There is nothing to stop you getting your own channel and getting permission from the copyright holder to play the music in the background of the videos. Personally I think it's simple, just mute all sound and put the words up on screen against each speaker along with an explanation as to why you are doing it.

@@shawncook8672 I tend to agree with @wjfOne that the LEO is not preventing anyone from video recording. What ever platform requirements to post videos is not the LEOs fault. That said I do find it childish and unrespectful, when LEOs play music on their cell phones while auditors around. In this example the way they were playing the music on the loud speaker was actually illegal. Pretty sure if regular citizen drove around that same area playing that same music at that volume they would get some ticket for noise pollution or what ever they call it.

And you are well aware that KZbin allows better exposure than a private site. He did this for one reason, to block effective exposure.

@@icecold9511 I hear you big dog! LEOs definitely know what they are doing, in theory it creates less exposure of the video. But they are not obstructing your 1st amendment. The way I see it. If I am somewhere in public and an auditor type person shows up video recording, if I decided to start playing music on my cell phone, could that person then "sue me" for infringing on his rights to the 1st amendment? I am not saying it should be OK for LEOs to do so. It should be against policy for LEOs to play music when interacting with the public. It serves no real purpose to the community. It helps LEOs to keep videos from getting as much traction on the different platforms. I am against the practice, but saying they are "obstructing" someone's 1st amendment is not a good argument in my opinion.

Cops have no jeed for any ability to play music of any kind in their patrol vehicle. They should be listening and watching everything around them. Music is a distraction and can lead to not seeing or hearing a cry for help, or a radio call out for help.

I literally heard a Sgt in an audit of Kansas City Missouri doing the exact same thing. This is the same Department that conducted a warrant and raid on a pot shop and the officers proceeded to test all of the Wares in the pot shop. And not one of them was fired. They thought they had disabled the camera system and the shop had a secondary system that caught all of it on video.

If I'm ever in a situation like this, I'm sending that video straight to the copyright owner; "Heads up. I'm pretty sure I caught this cop publicly performing your copyrighted material without a purchasing a license." He gets a copyright lawsuit, I might get a reward for letting them know. Rights owners have to defend their rights or they're void. Qualified Immunity doesn't cover Copyright claims. And no private person ever opts to pay for the full rights when they buy/stream a song.

Playing of the music during filming is illegal form of using prior restraint and or the Bane Act. It also stops people from releasing police video that has been FOIAed. It is a malicious way to block the freedom of the press that distributes via KZbin. Prior restraint is a form of censorship that occurs when the government prevents a person or entity from expressing themselves before the expression takes place. It can apply to spoken, printed, or enacted expression. Prior restraint is considered a serious infringement on freedom of expression. The First Amendment of the United States Constitution was designed to prevent prior restraint, which was common under British rule. Most scholars believe that the First Amendment's guarantee of freedom of the press includes restricting prior restraint. Bane Act A lawsuit under the Bane Act is a civil claim against someone who has attempted or managed to interfere with someone's civil rights (as guaranteed by state and federal law in the United States) through any act or acts of coercion, violence, threats of violence, or intimidation, including victims of hate crime violence.

I remember this video. He’s got a video of the same cop telling someone that they should sue the cameraman for filming, in public. This same cop detained someone and all because this guy was filming the cop said ‘you should sue him for violating your privacy’. That’s how stupid this cop is. He isn’t sorry. These sort of tactics while on duty and in uniform should be immediate grounds for dismissal. If the city councilman was not there, it would have definitely continued and that's not only an infringement on the man recording rights, but also disturbing the peace. All this nonsense because someone has the gall to record you while you're performing your duties to the community? Whomever is in charge of these officers needs to be on notice that if their officers are found to be pulling these same tactics then they too shall be terminated. Enough with the stupid games and unlawful acts by those sworn to protect and serve our communities. They should and must be held to a higher standard and if they cannot be professional and behave in a lawful manner, then they should not be allowed to serve in such a capacity.
