I live on a private road,not county maintained or governed by an easement. I am the only person to maintain it in the last 20 yrs. I bought the equipment and pay for all cost of maintaining said road. When I purchased the property the Rd was in horrid condition. I live at the end and the Rd stops at my gate. I had become frustrated with the few neighbors that I have (only about 2- 3 residences besides ours) due to no one contributing to the maintenance. And I've never asked them for money, I understand that is tough for some, including myself. But after several years I did politely suggest that I could use a minimal amount of assistance. Things like keeping ditches clean from leaves and debris, possibly when I'm running the grader they could help toss any larger rocks so I don't have to get on and off constantly. Just basically be willing and available to fulfill their responsibility they took on when buying a piece of property on a private rd. Needless to say the work ethic isn't what it used to be. So after years of biting my lip and when gravel prices essentially doubled about 8 or 10 yrs ago I decided to limit the work I was investing. And about 4 yrs ago I virtually quit doing anything with the exception of emergency repairs. Basically hoping that they would see the value in the effort required. Not so much, one couple kinda got an attitude, like they thought that I actually had a responsibility to maintain it for them. I found that humorous and allowed that I would be willing to let it go to all out crap if that was the way they were going to approach the subject. They changed their attitude slightly when I said that we all have very capable off Rd vehicles and I would let it get ruts 4' deep for all I care since my wife at the time was driving an Excursion with 35"tires and my teenage son's would love being able to go mudding every day. Fast forward to a few months ago and we're all out of state for a couple weeks and I come home and another neighbor had a relative come visit and they decided to rent a backhoe to "repair" the road in a couple spots. It was painfully obvious that they had very little experience operating any equipment (example: they broke the outrigger off,I have a hard time even imagining that scenario) but the biggest problem was that they dug a large quantity of clay,like actual modeling clay out of the bank beside the road from property that wasn't their's and I am confident that they went further than the 25' beyond CL. The worst part is there were a lot better places to get an fill required that didn't have that clay. I later figured out they chose that because they were stealing the fill and building a new creek crossing on their property and they have plenty of fill on their property. I thoroughly chastised them and told them that I was going to let them enjoy the work they had performed for a few months since they screwed it up and didn't even plan on buying more gravel. I could only do that because my wife and most of my children were staying out of state with a sick relative. They didn't even try to get the packed gravel loosened up so as to be able to mix with the clay and clay like that is as slick as glass when wet. So the moral of this story is if you can and want to maintain your own road don't try to prove any points to the peanut gallery and stay on it because it may create more work than you can imagine. As to your stipulations and guidelines for your forestry service easement are scary especially if the other property owners can have a detrimental effect on your ability to use the right of way. The things like the noxious seed provision are truly frightening due to the possibility of something as simple as your neigbors buying cheap hay for their livestock. I had a kid that would occasionally work for me, but on his property his neighbors had been buying hay and many things came from their paddocks and eventually spread across his line and you could even tell on the sides of his dirt road where hauling giant loads of hay down the road had seeded the ditches. There was a wide variety of weeds and noxious non native grasses. Variety of thistles and others and a ton of Johnson Grass. So that provision alone could sink someone even with the best intentions especially if you happened upon a grumpy forestry enforcement agent. I could imagine that they could exaggerate those claims to fit their agenda similar to the way police officers like to say that they smell marijuana. My oldest son was on his way to college one day and was pulled over by a state trooper and he made such an assertion. I was thoroughly peeved due to that child being the most straight laced kid around other than being young there was no reason, it was an obvious fishing expedition. I would just be concerned (not overly, but worth caution) that a similar modus operandi could be used in a case like this if anyone ever got miffed about virtually anything. North excellent video, I needed your information because I just bought a property with an easement but the big difference is that the easement entrance in small part of my property and I wonder if I can use it as part of my driveway. I can have a other side drive but the easement is right in front of the property and it's in my benefits.

What happens if originally there are 5 land owners with large agerage land holdings, and one of them decided to section his property into 25 individual plots, develops them, and sales each lot to 25 new owners, each building 500 thousand to 1 million dollar homes? Now the 25 create a home owners association and agree as a majority, a wealthy majority, to improve the road by asphalting it, adding street lights, garbage pickup, powerlines, and fire hydrants. Can the majority vote to change the agreement you currently enjoy and overrule your wishes?

