UPDATE: After this video, when the Supreme Court first heard James’ case in 2020, the government asked the Justices to recognize a new immunity under a law called the Federal Tort Claims Act. If the Justices approved this immunity, the door would be slammed shut on James’ case. Upon IJ’s urging, the Court declined to recognize this new immunity and instead asked the 6th U.S. Circuit Court of Appeals to hear IJ’s arguments about why it should not be applied. Unfortunately, when this case was remanded to the Sixth Circuit, it cited outdated case law to apply immunity and let the government off the hook. I truly understand what James king is going through. I myself is dealing with the same issues. I been fighting my case going on six years. I was jumped on, chocked and slammed to the concrete floor at the VA by several VA police officers. I was charged with and had to go to trial and found not guilty after the jury saw the video. The police officers lied on their police report and the the video told a different story of what happen. My case is still on going. Hope the best for you and your family. God Bless.

Most likely a public defender who hasn't the time nor resources to investigate properly. If I had a dime for every time a defendant took a plea deal in case like this I wouldn't have to work anymore and can retire handsomely. Most of the time these defendants are Black and/ or Brown and for even so more overwhelmed by the justice system than the defendant in this case. Mainly because they don't have 10% of 50K laying around to post that kind of bail and have to sit in jail until the court is ready to hear their case. Meanwhile the prosecutor is building and augmenting testimony to present to the jury to insure a conviction as the cops' testimony carries more weight than the claims of the defendant. This is how prosecutors get innocent people to accept plea deals. You should study the case of the central park five to get a better understanding of this phenomena! Prisons are filled with people like this alone. The police are over zealous and yet crime still persists!

That's the reality of statism, and then having a monopoly on arbitration. They can't be held accountable, because they use the threat of force to coerce people into submission. Qualified immunity doesn't apply to doctors, which is why they carry malpractice insurance. Educate yourself before calling someone else "stupid." Those "law officers" abused their power. They beat a man because they could hide behind their badges and the prosecutor destroyed an innocent man's life. Those are examples of injustice and why the US justice system is severely flawed.

My buddy ran into a situation like this, officers gave no indication they were law enforcement they were in regular clothes and they tried to take his ID by force. He headbutt one and pulled a knife of the other.... he's in jail now for 18 years. Smh

What is disgusting about this, is that within a very short time, his identity had been known, and clearly a mistake has been made, but there is no intent for damage control whatsoever. This innocent person, minding his own business, is zero threat to anyone, so why is he still in handcuffs when he is being given first aid. They should have been taken off immediately. Then, the system does absolutely nothing. During the time that he is taken to the hospital, the command chain should already be aware that they have f$%£ed up big time. At THAT point, senior officers should be making their way to the hospital to manage the situation, and try to resolve things as best they can, BUT not only does that not happen, but he is then booked in, and held as a prisoner in jail, AND has charges put on him?!?! No sense of justice, no common sense, it is a disgrace to law enforcement and the whole department, the officers concerned, and the senior management team should all be investigated for wrongdoing. They are all to blame. Nobody should be treated like this for having done absolutely nothing wrong. The fact that these idiots didn't identify themselves, the fact that their initial encounter, they just took his wallet from his pocket, is where this all went wrong. They are 100% to blame for the shit storm that then ensued. Appalling.

Yes, they took that young man to the hospital IN CUFFS! Some of the people commenting on here must have just watched this as their first video of police brutality. I have watched several videos where the police have taken people that they have paralyzed to the hospital, dragged them in to the hospital because they WERE paralyzed and could not walk; flop them into wheelchairs - which certainly could have heightened the damage done and cuffed them to the bed - WHILE their victims continuously tell them that they cannot feel their legs. NO ONE should be treated like this/beaten like this, regardless of the crime/non crime.

The DA should be sharing a cell with them. There needs to be legal consequences for using prosecutorial power to try to cover for police screw ups (e.g. prosecuting someone you knew was an innocent victim in hopes they'll take a plea deal thereby undermining any potential case they might have against the police).

