Hi Ms. Wong my lawyer submitted a session and Pereira motion back in July 2018 almost a year exactly which the immigration judge terminated my case base on Pereira motion, so no court for me in agust or ever , so that was a great news for me when I received an email from my attorney letting me know about the good news then we started the next process of filling the form for the national Visa center !!! Visa was approved within 3 months to be exact in October and I had an interview at the usa embassy in Managua Nicaragua scheduled December 26th but then I received a mail from the BIA has an appeal from the government saying that immigration judge are making erroneous decisions regarding of cancellation of removal !! So at the present I have an order terminating my case from the immigration judge but now that order isn't final according to my attorney because of the government appealed it .. my attorney said that he is operating in new territory . he did ask the government to withdraw its appeal to let me go to have my interview in Managua , Nicaragua and get my Visa for permanent resident but according to my attorney the government denied that request. Then he also said " I have asked the BIA to send your case back to the immigration judge so that she can give you volunteer departure but they have not decided yet sending it back " and that's all he knows about it!!! when to see my attorney couple weeks ago because he doesn't answer my emails so I paid him for consultation and he doesn't know what to do he recommended to look for second opinion from different lawyers .. if you know something about this government appealed it will be really helpful !! My lawyer had us file a i485 twice but we kept getting turned down after each interview and our appeals were rejected. Our lawyers never mentioned e42-b. I'm wondering why? I'm a US citizen and she has never been convicted of any crimes. We now have a hearing with immigration court in two months. What do we need to do before then?