Now let's say the 25 decide they want a Post Office. A few years later they sale a large parcel and build a Walmart or a strip mall because they dont want to drive so far for shopping. Someone builds a gas station, a hardware store, etc, etc. Street lights go up, a school, stop lights to control the new traffic, etc, etc. I've seen it happen man, on land adjacent to National Forests. Money talks and finds ways to change agreements, to overrule previous tenants wishes by majority. Just saying,,,,,

Great video. I just allowed a neighbor of 20 years to use my 14' driveway instead of cutting the legal easement at a big cost. I had a lawyer draw it up and the neighbor has to pay to maintain the road per my decision to upgrade when and what I want. (50%) They also cannot split their 6 acres and build a livable dwelling as it will revert to the original unfinished easement which is a swamp. I totally agree with you regarding a recorded easement. They cannot for any reason touch anything on my land. The lawyer stuck all kinds of protection in the agreement for me at a cost of $1500 which covered the survey and lawyer fees and paid by the neighbor. Yes. I have 2 road easements on the property. 1 side has 6 homes on it. Are you kidding me?? It was all elderly & quiet. Now younger people moved in bring in friends family, using it for exercise and dumping crap. Other side has 3 and they are claiming that it is their private drive. I even had neighbor put a cable up stopping me from visiting my property. Its thick woods so the road is the way to access it and there is the easement written in deed

This was very eye-opening and educational. On the lower end of the land where I grew up was a plantation of fir trees and there had to be firebreaks a set distance wide and set distances between each one. No one was allowed to touch or change the layout, trees or the tracks. If you wanted to move equipment or machinery through the plantation they were not allowed to damage or remove the trees or damage the track surface. It was all clear cut. So when we got a hurricane roll through in 1987 it took my father and his colleagues fifteen years to clear the fallen and standing debris, and seven of those just to get to the entrance to the plantation. The damage was horrific. It was a nightmare of permits, meetings, money and courts to get it done. Never again. I sympathise completely with anyone embroiled in that kind of legal maze.

whoever ran that grader should learn how to operate it. there would be less mud holes if he had crowned it. I would put in markers/fence exactly 25' from the center. a good fence makes good neighbors.

in most places you have to have permit for that.. you have to mark every tree you plan on cutting in advance.. and then submit the appropriate request forms and then they will come out and look and see if they have any problems with what you marked and where its at.. they might not allow you to cut all those trees or they might have a stipulation that you have to replant what you cut... within a reasonable amount of time.. land use ownership seems to be no longer what it used to be.. your not in control of it.. they are... and they will tell you what you can do and cant do.. and then they will make sure that gov. people are out there enforcing that and thier interest.. they tell you where you can build a house and where you cant.. they tell you what kind of waste collection system your going to have and what kind of building system your going to use.. they tell you where your drive way is going to be and they tell where your property line begins and ends.. im in williams county n.d. and these fuckers dont let you turn a shovel of dirt without a permit or a lot of hassle.. they want you to call to make sure there are no cables or pipes running through where you want to put your garden or where you want to cut a hill down to level out your drivaway or make flat spot for your equipment and trailers... they tell you that you cant run a generator out here.. or live in your r.v..even though you cant afford better.. I would really like to know where I can get away from all these assholes... cause I would like to move somewhere I can plant a garden or build an out building or drive upon my land where I want.. and without their god damn ass nosing into it.. im way the fuck north of every god damn thing.. and their are still assholes way the fuck out here punishing me for being born...

My suburban town has a ROW (with road) on my property. It connects to town land (a bike path) behind my property. A US Fish and Wildlife National Wildlife Refuge abutts the bikepath on the other side, and also uses the ROW. The ROW is heavily used. I just received a letter from the US Department of the Interior saying they’re putting up a gate to remotely control traffic and charge money! The ROW description in my deed is very vague. This gate will prevent access by ME to my own land! My recourse is unclear. I was unable to find the video you said you made about the Forestry Service’s easement as it related to your property, but am very interested in your experience on that front. Thank you.

