A Brampton, Ont. woman and her husband say they’re out more than $22,000 in unpaid rent and can’t occupy their only home because a tenant has refused to leave since he was asked to move.
“We need to occupy the house,” said Yvonne Folkes, describing months of frustration attempting to get access to her home again.
Folkes and her husband rented out the semi-detached Brampton home, their principal residence, to Hermann Founiapte Dakono for about $3,200 a month. She described him as a “good tenant” until she says he refused to move out and abruptly stopped paying rent or paying for some utilities as required.
Folkes and her husband had been living temporarily at another nearby home with other family members and the rent was being applied to their monthly mortgage payments, she said.

The landlord agreed to rent the house to the Tennent and then tried to evict them less than a year later; the Tennent in this case is arguing he has an agreement to rent until his home is finished being built, the landlord had no right to come and kick him out. Also, just because he's not paying them doesn't mean that he is living rent free, the rent goes to his lawyer to be put in an account that the lawyer keeps in trust. The money will go to the landlords when the judge hearing the case makes a decision about it. The decision will probably be that the Tennent is allowed to live there until his home is built, x number of months, and all the back rent will be paid and then he will have to pay his rent on time each month until he moves out. This is called fair; in what world would a landlord be able to arbitrarily put a Tennent on to the street?? I'm glad we live in Canada where Tennent's are treated like human beings and have proper rights. You're welcome to not live here if you want to live somewhere that allows slum lords, feel free to leave anytime.

When you sign a the rental contract, the rent is due at the first of each month if the rent is not paid, you are in breach of contract!!! my family has lived in Canada for 153 years, but yeah, I’m ready to leave👻

Yep, that's why I'm not renting out either. Would rather not deal with the stress and heartache and financial loss or damages. House insurance is much more expensive to have renters as well, as well as increased taxes, etc. No thank you. Until this system is fixed, I am not renting to no one.

After the landlord threatened to evict him without warning and several months before his own home was finished being built, which would have put him out on the street with nowhere to live. After that he probably withheld rent; which means he has paid his rent into a special account that is held in trust by a lawyer, the lawyer will give the money to the landlords IF the judge tells him to do so.

Why do you feel sorry for the rich land lord? They obviously had enough money to afford a second home somewhere else; this rental was just their own get rich quick scheme, they should have done more research and should have known that you can't just evict a Tennant because you suddenly decide you need the property back, that's basic info to everyone, what was their Tennent supposed to do, be homeless until the house he is building is finished? He indicates in the video that the homeowners were made aware that he needed to rent their house until his was finished, so what's their problem now. He clearly stopped paying rent because they were trying to evict him, not the other way round. spot on - the problem is with the authorities that have enabled and even encouraged tenants to default on rent. if the authorities did their job efficiently, this would not be happening. there will always be exploitative people and the system is meant to manage them not enable them.

This landlady is lying and global tv news is aware. The landlady gave the couple a little notice to move while the lady (the wife) was admitted in the hospital sick while pregnant. They pleaded with her for some time for them to sort them selves out given their situation because how it it possible for them to move while she was at the hospital fighting for her and her baby's life. The landlady refused. They attempted several times to pay her rent, she refused (to make it seem like they didn’t want to pay, there is proof of this as well)and now claiming the couple didn’t pay. Prior to her refusing the rent, they had never missed a payment (All documented as well)She randomly walks into their home and brings her friends to Harass them. They brought signs and wore mask to hide their identities while protesting infront of the house. All this is recorded. Police have been called several times due to the landlady coming by anytime she likes along with her friends to harass them. There hasn’t been any eviction notice given. This news outlet is also trash. The couple gave them all the evidence and explain what was happening and they omitted all of it. Another news broadcast came and once they heard the couple's side and saw evidence they didn’t pursue it because they understood the landlady is lying . Shame on her and shame on this news broadcaster. The landlady is telling liesss. It is sad that people don’t do their research and are easily manipulated by the media.

Which landlord in their right mind is going to refuse to collect over $20,000 in unpaid rents. One key think I notice is you mentioning the spouse being hospitalized, but the guy said they were building a house that’s they didn’t move, not because of health concerns.

That's not really the reality. They both have power, and the rights the tenants have are necessary. Issue is, there is manpower shortage and these cases have a massive backlog. You shouldn't have to wait year or more to get this addressed, either as renter or landlord.