A friend and I were arrested, 17 years old, parking lot at the beach, we had been surfing all day, had many witnesses, accused of breaking into cars, only things we were carrying was our boards and a towel, the descriptions they had were completely different from us, I kinda freaked out and tried to push one officer off me, he slammed me so hard to the ground he broke my wrist. It went to court, thankfully the jury found us not guilty. My father gave the thought to our attorney to sue , we were told, if we did to expect our families to be harassed, traffic tickets and such, my father said “sounds like gestapo tactics, lawyer said yes. Me too. I had a bad situation too. Though not as bad as yours it sounds like. I got arrested for DUI. ARRESTED. At 3 o'clock in the afternoon on a Monday. He said I failed the sobriety test. I'm over 40 but look high school aged but this guy committed to the arrest. He pulled me over to arrest me. I guess I looked like a young guy who he could get something on. So...a "failed" sobriety test and my 0.5 clonazepam prescription in the truck sealed my fate. Correct pills in the correct bottle. All legal as can be. But the bottle says "may cause impairment." The kicker is...I DON'T DRINK. Ever. I got no ticket for any sort of moving violation so his whole reason pulling me over was bogus from the beginning. Blood test comes back 0.0 or whatever. Just like I knew it would. Doesn't get me all those thousands of dollars and time and job back. Cops can kiss my ass..

I had a violation myself. But learning what I watched today I'll never plea again to something I didn't do. I just kicked opoied addiction from a methadone Maintenance program and was just starting to experience sober life and cause I didn't Wana spend 6 months in jail I pled to a lesser charge. Never again will I ever do that. The justice system is fkd.

I'd like contact him as I'm going through a extremely similar situation. I have a Federal case but need help. Can someone contact. I also have 360 video of the police illegally entering my house and pulling me out . As well as IA REPORT finding them at fault of course they minimized their actions calling not following policy but I was essentially kidnapped then tortured. Unfortunately not all my stiff is on tape but sane scenario they are trying charge me for fake crime to prevent other lawsuit. Please any help. God bless I wish I could talk this guy as I feel a bond just based on the similarities.

This story really hits home for me. When I was a young man in college a similar thing happened to me. I committed no crime and had witnesses with me but it made no difference. I was charged with bogus charges and told by my court appointed attorney that even though I was obviously not guilty that the court would take the officers word and the best I could do was accept a plea deal. I had to do 3 months probation for the crime of being a young man. I hate cops to this day.

Same thing happened to me 7 months ago. I was just sitting in my parked car at the park and the cops opened my door and told me to get out. I said why. They didn't give me an answer why. Then they grabbed on to me to force me out. They charged me with resisting arrest. The video is on my channel. The charges are still pending but I will not accept any plea deals. I am going to take it to a jury trial.

That the Cop accused me of having/carrying to go sell for Crack at a building 2 blocks from my home.. I Almost Killed a man that Night. Another time..getting off a Train a Cop pulled my ham radio from my hand.....Saying i wasnt allowed to talk on the Police band...i wasnt..but was talking on a ham band..for 2 weeks the coo kept following me in a cop car with some 12 channels as he Tried to claim i spoke on police bands...... I called the FCC and they levied a 20k fine against the cop who then was fired.. Another time i was stopped by 4 cop cars..on a Bus Forced off the bus..i demanded the bus stay there as ineeded witnesses...cop claimed i looked like a bank robber..thankfully the bus driver and 2 other riders told the cops they were nuts Oh this was all from bayonne police department Another time My cousin was pulled over for a broken tail light He was taking me to a surprise bithday party.. I suspected where my cousin likely was taking me But the cop questioned us both seperately Since my cousin knew where we were going..but i didnt. Well took 45 mins before they let us on our way and offered zero appoligy ( i forget which nj police dept he was from ) Another time When i was 16 and just moved to a new house in long island.... I walked across the entire town..checking things out But was followed by a cop for 3/4 the time.. Finally just 2 blocks from being home.. I was Stopped and Grilled by a cop ( didnt have ID at 16 ) and cop refused to let me bring him to my house to prove where i lived ( that took 30 mins before he released me ) Was in garden city long island So..i typically now get in a cops face as soon as a cop gets in mine and they can go F themselves Thankfully the city i live in now...the Cops are actually very polite and do their job well... Unfortunately.. i still get run ins with other cops So i hear you Quite well

