I wonder if the accused's lawyer would be allowed to attend the line-up and see the witness. Any lawyers out there to comment?

With todays advances in Technology you don't hear much about line ups being done like they did during the 20th century. Mostly what I see on TV especially in the First 48. They take a whole bunch mugshots (and most of the time they will have their suspect within the Collage and in Custody) and print them out, show them to the witness and say "Circle the photo of the person you saw did this crime" During these interactions, I have not seen a defense attorney representing the bad guy in those line ups. I think it's a thing of the past now. But then again the First 48 has yet to do anything with the NYPD. That I know of.

The still use them for full size and build, voice and mannerisms, as well as full profiles, side, back front... it depends on the jurisdiction and circumstances.