You should not be allowed to rent out homes in canada. Serves you well. Buy a home and live in it. Invest your money into other productive ways. Dont hog real estate like in a monopoly game. It is a parasitic way of growing your money. That being said, i don't support the squatters in this clip and i know full well i would be tempted too and purchase multiple properties if i had the means and try and make a living that way without working. A friend of mine went through the same thing in Toronto. He owned 3 rental houses with 9 units in total. 1 tenant refused to pay. This happened during covid and the tenant even had a job and was collecting the cerb pay. Took over a year to get her out. He then sold off all his properties to single families due too stress and frustration with Canada's lax laws that protect fraudsters, removing 9 units off the rental market. Well done Ontario. He, aswell as myself have moved our housing investment money to Georgia where this crap isnt tolerated by the courts there. Well done Doug Ford. Get your money out of Canada.

@@MrJesseray06not true. It’s been like this for well over a decade although the last 5 years the backlog has gotten exponentially worse, but bc of volume of cases. It’s an archaic system. There are also loads of bad landlords. If you’re an investor, you should have done your homework. Ontario had some of the worst landlord tenant laws anywhere. People only hear about the money, not the hassle.

Background checks don’t mean anything, it’s a waste of time. I would be going to the present place they live for an inspection and a chat with the owner. It’s not just the rent but ensuring you have tenants that treat your property like a home. Insurance does not cover damage from tenants even though you pay special insurance for your rental units. Insane

When I was younger, my parents rented our basement apartment out to a family. One day the tenants kept us locked out of the house. Another tenant set fire to our kitchen. Another one stank up the apartment with such a putrid smell, and left it a nasty mess. After seeing the horrors my family went through, I would never rent to anyone, ever.

I was going to leave a similar comment. Just go into the unit and sit on the couch and start watching TV. Use their bathroom, start cooking food in their kitchen etc. If they haven't paid rent then it doesn't belong to them anymore and you can use your property again.

many popular investors openly state they would never invest in ontario homes as their squatters rights are far worse than NYC or any other place for that matter, as someone who owns property and leases it i agree. lost 10,000 before taking it to court and waiting a year. i lost another 9000 in potential revenue.

@@tidbit1877 You cannot stop paying rent at all. Rent cannot be withheld just because you were given a notice of eviction. Rent can only be withheld if the landlord does not give a standard lease, for a maximum of ONE month. This tenant is withholding rent for over SEVEN months. You believing a lying tenant is ridiculous. He said, "She told me she didn’t want me to pay". That's a straight up lie. The global news article states that the neighbours said they see many people living in the house. So the tenant is obviously renting out parts of the house to others. Of course someone like you, are simping for a bad tenant.

This landlady is lying and global tv news is aware. The landlady gave the couple a little notice to move while the lady (the wife) was admitted in the hospital sick while pregnant. They pleaded with her for some time for them to sort them selves out given their situation because how it it possible for them to move while she was at the hospital fighting for her and her baby's life. The landlady refused. They attempted several times to pay her rent, she refused (to make it seem like they didn’t want to pay, there is proof of this as well)and now claiming the couple didn’t pay. Prior to her refusing the rent, they had never missed a payment (All documented as well)She randomly walks into their home and brings her friends to Harass them. They brought signs and wore mask to hide their identities while protesting infront of the house. All this is recorded. Police have been called several times due to the landlady coming by anytime she likes along with her friends to harass them. There hasn’t been any eviction notice given. This news outlet is also trash. The couple gave them all the evidence and explain what was happening and they omitted all of it. Another news broadcast came and once they heard the couple's side and saw evidence they didn’t pursue it because they understood the landlady is lying . Shame on her and shame on this news broadcaster. The landlady is telling liesss. It is sad that people don’t do their research and are easily manipulated by the media.

...this happened in my neighborhood....took forever...months for neighbor to evict squatter who refused to pay rent and lived rent free until legal action was done and sherriff showed up....word was the guy did that under his name, then wife and adult kids would each do this repeatedly

If he refused to pay the rent, then he is a tenant not a squatter. As far as I know in BC for example, a squatter could criminally charged and removed by police. But if the landlord misled the police and told them a tenant is squatter, the Landlord is the one who should be charged

Increase supply so that people want to rent out their place. You do that by streamlining eviction process, late or no payments should affect your credit score, no payment in 3 months is automatic eviction... Thank goodness for 'Openroom'

I am also a tenant for last 4 years, just once i paid rent on 2nd of a month instead of 1st and I felt guilty and apologized to my landlady several times over the next few days. I worked night shifts at a warehouse lifting heavy stuff and incidentally I slept the whole of 1st and left for work at night and forgot and that happened just once, ever since I started having reminder on cell phone and sometimes I pay the rent on 31st or 30th for the coming month instead of 1st. Not every one is bad but people like these discourage the owners to rent their place to even those who are honest.

