“Now Going To Be Held To Account!” Dangerous Cyclists To Face Same Sentences As Motorists

New Government rules will clamp down on cyclists by giving similar sentences to motorists for committing dangerous offences.
The law will see cyclists who kill or seriously injure a person because of dangerous cycling, face the same penalties as drivers and motorcyclists committing the same offence.
As it stands, a cyclist who kills someone can only be sentenced to a maximum jail term of two years, while a motorist can be given a life sentence.
Talk’s Mike Graham is joined by lawyer and road safety campaigner Nick Freeman to discuss the new legislation.
Nick says: “We are going to see a change in the behaviour of cyclists… because they are now going to be held to account with very serious consequences.”

In the first few minutes of the video when the pedestrian wandered into the cycle lane the approaching cyclist,who collided with him, had plenty of time to brake but like a lot of cyclists he just powered along not looking out for obstacles and lots of cyclists are like that. As long as they ignore all the other people,cars etc around them so they can go on their way. Some cyclists just don't seem to be aware of everything around them and that's when accidents happen. Many videos on KZbin show cyclists being in accidents because they don't read the road.They don't see vehicles indicating,they ignore traffic signals and sometimes even ride on the wrong side of the road and the wrong way down one way streets. They are in their own world and on their journey and nothing else matters as long as they can get to their destination as fast as possible. If it was law to take a riding test similar to the driving test about 75% of riders would fail .

In the video you mention the cyclist was just going too fast near such dense pedestrians, which is his fault, but it is also the fault of the infrastructure. A fast cycle lane should not punch straight through a busy pavement. Cyclist totally wrong there though. It's a zebra crossing.

I cycle and I drive. When I'm doing either, I certainly don't ignore other road users or pedestrians. When I'm cycling I'm very much aware that in any collision with a pedestrian or a vehicle I'm going to be injured or killed. I had a cycling acquaintance who was killed in a collison with a pedestrian. So when I'm cycling I try to anticipate any potential situation that could lead to a collision. There are of course cycling accidents when a cyclist fails to anticipate a potentially dangerous situation, but that is also true for drivers. You mention ignoring indicators. An indicator only shows an intention for a driver to move or turn in that direction. They still have to give way to any traffic inclusing cyclists whose path they would cross. That includes cyclists filtering on the inside of cars in a traffic queue as specifed in the highway code.

Cyclists are the scourge of every city in Britain. They never obey any of the road laws- and know that they don't need to, as they're unidentifiable. All bikes should have number plates, pay road tax and be forced to take out insurance, like other road users. If they don't like it, they can walk.

I am a carer ,the person i care for is wheelchair bound. Last August we were crossing at a pedestrian crossing, i pressed the button the lights went red.we were half way across when a cyclist over took the STOPPED TRAFFIC as the lights were RED and crashed into my client, as he went over his handlebar he hit him whith his helmet and feet leaving him with a gashed head wound a broken cheek bone black eye and abrasions to his body. He hit us at such speed he tipped the wheelchair over, GUESS WHAT HE SAID " YOU SHOULD HAVE SEEN ME AND STOPPED LOOK AT THE STATE OF MY BIKE". He then disappeared car drivers got out helped us and his wheelchair upright and took us to hospital. If that had been a car driver he would have been charged. WE HAD NO WAY OF TRACING HIM, Surely this must CHANGE.

Agree, if there's a cycle lane use it. I travel into a big city most days for work and part of our dual carriageway is full of cyclists even though running parallel is a cycle path - you can see it from the road! It's bonkers! One cyclist even leant on a car at a roundabout when the traffic came to a halt! Talk about taking liberties?!

Cyclists do use cyclelanes, if they are safer than the road and not significantly slower. Sadly most cyclelanes in the UK are more dangerous than the road and are almost always slower, which is why cyclists don't use them. The government has recently consulted with cyclists to find out why they don't use them and has published a set of minimum standards for cyclelanes. That includes being segregated from both pedestrians and motor vehicles, equal prioirty to the road through road junctions and no obstacles such as stret furniture and chicanes. Hopefully therefore new infrastructure will be safer and quicker to use and in time, the exisitn cycle infrastructure will be brought up to the new standards. One problem that maybe more difficult to solve is that cyclepaths quickly become covered in debris including broken glass which easily causes punctures. One advantage of cycling on a road is that the road traffic sweeps debris away.

The arguement that cyclists take up too much road space is incorrect. A road is used to convey people and cars are the most inefficient way to do this. You can get 7 times as many people down a traffic lane per hour as you can in cars, which is why would space is being transferred from cars to cyclists, as it increases the carrying capacity of the road.

In my town cars park in the cycle lanes on a daily basis, and cyclists generally go right down the centre of the roads, weaving in and out of traffic and ignoring traffic lights. 🤷🏻‍♀️

Outside cities the roads are so full of potholes that they are dangerous for anyone who uses them, cyclists ride close to the side of the road which seem to be worse. Agree that they do believe themselves above the law particularly following changes to the Highway Code.

I passed my car driving test ,after 25 lessons ,the first time after riding a bike for 20yrs. Being aware of traffic and the highway code helped. Most cyclists are just people on bikes without any road knowledge or sense. For eample, the guy who was jailed for 2 years for riding a track bike without a front brake and a fixed rear wheel didn't know,allegedly, that if you ride a bike on the road you must have at least a front brake. He shouldn't have been on a public road with a fixed gear track bike without a front brake at all and now a person is dead.

There are lots of rules that drivers seem to be ignorant of too. e.g. Not using the handbrake when stopped in traffic queues. I agree that ignorance of the law is not an excuse, but I don't find it that surprising that a cyclist didn't know that he had to have brakes on both wheels and not just one. Many cyclists only use the rear brake, as using the front brake too aggressively can easily pitch the rider over the handlebars. You've also omitted the fact that the pedestrian killed in this incident was using a mobile and stepped out in front of the cyclist without looking.

I think Nicks opinion on using the cycle lane is mandatory clearly shows he is not a cyclist, which is fair enough BUT what he fails to mention is in most towns (note towns not cities) the council provides a cycle lane/path (sustainable transport box ticked) and then completely fails to maintain them, they end up filled with all sorts of debris, glass, potholes etc actually making the roads safer.

This is an absolute non-story. The law was outdated as has been recently discovered due to deaths caused by cycling. There wasn't really an applicable law for which carried the gravitas to match the incident. Ultimately as a road user you are responsible for the more 'at-risk' road users which in the case of cyclists is pedestrians, and horse riders. The law is simply being updated.
