That's exactly what I was thinking. As long as they capture the physical features, it shouldn't be a problem. I don't understand their take. She can decide to shave her head the very next day. Criminals will alter their hair AND their faces, yet we still catch them. Hijabis will always be in public with a hijab on. As a matter of fact, you won't recognize most hijabis without thier hijab. Also, hijabis only take it off around women and thier fathers, brother and husbands. So it seriously doesn't make sense to ask them to take it off. Not to mention we all should be respectful to each other's religious beliefs.

@forthewin3910 that's absolutely possible. That's what usually happens at security checks in airports. They assign a female staff member to check the hijab in a closed room away from the public. I'll be honest, I never understood why they needed to check my hijab and untie my hair at airports, but as long as it's done by a female and not in sight of everyone then it's fine.

I would suspect that the reason they feel the need to check your hijab and your hair is to make sure you aren't hiding anything in them that could be used to harm someone. Not that you would, yet since people have hid bombs or weapons in other items of clothing, it is probably an abundance of caution type thing.

@bethnichols2875 the funny thing about this, is we usually struggle to tie our hair in a presentable way under the hijab. We usually don't want it to look puffy, so most of the times you will be able to recognize if something was hidden underneath without the need to remove the hijab. However I understand the security factor, and as long as they respect my religious beliefs, myself and other hijabis will be more than willing to do our part and submit to the rules. Also, thank you for your genuine comment and interest. We need more people like you 🙏🏼

A hijab is not covering your face, that is what a Niqaab is. Understandable if they were wearing a Niqaab,but they were only wearing hijabs. You said it yourself, convicts can simply change their hair style, the system don't have the right to make them stay with their hair styles during the mugshot either, they also logically don't have the right to tell convicts to removed their headress for mugshot as long as facial features are clear to be seen. The system shouldn't be that dumb to not be able to recognized people by face alone and need for every convicts to have the same hair styles and headress. Plus, even if they removed their hijab and turban for mgshots, do you think they won't wear them back afterward? What then...the system would have a hard time identifying them without theiir hijab or turban on? Of course not. It's clear that the reason they won that lawsuit is because it is really make no sense to ask for anything more than them revealing their face for mugshots.

Damn that’s crazy precedent. I’m all for allowing people to express their religion as long as it’s not wholly harmful. And theyre only wearing religious head garbs. The only thing I see concerning is that maybe the person has a distinguishing scar they are hiding or knowing someone’s hair color, style and length could identify them more but usually I don’t know that crimes are solved on distinguishing hair features except for those moments where the investigators find a piece of hair at the crime scene. But then again you could say “a criminal would more likely than not wear a hoodie or mask to cover their face” But then you could say “sometimes they don’t” So I don’t know. It’s a win for religious standards. But law enforcement and due process took a hit. How big I don’t know. Maybe a teeny tiny one or maybe a significant enough dent. But they took a hit.

They have the basis for that lawsuit exactly because they're in the US. Because freedom of religious expression is guaranteed by the US law. The higher level of freedom guaranteed by a country's legal system, the more it can be used to excuses people doing things that might not necessarily favorable to you and society at large. Chaos is ultimately the product of high level of freedom after all. On the other hand, the less freedom guaranteed by the legal system, the more power the state will have over everyone...which is not good. Dictatorship is what happens when a country is lacking in freedom guaranteed for its citizens. That's why, both absolute freedom and no freedom are bad. The best thing is always freedom with a good level of reasonable restrictions and limitations. Anyway, I personally don't think things like Hijab and Turban necessarily needs to be removed for a mugshot. Because they don't cover the users face at all. It's no different from mugshots of bald vs hairy people, convicts can always shaved themselves bald whenever they want after the mugshot after all...the system should be able to recognized them from their face alone, regardless of some changes in body hair details and visibilities. Face should be all that really matters for a mugshots, and with today's technology we can easily edit body hairs and accessories to make up for possible changes on the suspects style of choices.

For everyone saying that for religious reasons she doesn’t have to take it off. You must understand that the LAW doesn’t not need to abide by your practices. Other wise we would live in a lawless world. For instance I live in germany where you HAVE to register where you are living because that is the LAW. If I do not then you will get in trouble. I can complain how stupid it is because everytime I move I have to unregister to re-register at the new place.