Same here. I've had too many incidents to tell all the stories though one where I nearly died. I was picking up my GF from work one day when I saw a car pull in. Its super suspicious because its 2 am and I know her ex just got released from jail. I drove to a 3 story parking lot 50ft away and watched them. When the three dudes in the car got out they opened up the back seat which had the windows covered and had chains and restrains tied into the car floor. I then got a call from my gf saying her ex was threatening her on the phone. I then immediately called the police and grabbed my gun I told them a kidnapping and shoot out were about to happen. The police came and created a cordon but didn't enter the lot or strip area we were in. They just let it happen. He eventually took my gf.hostage and got in a shootout with me. I eventually got in my car and pulled out of the lot right in front of them. Right as j was about to pull my gf into the car and start shooting the criminal the cops rammed my car. He ran. But j stayed and surrendered. The cops didn't chase them and let them escape instead their cordon collapsed around me. They dragged me out of the car and beat me leaving me in cuffs in a dirty alleyway with my gf for 2 hours. The guy was on work release from jail and they never followed up and arrested him. I nearly died that night from their incompetence. In another instance I had planned to meet with two friends from highschool. Little did I know they had turned into junkies. They robbed me and tried to drive away. I was stuck in the passenger window though and they dragged me down the street. I was able to grab my money and fall off the car but the junky driving slammed into a parked car while trying to squeeze me between the two. The cops eventually showed up and assumed it was a drug deal gone wrong. They coached an old lady (who wasn't even there but lived on the street) into being a witness for them, claiming that I had gotten into the drivers side and knocked TBE driver unconscious. I got charged for that Even though I was the victim. I even brought my pair of pants in that had drag marks on them from the incident. The court didn't care even though I had witnesses. I've had officers blackmail me too. I truly do advocate the policy of public hanging for 99% of police

I waited for 2 hours. they took my cuffs off and found my cigarettes a couple feet away and decided to charge me with that ! After being super cooperative! They told me to pay a $30 fee and then wanted me to drive 3 towns over for a “tobacco safety class” and guess what! The tobacco class wanted another $30 for their bullshit 3 hour fucking “class”. Wanted to ask us minors if we smoke marijuana like it’s funny or something. All the other kids raised their hands thinking their funny. I was like who’s businesses is that? I was only 16. It's true that it happens disproportionately to black people. For instance, a black suspect is two and a half times more likely to be shot, than a white suspect. Some of this can undoubtedly be explained by direct racism. Either by individual officers, or even entire police departments, institutionally. Much of it isn't. For instance, black and latino suspects have a much higher incidence of being killed by black and latino officers. The major factor involved is poverty. Generally speaking, if you were born and raised in a poor area, you're more likely to be involved in criminal activity and much more likely to be stopped by the police, whether or not you're involved in criminal activity. Now, while more white people live in poverty, overall, a much higher percentage of the black population live in poverty, compared to the percentage of white people living in poverty. It's undoubtedly true that racism plays a significant role here too but so too does the political and economic system that does little to help people escape poverty. The main focus being on Wall Street and big business. Tl/dr - Racism is a major factor in these sad statistics but it's not always the direct factor that people often assume it is. Widespread, indirect and institutional racism probably plays an even bigger role. Nor is racism the only factor. White peopleborn and raised in poor neighborhood are almost as likely to suffer such injustices as their black counterparts and overall, a lot more white people are killed by police than black people. I absolutely support the BLM movement but the issue is more nuanced than most people acknowledge. Accountability of officers, for any actions, must be the priority atm. Though it's good that the debate has spread to look at racism in society as a whole. It's also encouraging that the protests have been by people of all races and have been supported by the overwhelming majority of Americans. Perhaps the times really are 'a changin'. :)

The problem is that QI isn't actually Qualified ("not complete or absolute; limited.") anymore. It has basically become blanket or absolute immunity due to the self-defeating standard applied by the courts. There can't be a prior ruling finding the police violated someone's rights if all cases arguing this very thing are automatically dismissed under QI. The original intent of QI (immunity that is actually qualified) was to prevent honest mistakes (you arrested an innocent person but there was good cause to believe they were guilty at the time) from resulting in a lawsuit, not to protect cops who act with reckless disregard for the rights of citizens. The correct standard to apply would be something like would a reasonable person believe that their actions violate the victim's rights.