Chad, I'm sorry to hear the property around you is being opened up so much and potentially developed. We raised our six kids on a small farm and I truly believe farming is a wonderful environment in which to raise kids, and I hope you can keep things rural for a long time. When you first experienced trespassers claiming easement rights (video: Confronting Trespassers, posted April 4, 2018) you mentioned your title insurance company and your attorney both assured you that this kind of thing would not happen. Now a 50 foot wide road is being graded! Is this the same spot? You were pretty upset at that time over the trespassers, but with this wide road opening up I suspect it's just going to get worse and I'd be very disappointed, too. I have owned three farms and am very familiar with easements so I understand how the serenity you had expected can be destroyed. You mentioned you now have two easements. Is the Forest Service easement something new? Please keep us posted but keep a cool head; there are some legal things you can do to tie up any further development for years, and it may not cost much to do it. Thanks for posting this update. And, by the way, keep your cards close to your chest. I'm sure your neighbors are aware of this channel, so communicate with some of your more experienced subscribers by email or phone when considering your options, and keep your attorney's advice strictly confidential.

My land is landlocked and my grandmother land was sold a year ago. The people who bought it has been moving trash from the house, over the easement, and into the woods. Well when they moved that trash. They have moved trash into my easement with nail and broken glass. My girlfriend got a flat from it yesterday. They told me I had to pickup after them. Then they said that they were going to move it and I'll have to move my driveway when the easement was established in 2012. Is there anything I can do?

im dealing with a situation right now where the neighbor property and the seller told the new owner that their driveway across our property which was just a simple permission to use the drive way was a 100foot easement right in our front yard, and now its been surveyed as such and we've been trying to get the land office to block it from getting registered. not the best way to to start out

Good luck getting anyone to agree to upkeep. It needs some small trenches put in, to move the water out of the ruts and off to the sides of the drive.

I have a story for you on easement. I have 3 deeded private easements to access my property all like yours we pitch in to maintain them. One of my neighbors thought he would be smart and pull a fast one and develop his a little more the half of his land to put up to 2 possible 3 house lots in moving my easement which holds a thirty six year federal placement claim as well as a 25 year state placement claim and is a deeded easement. ten to twenty feet onto my other neighbors property were I have a deeded utility easement. He got caught my a would be buyer for one of his lots. The buyer went to out town planning board to apply for the necessary permits to build on the land he was purchasing and in the process found that the changed easement was as much as 50 feet off from were it was supposed to be a lot more than even I thought it was I saw the plot plan of were all three property lines meet after the second change to it. The planning department had the land surveyed including the property lines and were the changed easement was supposed to be. After the survey his subdivided land was pulled and the sale of the land was cancelled and now he is facing big fines in land court and a lengthy court battle. I am keeping my new easement were it is with the neighbors land it goes through with the restriction that I am responsible for the maintenance of it and my other neighbor has lost access completely to it so he can no longer develop his land.

That would be why it is wise to when first acquiring a property with a very open easement agreement to set some concrete corner and line posts along that easement, to keep it from migrating in the future.

I bought property that had a road along one edge of it that went to other peoples property. I lived there about 10 years when someone buying a house further up the road contacted me because there didn’t seem to be an easement and there wasn’t. I could’ve blocked off every single persons access to their house or access to that road. I wasn’t going to do that but I wasn’t real excited about doing an easement. They’re very hard to get out of. I ended up doing it because once the other neighbors figured out, there was no easement. Everybody started getting nervous. But it’s definitely something you should check into before you buy property if it’s not on a state maintained road.

Hi Y'all..good vid..couple of things I see from issues like this here in the Mtns...when somebody "carve's" on a road without clearly defined survey markers, you stand the risk of having the "center line" re-defined slowly taking a larger and larger chunk of your property over repeated gradings.. It wouldn't hurt to exercise the dreaded "F" word and run a fence down the edge, taking the "old" centerline as a "pin marker"...re-establishing the "S" curve..The other thing I think of (from past issues with road grading), is that sure makes getting trailers (mobile homes) and 18 Wheelers in and out of the area for someone else's convience..Possible future development???...Who knows, by the time your "youngin's" are grown, you might be living in a "Gated Community" LOL..just kidding..Bless Y'all and stay warm..it's finally started here with temps in the 20's and low 20's all this coming week..I didn't get my wood stove install completed in time for this year, so biggy elec. Bill's expected...

