This is like watching Show and Tell with 5 year olds. They are totally unprepared for court. They should be suing their son who continues to invite the defendant over to the house.

The parents have HUGE blinders on and are in denial about their son. How is it that the defendant has to be held accountable but their son shouldn’t be held accountable????? The dad keeps saying “these people” and I don’t think they include their poor manipulated son in that group.

@@GarretMartinn In this situation, there is no way through the justice system to make her accountable. And that is the parents fault, 100%, because they are blind to their son’s problems. They are paying a big price for not putting their feet down a long time ago. They didn’t get to this point starting in 2017.

This was so fascinating -it continues to shock me how parents allow their kids to keep doing wrong over and over yet they first look to blame others for all problems when they arise. And as always thank you for all the work on ur channel in providing us with great content.

I'm a big Judge Judy fan, and I know that's "reality TV," but there are so many parents that refuse to place blame on their children (no matter how old), and will look to blame anyone else they can. This is just another example of that going on. It's such a huge problem because this "blameless generation" has zero accountability and reek with entitlement.

Kim, it is the parents who keep cuddling the adult children, and it never stops when they are grown and the keep doing the same stuff. And with the girlfriend, their son, is responsible for the damages to the property. Denial in parents is HUGE!

And then the judge blatantly said to the girlfriend that she caused these people to lose faith in the justice system!!! She doesn’t have that power over the courts. That’s where all respect I had for the judge went out the window. And to say that she is the wedge that’s dividing Jordan from his family?! No, Jordan makes his own choices and chooses to be in a relationship with this woman just as much as she chooses him. His parents just enable his bs and refuse to accept truly how big of a problem it’s come out to be.

Their son sounds like a real winner. "He's our son he pays us rent when he can." And also, "He knows he can get away with it..." You can't be an enabling parent and a landlord that drags people into court. Everyone of course but their son. The girlfriend didn't sign a promise or a lease, and she's not family. The one who owes is the one they continue to enable.

The correct answer is, he’s my son and there is a lease. PERIOD!!! He pays me when he can??!! The dad had the nerve to say that out loud!!?? Not even embarrassed!!?? I’m glad my parents didn’t raise me like these parents.

THANK YOU! I found the wife to be far less credible than Ms. Mott. Drives me nuts how all these people just want to judge her. I mean, clearly she made mistakes. But Jordan is the real problem here.

@dhec34 from what we saw here, I agree. I suspect the judge may have had more insight into the situation. But one of the reasons I don't watch much small claims court and never landlord-tenant court is I find the judges make an awful lot of assumptions about the situation, and despite the dad's little pity party, landlords almost always come out on top.

@@ericpl7227 Not really, no. While there's a little more nuance to it, I believe what you're watching on tv there is a form of ADR; as in the Judge is acting in the capacity of a mediator, on camera. Still, "once a Judge always a Judge" they say; despite being retired from the bench and serving as an arbitrator on camera, she's still a Judge at the end of the day (just not a practicing judge). Her advice is solid and, unlike say, a Judge Jerry type mediator (RIP), it's based on years of good law/legal experience. Make sense? 🙂

People rely too much on their phones. Oh, I can just hand over my phone. Pictures? On my phone. Video? On my phone. People have lost their ability to rationally think that they need to have tangible documents and evidence to hand over for courts. Adding onto these people trying to cover for their idiot son who can’t seem to keep himself out of trouble and the girlfriend probably isn’t much better, because she would date a man who can’t keep himself out of trouble. Everyone here is just a mess and needs to get their lives together, including the parents. The parents are probably just holding the house so the son didn’t lose it to some other legal problems. Considering they said he bought it with an ex girlfriend, I’m guessing she may have had some claim to it until he signed it over to his parents, possibly.

These parents are so deep in DENIAL! It’s beyond sad. Not to mention the fact that they’ve totally thrown their own son COMPLETELY under the bus by revealing that he’s VIOLATED the current TPO he’s under MULTIPLE times. I mean…😮 & the dad is so indignant acting..he’s continues to blab throughout the whole hearing. HE is the one who continues to infantilize his child. The PROJECTION is palpable.

yeah, I don't think she's wrong for wanting an estimate for damages she's offered to fix, which the parents should've obtained for court anyway. I disagree with the judge's idea of randomly sending them money, that's not gonna make them like her more and it's a bad reason to make payments. She deserves a proper paper trail of the amounts. But if she really believed she wasn't primarily responsible for the damage, she should've said, "no." The parents' decisions are questionable to me as well - at first I thought it was nasty to force their son to remit ownership of his house to bail him out of jail, but it sounds like he wasn't able to maintain the mortgage, so I get it. However, if they decide to sell it, that should be between them and their son and whether he's able to pick up the payments again, not just to get her out. This girl ought to move on, let it go at least for the time being, and let them sort out their family issues by themselves.

The defendant did not understand the word negligent. The judge didn’t even bother to make sure she understood, what she did was repeat the words exactly the same and the defendant still didn’t understand. What the judge should have said is did you intentionally or “accidentally” do anything to the truck. Also, the judge gave legal advice to the plaintiffs.

Thank YOU! Yes - that is exactly what I thought - then the judge proceeds to apply her OWN PERSONAL moral judgements and advice, based on her "feelings?" Oh, HELL no - if she had judged against Ms. Mott, I would help Ms. Mott file a complaint, and appeal the decision, all pro-bono, just to see that sanctimonious judge put back in her lane.