@@vincente515 It has nothing to do with the union if they "Acted under the belief that they were doing their duty" they can't be prosecuted - but that only saves them from the assault and the injuries. Everything afterwards is on the officers, the department, and the DA (city/county). EVERYONE can be sued for their part after they got him into cuffs and realized they f-d up. The officers for the false arrest, slander, libel, filing a false police report, perjury (because they filed the report and testified under oath), violating his civil rights, and sued civilly for the lasting harm done following the bad arrest, and the physical and psychological injuries. The department(s) can be sued civilly for providing an environment without sufficient oversight, leading to the false arrest, the wrongful prosecution (being charged and taken to court to hurt the person), slander, libel, perjury, violating his civil rights. The DA can be sued for wrongful prosecution, slander, libel, negience - unless he can prove that he had less than zero knowledge of the police doing what they did. If he had knowledge, charge him/her as an accessory after the fact, and for conspiracy to violate someone's civil rights using the power of their office. Basically if any of those cases are won - the whole system that was in place at the time of the arrest comes into question. If this arrest was bad, how many others were bad? If they lied under oath this time, for how many other cases did they lie under oath? If the DA conspired to charge the guy to protect the police/city/county from a lawsuit how many other times did this occur? We've seen recent examples of a crime lab getting caught fudging numbers, leading to hundreds of cases being tossed over YEARS. This is how far the damage to a government goes when the basic duties and police procedures are either ignored or adulterated by a few bad apples. Soap-box time.... When law enforcement loses the moral authority, they no longer have any authority in the eyes of the public (laws only mean something if the people believe they do, kind of like the value of money that way). We should just start dealing with this stuff the right way. Make it so a "dirty" department just can't legally operate anymore by making them uninsurable (one serious miscarriage of justice? Now you have to carry a $1Billion bond, for each officer on your force) - and all officers/staff of that department shouldn't be allowed to hold a job in anyway related to law enforcement or public office - and just to drive the point home, make the shutdown of a department a firearm disqualifying offense for all members past and present. The good cops will more or less get rid of the bad cops or they'll be branded bad cops for life. I generally like and respect cops, (have a few and have had more cop friends) but dirty cops and hiding one's mistakes by making 10+ other mistakes and ruining people's lives, is childish and demonstrates the lack of character and integrity required to continue in that role. We also need to, as a society and wider acknowledgement among law enforcement departments, accept that shooting a cop in plain clothes who fails to identify themselves >>effectively

They were hoping that he would plead out, which means admitting guilt, in order to avoid a possible decades-long prison sentence. That way, because he would be admitting to something he didn't do, his guilty plea would prevent them from getting sued for brutality and violating his rights. It needs to be pointed out THAT THE PROSECUTORS WHO BROUGHT THOSE CHARGES ARE JUST AS COMPLICIT AND SHOULD BE CHARGED ALONG WITH THE POLICE OFFICERS. Best defense is a strong offense. I thought trials including accused police misconduct were supposed to be held in a different court system with district attorneys that don't have a predicated relationship with local police. 4 or 5 officers in a town like this was what half the police force a third? Anyone ever watch Robinhood the animated movie when they were little? This abuse of power is something we all knew about we just felt powerless to change. The people of this country are behind you, so please don’t hate the country-the people that perpetrated this crime against you and got away with it no longer serve our country. They made a conscious choice to not serve our constitution ignoring their oath to do so. I have taken multiple oaths to protect and defend our constitution and country and those oaths don’t have an expiration date and it appears that my service may be needed again soon. I will die for what this country is supposed to be in hopes of making it just that. I love our country, the many different and beautiful people of it and the freedom our Constitution provides to all those people.

That's right. They go ahead and arrest you, put you in jail (unless you can afford the bail ) and you have to defend yourself otherwise you serve the sentence they hand down. So yeah, guilty until proven innocent

Did you watch the video and pay attention ( listening to what is said)?!?!?! He didnt spend " years" in jail, it was six months and one day in total, ok, dont try to invoke people's emotions by misleadingly stating an amount of time spent being punished for something they didnt do.

Loath though I am to admit it, seeing abuses of power and miscarriages of justice such as this (particularly within a country I had so fervently hoped would prove itself one of which I could be genuinely proud) has a great deal to do with my being rather comfortable with the notion of taking the law into one's hands for the purpose of ensuring justice is served correctly.

Qualified immunity must stop, arresting someone after you find out they are innocent to cover up a mistake they made should have repercussions. And perhaps this will stop.

I know the feeling. I had something similar happen to me. I got arrested for having a scanner hand held radio on me that I had a license to have. I got assaulted, my car impounded, arrested and thrown in jail and I never broke any laws. The cops didn't know the law and it cost me big time. I had never been arrested before and I learned a lot about our broken legal system. This can happen to ANYONE AT ANY TIME!!

