Sir, in section 237 if hum subsection 4 mei ye bol rahe h aggrieved party ko within 30 days m apply krni appeal from the date of publication in official gazette And then hum sub section 5 mei ye bol rahe ki CG order toh tab tak pass kr hi ni skti jabtak subsection 4 k appeal ka time khtm ni hota toh ye toh contradictory ho gya na jab tak order hi pass ni hoga tab tak appeal kaise krenge

order notified in official gazette wala provisional hai( Its publication in official gazette of assessment of compensation)... the wording Official gazette me compensation publication hone ke 30 din tak time hai aggrieved party ko appeal karnekeliye agar uska interest or rights affect ho raha hai toh. Uske bad final order pass nahi kar sakte jab tak appeal wala 30 din khatam na ho. so It means CG can pass order of amalgamation only after expiry of 30 days from the date of notification of assessment of compensation in official gazette so as to give a chance to aggrieved party to secure their interest and rights. Kindly note that Publication in official gazette u/s 237 is different from Order U/s 237 Steps Involved U/s 237:- 1st, CG shall give Publication in Official gazette Then provide 30 days time period to aggrieved party to appeal against the compensation assessment Finally, after expiry of 30 days(and fulfilling other 3 condition) CG can pass order. (NOTE: PLease check the * and ** at the end of the page of ur note and u will be able to understand the entire thing easily)

Sir agar sec 230 mei company's share capital ka reorganization ho raha hai toh creditors ka bhi approval lena padega ? Aur aise hi opposite case mei agar sirf creditors k sath compromise kr rahe toh share holders ka bhi approval lena padega ? Pls tell .

@@muskanaggarwal6577 In Sec 230 the approval is taken either from Shareholder or Creditors, depending upon the compromise agreement, However the notice is send to all members/creditors/Deb. holders In sec 233, In Fast Track Process, both Shareholders and member approval is needed, which applies to Compromise/Arrangements/Demergers..
