Ha ha ha! Silly me. Way back when ccw was first introduced in our wonderful state, me in my ignorance took my dd214, along with my orders for my combat infantrymans badge, silver star, and thrice awarded Purple Hearts, from my couple of tours in the beautiful country of Vietnam, to my county sheriff’s office. I was informed in no uncertain terms that all of that was not good enough. I would have to go through the ccw school, ect, ect, blah, blah, even though MOST of the states around us considered military experience more than good enough. I then, in no uncertain terms, told them where they could shove their ccw, went home, put my pistol in my pocket, and went on my merry way. I will continue to do so, law or no law.

The Ohio AG guide states, “This publication is intended to provide information regarding Ohio’s concealed-carry law. It is neither legal advice nor a substitute for legal advice. If you have questions about how this law applies to you, consult an attorney.” My question has there been any adjudication or case proving Ohioans can now carry with a loaded firearm while in a vehicle? Or which statute specifically mentions qualifying adults transporting a firearm in a motor vehicle?

@armed2defend2 жыл бұрын
Good questions. So Ohio doesn't specify how to carry in the car except that you'll want to maintain access control. So on a seat or in a cup holder with just you in the car is ok. But if anyone else is in the car then you're not providing access control to that gun. The other issue is if you hit your breaks hard or if you get into an accident. The gun will fly in your car. My attorney would say that guns are drop safe, but not accident safe. So a gun hitting the dash at 50 mph might go off. As far as printing while carrying. Ohio has open carry so as long as you are carrying in places that allow for open carry you'll be fine. I don't know how the grey area of carrying open in a place that serves alcohol or other places that concealed carriers get exceptions could be interpretated. The constitutional carry laws are specific to being able to conceal carry and not open carry. It is a grey area that someone will get the chance to fight in court one day.

@armed2defend2 жыл бұрын
Thank you for the comment. I don't know of any standardized training for the officers on how to respond. I never hear of one. If a department has a policy then it would be specific to that department. From my experiences, I was always thanked and the officer moved on to giving me the ticket, lol. I was never asked any details about the gun. In 2008 Ashford Thompson, a licensed concealed carrier, shot an officer 4 times in the head after being pulled over for loud music. He was convicted. Officers must always be ready to respond and they appreciate citizens making stops easy and safe.

Can your ccw permit class be completed before an individual turns 21 so that the application can be submitted asap?
@armed2defend Жыл бұрын
Yes, you have up to three years to apply for your license after taking the course. So in general as long as you take it when you're 18, you could still apply for your license when you're 21. I heard of sheriff's who allow you to apply for the license before you turn 21 so that it will be ready on your 21st birthday. You can call your county or any adjoining county sheriff concealed carry office to ask them if they allow for you to apply before turning 21.

The law never mentions a need for a holster. A gun magnet isn't a good option for me. I have kids and I don't take my gun off me and put it unsecured in my car. I know I'll forget about it and leave it for anyone else to find it. If I forget and leave my wallet, phone and other important things in the car, then I know I'll leave my gun. @armed2defend2 жыл бұрын
Hello, thank you for the message. Constitutional carry was a huge change in Ohio's laws on how you can transport a handgun in your car. With that you have to make sure the information you're reading is up to date. Here is the quote from the Ohio Attorney General Concealed Carry Law Manual. "Transporting in Motor Vehicles You may transport a loaded concealed handgun in a motor vehicle but are not permitted to do so if you are under the influence of drugs or alcohol. Motorcycles fall under the definition of motor vehicles. Thus, the same requirements apply to those who carry a handgun while on a motorcycle." www.ohioattorneygeneral.gov/Files/Publications-Files/Publications-for-Law-Enforcement/Concealed-Carry-Publications/Concealed-Carry-Laws-Manual-(PDF).aspx Constitutional carry removes the need for a CHL to carry a loaded concealed handgun in your car. I hope that helps.
@LambosOnly2 жыл бұрын
2 questions, 1. does this change the transport laws for firearms in vehicles? 2. I heard under Federal law and Constitutional Carry that you're not allowed within 1,000 feet of school property while carrying. Is that correct?
@armed2defend2 жыл бұрын
Great questions. As far as transporting, you don't need the license anymore for a qualifying adult to carry a loaded handgun in the car. You still want to maintain access control of the handgun. From the updated Ohio Attorney General: "Transporting in Motor Vehicles You may transport a loaded concealed handgun in a motor vehicle but are not permitted to do so if you are under the influence of drugs or alcohol. Motorcycles fall under the definition of motor vehicles. Thus, the same requirements apply to those who carry a handgun while on a motorcycle." For your second question, the Ohio attorney general didn't include a school zone perimeter beyond the school's property line in the update. I know it was something they were looking in to so they must have determined that it didn't apply. But they don't explicitly state that it doesn't apply. From the updated Ohio Attorney General: "Forbidden-Carry Zones Under the law, you may not carry a concealed handgun into the following places:... School safety zones A “school safety zone” includes a school, school building, school premises, school activity, and school bus. For purposes of this statute, a school includes everything up to the property boundary. However, if you have a CHL, you may have a concealed handgun in a school safety zone if you leave the handgun in the motor vehicle, the handgun does not leave the vehicle and, if you leave the vehicle, you lock the vehicle. Permitless carriers are not allowed to carry a firearm into a school safety zone. Doing so is a felony under state and federal law."