here in Ont Canada any easement is public accesses and i cant stop anyone from going though, in my case it is a big hydro transmission line and it is 66 feet from center of each hydro tower and there is a servay stake in the center if the tower and one on each side at 66 feet each way, weather it is a pipe line, hydro forestry easement it is shown on map in yellow blocks, and yellow blocks mean public access, now o fenced off right across the hydro easement for my live stock but i had to put a gate on each side so hydro can get though and because all easement are public i cant lock them, hunters snowmobile ATV can all go though, but they all have stacks in the center and stacks a the 66 foot edge on both side, i can put anything on it as long as it is portable or can be moved, but many use it for there scrap pile like the clown next door a mile away,in any case any one can use them. and they are maintained by the corporation that has it, if they came though and wideded past the line and made it that nice, it is looked at as land improvement, hydro comes though with there machine every 5 years and cut the brush an mated old grass and mlchs it all up and they have come on to my land and cut the brush like 100 past the mark and i love it as it keeps my brush down, i just asked them not to spray any part that pass though my land as we have the option to say no to that

THE FARKAS yeah man, it was just bad timing. I know that those rutted spots are going to be hell through out the winter and need to be fixed, which will be our problem, because we’re the ones that live out here. And they were good to go before the work was done and ready for freeze

Yeah I just had problems with neighbors! One is shooting up my property, he shares a easement with me. The same day I had the other neighbors claim I was on their land and that the road I cut they cut the road. I have video of me cutting the road, he still claimed it was his land, it isn't. I made sure of all the easements and that the land would perk...but also Make sure to get a survey before you do anything with the land.

Yeah not fun being the new guy on the block. Atm all the neighbors are feuding, most of them are against the one guy (the guy that said I was on his land) because he is putting up a public venue, some of the people up the road are feuding....I was just hoping to be switzerland in all of this mess, fight all you want, but just don't mess with me! When my parents first got their place the neighbor was hateful, over the years he turned out to be a really good neighbor so I'm holding out hope.

In my case there is no reason to get a survey, the original easment location was never defined, only that is is where tge existing road is, and is 50 ft wide, which means each time I grade I could move the road up to the limits of what you could prove from maybe old photos or something. I understand widening the road so limbs don't scratch up your vehicle, and that takes about 20 ft or so for 1 lane.

I have a recorded 20' easement across the south lot line of my neighbors property in order to access my own. He has now built a fence on his south lot line, completely blocking off my easement and access to my property. Looks like I'm going to have to take him to court :(

Sometimes you can't just easement on down the road. Ask the realtor before you buy and get it all in writing.

Only good thing I can see with it being widened out is. The sun will be able to dry the road better. This will help keep the mudd down. I just dont understand why someone would spend that much time and money doing this for no particular reason. My first thought was he was bringing in a modular home to have erected. But then you got to the forest service land and it was only half the width.

J it’s arguable that that could even happen. Courts won’t allow properties to be land locked and will create an easement if they have to.

Then I think there needs to be a conversation about what issues this causes. If he's new, he may not know about the rainy season and he just created a huge mud pit. The dry season your truck will look like pig pen.

I'll reserve most of my comments until the next video but as a former land surveyor and construction inspector I am curious as to whether you have your boundaries marked at each change of direction. (PI - point of intersection) It's obvious that the equipment operator gave no thought to drainage in low spots in the easement and did they kick up a big brush mess on your property. KNOW YOUR PROPERTIES BOUNDARIES and do not them be encroached upon not even by a walk path❗️ 🐻 🚜

@@NorthCountryOffgrid You do not want to someday wind up in an adverse possession case. what they use for x amount of time per law becomes theirs. Where I live a lot of sellers/developers create road districts which solves a lot of issues as to who pays for what and when.

Agreed with Ron. I suggest you to set up every other pole you were to install as if you were to install your front fence (paint them in white, have some reflectors or paint them with reflecting paint or have some reflectors on some sides) and place some signs stating (Fence under construction. Please do not trespass through them. This is a private property. And if the happy grater wanted to clear his land let him. But set some 4x4 and let him know somehow "thank your for clearing my fencing line but, don't do it again" (indirectly) with the other words.

I agree. The center line along the tangents and the curves should be surveyed. If not that road will change over time and it's true location will be lost.

