true.

From what I have seen, it's clear that Dark and Darker did some dodgy stuff between leaving Nexon and starting to work on the game on their own, and I will think that until I see evidence against that. Nexon losing the case would push that way, especially if it was well substantiated, but there's plenty of stuff that's immoral but not illegal (even slavery was legal at some point).

From what I've read Nexon was breaking up the studio and moving the people onto different projects, so they quit to make their own game. If something similar. It's fairly clear they're not using Nexon code or their assets - cause they're using unreal store stuff. The grounds they have is that they're making a similar game that they were making under Nexon. Which is true. Tho they're not using Nexon property. So it's tricky. At worst this is an indirect violation of NDA, as they know development details and decisions that went into making the N exon game. But then making a copycat game in the us ain't illegal. I imagine it'd be even more of free game if the game that was copied wasn't even released. I can't see which way the courts would judge, especially since they're not American culture ones.

I've been thinking of setting up my own legal analysis and critique channel for a while. May as well make use of the law degree I completed nearly 20 years ago. And what you said is absolutely correct. It does burn my buttons when someone spreads misinformation about a case because they've pinned their mast firmly to one side and so end up misreading and misinterpreting a legal issue to fit their personal bias in that case. A bit like Trump supporters in the US. Facts cease to matter. Just their feelings. An injunction is usually just a temporary measure preventing someone from doing something while a complaint is investigated. And, yes, I agree that it shouldn't be applied to the defendants in cases like this as it means that they will lose a source of income in a case that could, depending on the state of the law in their jurisdiction, go their way. Even if they were then to win, there's usually no way for them to get that money back. And beyond that, if it's an online game then they're going to lose players and that could lead to a legal action sinking a company even before lawyers' fees are considered because there's no guarantee they'll get all those paying customers back.

I've been following Karl Jobst's and Twin Galaxy's fight with Billy Mitchell for some time as well. What I find is that if a KZbinr has a gut feeling about how the law works or should work, then generally that is how it works, so long as they've given some rational thought to it and not given in to an emotional evaluation. You may not think that you know your stuff but you understand enough, and being able to "dumb it down" for people without legal knowledge is a valuable skill. Personally, I am often critical of the law, particularly defamation law (protects the wealthy who have the resources to fight back, while often condemning ordinary people to a lifetime of having to deal with people thinking the worst of them), so unlike a lot of law KZbinrs, I hope to bring some much-needed criticisms of laws and those who work within these legal systems. I'm not a lawyer, so I don't need to say "the learned judge" for fear of being disbarred. So I can call them whatever I want and tell them all to **** ***. 🤪

Whenever I'm sifting through videos on the newest hot gaming drama I always see some people write something like "why they haven't been sued yet is beyond me" or "time for a class-action lawsuit". And I always want to answer: "Well, what's stopping you, why don't you go ahead if you think it's such a simple, obvious case?". Also, new favorite term of many: "scam". If you go by the loose definitions and barebone grasping of some then 99% of games are scams now. Go and try to have a more nuanced opinion, go and publicily say that for example The Day Before potentially wasn't a full-blown scam but "just" lazy and incompetent dev work. I dare you. I commented on a video of his relating to this exact content and behavior, and he replied/ had a conversation with me in the comments until I said something he didn't like and then he just ghosted me. I really think if the roles were reversed in such a manner where Nexon was the smal studio and Ironmace was the large studio, more people would side with Nexon. I think it’s that simple. I've watched a few of Onepeg's videos. He seems like a decent guy. My guess would be he's got an opinion favorable to IM (no shame there) and got caught up in his audience's internet rage and tried to be a hero to his followers. I'll just say this here instead of going over to his comments: You can still rise above this. This is wild. Your reporting on this has been incredibly factual, just going over the official court documents and what they are saying and giving your opinion on where it's pointing. I really don't see how one can disagree with that. And even if this latest thing had said what he though (which of course it didn't) it wouldn't have a knock on your previous reporting, it would just be a court case developing in a different direction than expected - something that happens all the time. Some anecdote's from someone living in South Korea: 1. Korean media is and has been heavily biased towards Nexon from the beginning, even before evidence was submitted 2. Korean courts are heavily favorable to large companies/big money So I don't have a ton of hope for IM whether they stole it or not. That doesn't prove or disprove anything, just a note to take extra care when using Korean journalism sources for news on the matter.

Rather than Omi made a Netfllix clone where you have your own login but it seems very similar. The analogy I use to explain civil litigation to gamers is _Magic: The Gathering..._ it's a long, complex, turn-based strategy game where you play a combination of attacks & defensive moves at the same time. When a plaintiff files a lawsuit they don't just play one card... they will file injunctions, motions for sanctions, etc. and the defendants need to counter, mitigate or address each one in turn. But mitigating the effects of one hand (or in this case, an injunction to stop game sales) doesn't win the game overall... and it doesn't make the final outcome a foregone conclusion either. This guy essentially stormed into his local games store, threw an ace from a standard card deck in front of the nearest MtG player he recognised and exclaimed "A-ha! I win!" ... smh. Personally, my only interest in Dark & Darker has been the legal side and having read the legal docs, interviews, etc. I agree that Nexon have a reasonable case against Iron Mace... the Iron Mace devs certainly don't help their own case by being disingenuous with their own community & stirring them up like this.

Then Krafton decided to buy the rights to make Dark and Darker mobile and people got mad because they were accused of doing the same thing as Ironmace in the past. Every now and then Kira gets on my nerves, but at least the man does his homework before he puts his videos on the net. Dark and Darker is not safe and the developers are just as "crazy" or weird as those of Tarkov. I don't know where the journey will end, but we want people to enjoy the game. And leave everyone else alone who has a different opinion. In my opinion, the game was built on stolen data. Just like Tarkov is still heavily infested by hackers, and therefore not a real shooter. ^^