@@hongisland3016 I experienced the same kind of brutality, spent the night in jail, went to court but gladly the judge believed my version. That was in my country, not the US, but this doesn't prevent me to notice how the mainstream media pays more attention when it corresponds to the narrative that police brutality is about race, so to incite resentment and violence to make black people vote Democrat.

@@marioques there is lot of political issue with police now one main police Union endorsed Obama at least 1 time and now endorsed trump 2020 if they wouldn't kill people tho this level of riots wouldn't be happening Around last 10 years is when it became police against the people vice versa and seems it will only get worse there has to be some debates in each community more unless we vs them, and those things nothing good will come out of divide and conquer So I wonder if those riot groups will question Obama for getting money from police union its in both parties talking points is police against minorities last 10 years on and off

Sometimes cops don't read miranda rights also The thing is if it happens to innocent then sometimes it creates people to get vengeance and hate the system, Its hard to forget injustices when it happens to ourselves and to those close to us takes brave and strong people to overcome and to forgive I don't know what the solution but I think police and other with community should be discussing this more in schools and at youth level wje people get to teenagers then more temptation and peer pressure I don't see where I lived no cop around smiling or saying hi, I'm just telling you what I see in kak parts of United States new York, california, in small states police don't abuse power as much form what I observe

I’m in Germany on my lunch break and I just watched this video. I am certain that there isn’t anything I can write that hasn’t already been written in the comments section. Hearing him recap his nightmare really saddened me. What happened to him can easily happen to anyone regardless of whether you are law abiding or not. It is beyond mind boggling that he was actually charged after HE was assaulted. Wherever he is now, I hope it helps him at least a bit to know that many of us are truly on his side.

@@EdwinMartin No one should feel too cozy about where they live. I'm seeing things fall apart in the US, it can happen elsewhere, and is happening in other places. It happened in Germany in the past. Complacency is dangerous. The only defense is an educated, and politically engaged populace.

There has got to be tens of thousands of innocent people that got convicted and sent to prison by the dishonest and corrupt cops and prosecuting a-holes. Law needs to hold them accountable. We would have at least two prisons FULL of lying cops and lying prosecutors just from the last 10 years. And 20 times that of innocent victims of their corrupt system are rotting in jail when they should be trading places with the dishonest criminals that put them there in the first place. I want to see more lying prosecuting a-holes sent to prison. Into the general population.

The sad thing is it has nothing to do with mistakes. You think all of those agents looked at that guy and then looked at the photo they had and no one said a thing??..It's about politics and power. Whatever they feel like they need to do to get what they need, that's what they're going to do, because there's nothing that can stop them. My father was just as corrupt as these shitbags, haven't spoken to him in over a decade but every time I see a video like this it gets me fuming. I do agree with the comments about filming though. There are fewer places to hide their behavior in the modern age and im sure as times goes on it will get worse for them, thank god. What people need to remember is: It doesn't matter what uniform a person wears, how many medals they have from whom, who praises them, they're still human. And humans are corruptible.

A similar happened to my son. He went to his driveway at midnight to look a work he had done on brakes of his vintage car. As he took a knee to look (with a can of beer in his right hand) he heard some yelling, then a large growling dog approached him, then two men in dark appeared with a gun and shot him.... luckily it was a taser. They took him to jail where he stayed Friday, Saturday and Sunday night because he did not know he could make a phone call. They took him to court on Monday and he still did not know why. After court he was able to call me to say he way in jail. OH MY GOSH!! Asked him why but he said that he just got the police report and would call me to let me know after he read it. So what happened was the police were running (up our hill) trying to find a suspect who earlier ran from them. In the report they said they saw the suspect crouched behind a "hulk" auto. I guess they don't know a classic vintage auto. And further they spotted what they thought was a gun in the suspect's hand (the beer can). So they tased and cuffed. Anyway, the attorney I hired said he should take the plea because a jury would likely not go against what the police had to say.... which was, they tased because my son did not raise his hands fast enough. It too had major effects on my son's life. He was in the middle of getting his degree and put him behind. Later he was stopped by police but tried to run to a camera location.... and was further charged. Long story anyway, but lots of PTSD and effects that make him unemployable. At least he finished his college degree. He says he cannot be near an officer because he gets very upset and thinks they will arrest him because he looks nervous.
