How about those who are the victims of employment crime? Technically they have also "overstayed" and are out of status, the question is does USCIS factor that into consideration. More so for those individuals who went the extra mile and reported their shady employer to the DOL and where the DOL has determined that their employer was in fact AT FAULT. The DOL has a responsibility to go after US citizen employers reported to them who break the law... and yet they don't. Similarly USCIS should offer these victims of employment crime who wish to remain in the US the option to get a green card, or if they have been in the US 20 years or more, apply for citizenship. It makes no sense whatsoever punishing those who came here legally, have been living here for decades in many cases, working hard, highly educated, have never had trouble with the authorities, yet cannot live a normal life separated from the rest of their family because of some "technicality". These are circumstances beyond their control and not out of their own fault!!! ANY intelligent politician/lawmaker should understand that. It is sad and unfortunate that rather than offering help the finger pointing and blame is all these victims receive. It is remarkable how carelessly the DOL will sweep a case it gets under a rug and let that employer off with just a slap on the wrist. No trial, no punishment, no fine, and worst of all for the victims, no way in hell to get back what they lost and live a normal life again. Welcome to the United States of America!!!

After 20 years in the USA...you should've found an American to marry. 😑
@Luscious31742 жыл бұрын
@@rockon8174 How do you know I didn't already come here married? What's your suggestion going to be for those people - go have an "anchor baby"??? It's precisely this kind of thinking that makes the problem worse, and no, you're not helping!!! The bottom line is employers across the USA aren't being held accountable - something that has nothing to do with a person's "marital status" or their academic qualifications. And it's because as a result of that many innocent people get ruthlessly taken advantage of and exploited at their workplace, especially immigrant workers because of their status and limited options. That's another reason why the DOL absolutely needs to take these complaints a lot more seriously and get tougher with employers who knowingly break the law. Understand as well that "changing jobs" is not an easy thing to do or even an option depending on the visa/permit you happen to have - J1,H1B, etc... all tie you to that one employer.

Forget about getting pathway to citizenship, current situation is making crucial even to survive, beggers are not choosers this is a situation of asylee- as one of my best friend who filled asylum feels that way, that's cruelty isn't it? Very sad. please don't do this to asylee. Have some mercy please, Especially asylee who stay here in USA are already going through lots of stress staying away from their family even though if it is by there own choice. please don't give them more hard time, they need peace no pathway to citizenship ✌️🤗 please.

You can apply for TPS if your country of origin is on the list; apply for a GC if you are married to a US citizen or if you have a child born in the US, apply for a GC when he/she turns 21 but make sure your name is on the birth certificate and that you have been a part of the child’s life; which every parent should anyway.