@armed2defend2 жыл бұрын
Thanks for the question. Good news, Ohio doesn’t have a gun registration so it’s not an issue. When you buy a gun at a dealer they run a background check on you but there isn’t any way they can register a gun in Ohio. When you sell a gun, you don’t have to notify anyone of the sale. I always prefer to do a transfer at a dealer for a record of the sale to protect me from any legal issues. And to make sure that the person I’m selling it to is legally able to own it. But it’s just a background check the dealer does.

@@armed2defend I haven't seen the signs. From what I briefly read off google it said Walmart no longer allows open carrying but it allows conceal carrying if you have a license. My question is do I need to have a license to conceal carry in Walmart or is it over written because of the new constitutional carry laws in Ohio
@armed2defend2 жыл бұрын
@@masonhill4065 good question. In Ohio the store has to notify you since it’s private property. The notification has to be such that a reasonable person would be notified. Typically a sign on the door. Having to google and search for their policy would be unreasonable. Now if they told you personally that you couldn’t carry because some how they knew you had a gun, then you wouldn’t be able to carry. Does that help? It sounds like you’ve done your research, but I just want to point out for others that there are some no carry areas in Ohio that wouldn’t be obvious. Like places of worship. By default you can’t conceal carry in them. The attorney general does a good job explaining it.

Does the “ qualifying adult” goes to some data base or what?
@armed2defend2 жыл бұрын
There isn't a data base for qualifying adults. It is just based on the adult's background. Say someone is pulled over the officer asks if they have a gun. Yes, they have a gun. Then the officer runs the driver's license and sees disqualifying charges/convictions and knows that the person is illegally carrying since they aren't a qualifying adult. Or if the person is charged with something else and the prosecutor digs deeper and finds the disqualifying charges/convictions. To help determine if you're a qualifying adult, check out the Ohio concealed carry application and answer the questions. If you can truthfully answer them, then you're a qualifying adult. The Ohio attorney General's Law summary also gives some information on it. You can see both of these here: armed2defend.com/resources/after/ I hope that helps.

Regarding the comments carrying into a Meijer grocery, and no gun zones in general, my local Meijer has a sign posted that shows a pale blue/green silhouette of a gun with a black circle and and a strikeout through it. It is tough to spot while walking in. As I understand, Ohio laws require a certain standard that the no gun signs need to meet. I interpret the sign as not illegal to carry concealed in the store based on their sign presentation. Am I misunderstanding the something?
@armed2defend2 жыл бұрын
Great comment. Our Meijer has the same sign. It’s small but I didn’t miss it when going in the first time it was posted. Ohio actually doesn’t have a standard for the sign. The AG gives an example of a sign but states that there isn’t a specific sign requirement. Typically an item with a circled strike through is universal for not allowed. 🚫 So a reasonable unbiased person would conclude that a gun with a circle strike would mean no guns allowed. A reasonable person familiar with Ohio’s concealed carry laws would understand that if a sign is posted, then you’re not supposed to conceal carry in that store. Being a responsible concealed carrier, I of course think that it is ignorant to have that restriction. Best we can do is to push back by sending communications, giving negative reviews (very powerful), and not shopping there. Meijer is my favorite grocery store. They have more unique speciality items than then the other stores for our food allergies. But we’ve mostly haven’t shopped there since.
