I think the reason the detective asked "why" is because he was upset at the prospect of this grieving father being put in prison for the rest of his life, further traumatizing his fucking kid. And 99 percent of the time he'd be right, but luckily this dad managed to get his revenge without actually making anything worse.

The cop who asked why was actual a friend of Garys, and would play cards with him regularly. So in that moment he saw his friend who was already in a dark place basically signing his life away, when he had a wife and kid at home who needed him

I feel so sorry for the dad because he had to do that. It's exactly what I would do and I'm sure most people in that situation given the chance. And obviously I feel so bad for the son who had to not only go through the original hell but now has to grow up without his dad around. As for the worthless nothing that got killed he got exactly what he deserved. My only issue with that is how he didn't suffer. But that's just emotion taking over and ultimately just being taken out with a shot to the head is the way to deal with a nonce.
