OPP say they're now conducting mandatory alcohol screen during every traffic stop in the GTA in an effort to keep impaired drivers off the road. OPP say impaired driving collisions and charges are up nearly 30 per cent compared to the previous five-year average, with the highest increase in the GTA. Refusing to provide a breath sample to police is illegal.

Enable police bullying.....impaired driving stats are higher in other parts of Ontario than toronto. The city of toronto which includes the toronto police servies have applied to legalize drugs lije B.C. to help impaired driving in toronto. Thanks Toronto Police Services. Watching this cop and the ctv staff thinking this is a great thing and actually laughing about it just shows how media is working with police to take more and more of your rights away. Lawyers and citizens should get together and start a class action lawsuit to stop this. If drunk driving is a worse problem then how about augmenting the punishment. We are considered guilty before innocent.

What really needs to happen is that each and everyone of the OPP must be tested for alcohol prior to their shift in order to make sure that this Province is safe because we obviously know that they can’t be trusted. Of course I was flying down the 405 at around 200 kph and they couldn’t catch me and I was able to gobble down a whole liter of Schweppes liquor without them catching me until I pulled over at the LBCO for a refill. Talk about a nice drive…

Not a lawyer but any charter violations concerns? Can someone help me understand how a breath sample would be considered a reasonable search for someone being pulled over for let's say following too closely? A blanket approach to screening seems to be overbroad IMO

I've never understood. Police must articulate their grounds for stopping a driver in order to have their evidence admissible, but somehow it's all right to stop vehicles all day during the R.I.D.E. program at Christmas. I'm all for getting impaired drivers off the road but I don't understand the difference.

Once this is challenged to the SCC I'm sure they would come to the same conclusion. I have a feeling that won't be too long.

How are they going to guarantee that they are using clean plastic nozzles to do breath testing? Are the officers hands clean? Will they be willing to do hand hygiene before using it if asked? What if they run out those plastic test nozzles on the road? Is this stuff going to be individually wrapped in plastic? I mean, I think we can all agree that we wouldn't want anyone shoving unsanitary things this into our body. And we are told that we have no choice or face a "serious charge". Sounds like a massive human rights violation and a gigantic lawsuit if anyone gets a disease, half beaten to death from refusing due to asking too many questions and angering officers or sexually assaulted from this.

Absolutely!! I've been posting the same concerns. This could potentially be extremely dangerous. A cop at the side of the road is not going to take the same care with sanitation as say a dentist before shoving stuff into your mouth. Try proving weeks or months later that you got a disease from a roadside breathalizer test. No thanks.

The progression to a total police state continues. More and more laws ignore the presumption of innocence and need for probable cause. This is absolutely ridiculous, no different than demanding ID from anyone walking down the street regardless of whether driving "is a privileges". @@ivonmbuyamba3190 That’s sort like some sort of fudged numbers. South Asians most don’t drink because of religious reasons, the ones that do go out get smash and does a lot of damage. White Canadians have higher percentage of alcoholics thus part of their culture to be piss drunk. But how many of them drink and drive knowing what they know. It’s more of a duty of care for other people and morals. Immigrants definitely have less morals than few gen Canadians. I have friends in all race and all walks of life. East Asians seem to be the most model citizens. Blacks a lot of them just gangsters but don’t drink much. There you can call me out on stereotyping. But there is some facts in this. Everything is culture and acceptable in their own culture.

My concern is someone sticking a plastic straw on a machine that had been used previously by someone else and hands not washed by officers … and what’s the cost of the replacement plastic? I thought we banned plastic straws in Ontario 😅 the spike in impaired driving is most likely due smoking and gummy bears than alcohol. No thanks.

Absolutely not, the courts will hold that person to the wire and pins unless their rights have been violated or the ceiling of the time has expired which is the only two options in getting off on charges, part of the job is already done mentally with holding the person accountable in hearings and trials within the 18 month period, its a easy win in most cases for the crown so they hold on the cases like these as if it was super glue.

Justin Trudeau introduced the legislation in 2018 Under section 320.27 of the criminal code, police officers can demand that any lawfully-stopped driver provide a preliminary breath sample to test for alcohol provided that the officer has reasonable suspicion that the driver has alcohol in their body.