Non payment of rent, beyond a month, without out written consent of the owner/landlord should equal automatic eviction, shouldn't even be needing to go to tribunal or provincial tenancy board. And yes, I am a renter, and this behavior makes it harder for me an my peers to find decent places, and means there is less turnover as a result of people deciding not to rent out their places, and drives costs up because landlords have more choice in who they rent to, and need to cover themselves from situations like this.

@@fantasyguru26 I was illegally evicted from a basement apartment I rented for several years by the landlord who claimed he wanted to undertake major renovations. He didn't even serve me a N13 form. He wrote a letter. I went searching for another place and found one with the condition I had to move in at a certain date. I already paid rent to my landlord for that month, so had to ask for my last month rent deposit and one month's rent compensation for the "N13" eviction. The landlord refused to pay me either. I filed T1 with LTB and its taking 8 months to get a hearing.

Garnish wages to pay landlords. We have a family responsibility office for people who refuse to pay child support, same deal for tenants who refuse to pay, however we also need rent control on all rentals.

The laws don't protect either lanlord or tenant. It doesn't protect renters in some cases either, when lanlords are slumlords (this is clearly not the case here, though, that man is clearly a con artist,) and tenant hearings take forever. The system needs to do better

My friend was in the same situation and someone adviced her to call Hydro and the City to turn off the water and electricity services. She got her house back a couple months later. No unpaid rent recovered btw.

I am not defending them as I only know what the news story has reported. But i am a highly paid tech worker. Never ever missed my rent or destroyed or done anything bad to any house. I grew up in a very decent family and i would not feel good to behave dishonestly in relation to my obligations. BUT YET every single landlord i have had except one has tried to screw us over. So when i hear these stories i automatically just think there is more to it. Because of how houses have become purely an investment instead of a place to live many landlords are extremely cutthroat and actually dont care about the tenants or the rules which are in place to protect tenants. Or even their own obligations. It usually turns to this when they are trying to jack up the rent or sell it

So imagine you're a developer, and the GST credit on purpose-built rentals gets you considering building a rental apartment. If you built 100 units to rent at $2000/month, and 20 tenants decided not to pay you for a year, that would mean a loss of $480,000/year. Wanna build more rentals? Do ya?

Block the doors and windows. Cut off the power, cables, heat, gas, water. Waiting flr him/her to leave and reoccupy the house. Do not expect the help from Canadian police. They are useless these days.

@@DriveLapseCA You mean a system that works, this specific case is already to be decided in less than 18 months according to the video. That is extremely fast. The guy seems to have had an arrangement to rent their house until his was completed; seems to me that the land lords are the ones that have suddenly tried to evict him because they changed their minds. Good thing this guy is protected by our great laws here in Canada and the landlord was not able to just put him out without cause. You shouldn't cry too much for these wealthy landlords, they clearly had the money to pay for TWO homes and tried to profit by having this guy pay them more money to live in their house than it costs them to maintain. Greedy, greedy, greedy.

My father-in law has this issue in Mississauga the dudes name is Paul Lopaz doesn’t pay rent and won’t leave even had to put a restraining order on the tenant but can’t get him out

You mean being an owner of multiple homes and profiteering from higher than usual rents is risky? Another "poor landlord" story by disgusting Global News If you watched the video then you know that this case is going through the proper legal channels and the proper court is about to make a ruling on it. Why do you feel sorry for the rich land lord? They obviously had enough money to afford a second home somewhere else; this rental was just their own get rich quick scheme, they should have done more research and should have known that you can't just evict a Tenant because you suddenly decide you need the property back, that's basic info to everyone, what was their Tenant supposed to do, be homeless until the house he is building is finished? He indicates in the video that the homeowners were made aware that he needed to rent their house until his was finished, so what's their problem now. He clearly stopped paying rent because they were trying to evict him, not the other way round. I'm glad that in Canada we have strong Tenant rights and a proper legal system so that your landlord can't just put you out on the streets. Shame on Global News for constantly doing these "poor landlord" pieces, shame!

You have to evict someone legally. If its taking way too long because LTB is crazy backlogged, that is issue. The laws in place if enforced efficiently would work. If the system backlogged like this, you have people who can manipulate it. In truth, landlords manipulate it constantly for financial gain also.
