Reference against Qazee Faez Essah To the judicial council of Pakistan: Due to his controversial reputation, Judge Qaze Faez Essa should not serve as Chief Justice or judge in any court in Pakistan or anywhere else in the world starting September 20th, 2024. I urge the United Nations to step in and safeguard the civil liberties and fundamental rights of the people of Pakistan. Even in his capacity as Chief Justice Qazev Faiz Essah, he is unable to oblige himself to be part of the bench when a party presents a motion suggesting his potential bias. The adjudication of that motion must take precedence. The simple act of lodging such a motion establishes a scenario that may result in the disqualification of the judge, thus precluding him from participating on that particular bench. When a judge, such as Waze Faiz Essah, is alleged to display bias, any party involved may formally petition for the judge to withdraw from the case. This request, known as a motion to recuse, can be initiated by numerous parties, including the plaintiff, the defendant, the defense counsel, or the prosecutor. Judges may be compelled to recuse themselves in several situations, including but not limited to: 1- Having a personal bias or prejudice regarding one of the parties 2- Possessing individual knowledge of disputed evidence 3- Previously serving as a representative for one of the parties involved in the matter 4- A former colleague acting on behalf of a party in the case 5- Being a significant witness in the proceedings Even without genuine bias, the mere perception of bias can jeopardize the judicial system's integrity. For instance, should a judge's relative stand to benefit financially from a case's outcome, this could result in a conflict of interest. In light of the ongoing controversies concerning Qaze Faez Essah, he is legally barred from functioning as a judge in any court across Pakistan and, consequently, in courts around the globe. The concept of "recusal" is similarly applicable in instances where a party suspects judicial bias, leading to a recusal motion. For example, if it becomes known that a close family member of the judge could benefit financially from the outcome of a case, the judge may confront conflicting loyalties that compromise their impartiality. In such circumstances, an attorney may submit a motion for disqualification, advocating for the judge's recusal. Recently, a legal organization successfully appealed a case where a motion for disqualification of the judge was initially rejected, prompting us to file a Petition for Writ. 8 imrandoo judges did see yhe constitution and concluded verdict on suppositoons. They had mothing to favour Niazi and that is why over 2 months took them to conclude. SC is only to adhere to constitution instead of throwing it into dustbin. What these judges had been doing in the past. In love of Niazi they went to any extent to facilitate him even his party was not claimant in reserved seats case. 😅😅😂😂