With the road graded onto people's property, and more so on one side than the other, wouldn't one owner be gaining property and the other owner losing property? Eventually the center of the road would shift, wouldn't it? I'm new to this. Even if the road stayed at 50 ft, it could be 10 ft on someone else's property if the center line were not adhered to, couldn't it?

yea easements can be a thing. had to deal with that when i was in oklahoma but i prevailed. btw i changed my you tube name from taraz pariseau to Lady-T because its easier to pronounce and remember and i have started my own you tube channel. nothing much on it yet but im hopeful to start my own blog. but im a returning subscriber just with a new name lol

I am in agreement with others here. You need to fence off your 25 feet from the road centerline. T posts and wire are cheap insurance. Your neighbor has something planned. I would also take pictures after I put them up. I sometimes don't have much faith in my fellow man, which means I am going to look out for me and mine first.

Hmm.. That was a chunk of work to do without trying to get the other neighbors to chip in for at least fuel money. I suspect that grading is just the start of something. Be interesting to see what comes up that road next spring.

We have a ditch road. The county and city close by wants to make bike paths. Not here they wont. This is for the ditch company only. I don't mind anyone walking their dogs. But I do not want any public paths here. I would fence it off. The ditch company agrees with us. Thank God. Love your videos.

It is access for the irrigation ditch and drainage. We live in a old farming community that is growing so fast I cant hardly stand it here. If we didn't have a little over 1 acre I would be moving. The ditch is there to provide water to irrigators and drainage back to the Colorado river. We have grandfathered access to this ditch for our irrigation needs. We grow a 150'by 14 garden every year. It gets complicated at times. Like you have up there.

I used to have some land that had easement thur Forestry service. One day when i was on my way up to the land. Couldnt get to it. Forestry Service had put up a 10 foot tall fence with Razor wire right across the road access I used and was allowed to use. When i called them up about it. They said they will send me a email. Got the email. The Reason they closed the access was due to tires being on their land. They had pictures of the tires. Looked at the pictures. It was just 1 tire. 1 tire and they closed the access of the road. lucky I was able to get access to land from other side thur a Neighbor, who made a path thur on the edge of his land. So i can drive to my land.

Apparently the guy who used the motor grader has no idea how to run it. He should have put a slight crown to the road with at least a shallow ditch on both sides because when it rains that road will be under water.

I hate to say it, but its time to fence off the front of your property w/t-posts and 3-4 strands of barbed wire. There's really no reason for an easement to be that wide unless your neighbors got some improvements in mind. Is he bringing in a new doublewide for the grandkids to live in, or is the county putting in a new subdivision and need a 2 -lane road?

You won't really know until you ask him straight out what his plans were/are. I imagine you have a rock pile somewhere on the property from the work you've done. If not T-posts, how about some nice big rocks along the edge where you want people to drive into the driveway. mark the property line and decorative, too.

Most people are clueless until the electric company cuts all the trees in the back yard. Happened to me just before (thankfully) I bought the place! Also land surveyors can come in and hack up your landscaping and chip up your driveway if they think they need to.

work that was not wanted,needed,agreed upon or advisable to do at this time of year. what he got is trouble for the winter and expense in the spring to correct. it looks like some of those sections may deteriorate badly if traveled regularly in the winter,especially if you have to run heavy loads in and out a few times. Sounds like it's time to draft a new agreement. I would be pretty pissed,especially if I was your neighbor. Great channel NCOG!

My stepdad has the same issue. The neighbor has the rights to a easement road but it's only supposed to be 15 feet from the center. Making a total of 30 feet max. Some areas of my step dad's property he must have made 50 feet to 60 feet wide. But I thought a easement Road is only that if the other property is land locked. The guy that has access to our road already has a different main access.

Did you ever go 2 courthouse and see plat map. As their is multiple land owners, implies a subdivision of some sort. A bigger chunk of land was carved up and common easement (road path) or right of way was established. The county will have this map and should point you 2 original subdivision plans and agreements. First new subdivision should have deed restrictions CCR's. Unless older or personal subdivision 2 family. Roads are put anywhere in that 50 foot, with map or lot pins, should be able 2 see it favor one side or the other. Especially around curves. All lot owners should have right of way, but who is responsible for road is huge. Might even fall under HOA formation , but some sort of road agreement should be there. Do your deeds say anything about roadways or maintain economic fees?