They're right when they say refusing to give a breathe sample to Police is illegal, but that was only when they had probable cause that you were impaired and refusing to give a sample. If you're pulled over over nothing that relates to being impaired in any way, then you have every right to refuse it. One of the reasons the impaired driving is up is because we now use camera's for red lights and speeding instead of Police. The lack of police pulling people over since camera's now do most of their job is a reason more people drive impaired.

You are not allowed to refuse whatsoever, regardless if the traffic stop had nothing to do with alcohol. Most drunk drivers are pulled over for a different infraction anyway

"It'll be a new mouthpiece" ...The new mouthpiece should be removed from the protective cover in front of the driver in order to prevent potential contamination and provide a degree of assurance to the person whose rights are being violated.

so public safety ministers know where people start drinking and driving from pubs and bars . let them get behind wheel go crash ? . or stop them somewhere else ? why not check drivers out side pubs and bars before they get behind the wheel and drive off . hire more police . there will be more police jobs .one police officer out side every pub and bar ? to prevent ''DEATH ''. and there is no procedure of law that is keeping an eye on off duty police officers going to pubs and bars get caught and letting each other go . who watch the watchers ?

let's see him announce how he's going to be doing mandatory breath testing at all TPS Divisions, Districts 1 through 5 @ the start of all members shifts especially mornings let's see how most TPS members respond. Let's throw in City of Toronto workers and oh yeah all local 183 construction workers , Toronto Fire throw them into the OPP's breath testing crusade as well. 😳 Obviously this OPP member is suffering from accident PTSD and it's marring his judgement where he now believes/assumes that all drivers have the potential to be like the alcohol related accidents he has investigated. Maybe he's due for some type of medical leave? 🤔

On one hand: I appreciate the thought to keep all safe. On the other hand: We are making a gross assumption that all officers are good, honor the badge/authority, believe in serving to protect, and will not take advantage of this. Wrong assumption. If you give officers more rights to incriminate, then we citizens need more rights to protect against false incrimination and abuse of power. It happens. Let's see what happens now.

If they were to lie and say you failed you would be required to go back to the nearest detachment and provide a sample which all detachments are on camera the instrument test results are all recorded

​@stevelarge5215 Do you see how absurd this response is? The root of the problem continues to exist in the lack of trust in officers. Period. It is very simple. If you change the laws for officers to enforce, change the laws for citizens for protection too. Balance. There seem to be zero laws against officers falsifying information. Zero. Just recently was released "updated laws" where upper management can now place officers on leave without pay. Why did this take so long? Officers are employed by the citizens, by the people. Perspective.

They have three governing bodies their own professional standards, SIU and OIPRD along with the courts if they were to falsify the evidence which their is no way they could due to the recording mechanism of the instrument plus it’s another officer that would be doing the breathalyzer test at the detachment.

It has not been working because the root of the issue with law enforcement is that there are zero repercussions for their actions. There is also zero testing and measuring along the way with how mentally, emotionally and intellectually suitable they are for the job at hand. Then to add to all of this. The true root to all of this is truthfully two-pronged, before it reaches the officers. 1) Government legislation. Yes let's continue to legalize everything and encourage escapism. Lets ensure no access or enough resources for mental wellness. Lets waterdown the values of canada. I am keeping things very general here as it would simply be too lengthy . 2) No inspiration towards leadership, self-suffiency, optimal wellness from early on. School, at home or society. I understand that officers wish and need to use what tools they have access to to assist in reducing alcohol related incidents. But in ALL of this, we are not addressing the root causes. And a maneuver like this, without equally protecting the people. Corrupt. Because it is not just the officers, it is the lawyers, the judges, the system. We need to address the root causes.

What happens when an officer (off duty or on) is stopped and does this test and is found to be drunk??? Does the 'we look after our own' policy still stand or will they be charged like the rest of us??? We know cops like to drink and drive to...plenty of videos on KZbin of that. Dont' mind this but waiting for policy makers to grow some balls and start holding cops to the same standards as the regular citizens of Ontario. Won't happen cause politicians and those types don't like to lose their 6 figure jobs but hey, wishing thinking never hurts right?.