I didn’t like this judge. Telling the girl not to speak but allowing the parents to ramble on was disrespectful. Just because she’s young doesn’t mean that she’s automatically wrong. Mostly, the parents need to cut the apron strings for their son.

I thought so too, she was being a little smart with her about the answer she got, but in all other court's I've seen u are allowed to explain yourself, so that was a little unfair.

I love the split screen idea! The close captioning is also perfect! I am hard of hearing so although the audio is crystal clear I deeply appreciate the hard work you performed. Regarding the court subject there IS a lesson to be learned here: Do not rent out to family or friends (spoken from experience). It rarely bodes well.

His choices of friends and girlfriends caused these problems. If my sister comes to my condo and trashes it, my landlord isn't going to go after her. They are coming for me! Also, I have a lease so it's in writing they will come after me. I'M RESPONSIBLE FOR WHAT GOES ON IN MY HOME.

so what? that house was given to the parents by the son. they got a free goddamn house. So the F what if 3 doors, a window and basement carpet got wrecked by him or his B. Sounds like they are trying to keep their son out of trouble. He's on parole, and they probably think the girlfriend is part of the problem that got him there. They are trying to control him remotely with predictable results.

As the judge pointed out, they do not have a lease with their son and he “pays when he can.” There must a lease to evict someone. They will have to do with their son what the did with his girlfriend. That can take time, though I think a parole officer might be able to move it on a little. A sad situation. I am so lucky my daughter has grown into a responsible adult with and executive position and is a fantastic mother to my twin granddaughters. It breaks my heart to see other families suffer like this. No one said anything, but I am willing to bet there are drugs or alcohol involved. Parents don’t have as much control over how their kids turn out as people think they do. I know a family with 5 kids and all but one have grown into responsible adults. One daughter seems to be attracted to bad guys-she is married to an ex-con who is in jail again right now. All you can do is love them but NOT enable them. They have to accept the consequences for what they do. No one can make them. Some will eventually catch on, many won’t. Most of the people in prison have some very disappointed parents and other loved ones.

Parents cannot get a trespass order.. what they should do is make her son sign a lease with stipulations no one can live there unless he gets approval from them

My friend owns a property that her son is leasing and at one time he had a girl that lived there that whenever she got mad she would breaks windows.. she tried a no trespassing on her but because he lives there he has to ask for it

@@Indygrandma56 wait how do you think apartment owners prohibit specific individuals from entering the property? no trespass arent that hard to get or uncommon. it is far easier to get a lease that prohibits it for sure but i dont think your initial statement is actually true. least not in my state.

Yeah, they should have made the son sign a lease that would have prevented then the things they complain of now. They let the son live there with no limits they could enforce in court. Now they want the court to remedy their negligence. Not going to happen. Maybe it's not strictly speaking impossible, but for a landlord to get a writ of trespass on someone their tenant has invited to the property is a very, very long stretch. Suppose it were a shopping center and the hardware store tenant has a customer who comes in and while in the store somehow manages to bust an exterior wall. Is a court going to hear the landlord who seeks a trespass order on that person? No chance. It would grant a writ to the hardware store, but for the court to allow the landlord to dictate who can and cannot go into the store is to invade the "estate" granted to the hardware store by the lease. So, as a practical matter, I think you are on the mark: no way they are going to get a trespass order.

I’m so confused…the parents came to court to get her to pay for damages but didn’t bring any proof or even a cost of the damage. How do they suppose the judge set an amount for the damages that sons gf would owe? I guess she was suppose to guess…the parents can’t be that senseless…omg

Yeah I disagree with the judge saying that Ms. Mott can just go to the house and be like "here's a check for $100". Both she and the parents need a paper trail of exactly what is damaged, an estimate for repair, and proof that she gave them money and that money is going towards paying for a broken thing, otherwise they could just spend her money on vacations and say she still hasn't paid for whatever it is.

I totally agree with the judge. There is no way to prove when this happened or even who was responsible. What Ms Mott could do to mend fences is…. Instead of going to the bar and spending $100 with the son is instead take that $ and give it to the parents or better yet make a trip to Home Depot with her boyfriend and buy a door and go fix it! Next paycheck do the same thing and fix another door or a door and window! Ms Mott is choosing to do nothing except sit on her ass and gloat!

The judge is following the law. The judge knows exactly what’s going on. The plaintiffs came unprepared and the defendant is just an instigating, manipulative individual who should realize that she is not wanted by the owners of the home, but knowing that she still acts like trash.

YES - she didn't even try to understand what the girl was saying, and was really out of her lane in this trial (read my other comments - for detail if interested). Judge is lucky she didn't find for the plaintiffs, b/c defendant had (and may yet still have) grounds for appeal and sanction, depending on specific judicial oversight in that jurisdiction. Refusing to recognize and allow defendant to explain why she didn't understand how to answer (she clearly didn't know the definitions of all of the words the judge was using, and issuing moral judgements and feelings in an admonishment based on same from the bench and horrible advice based on it - holy crap was this judge out of line!

I don't get why the judge is lecturing her to pay the parents anything. She damaged her boyfriend's property and her boyfriend forgave her for it, as he was entitled to do. The parents took ownership of a damaged property. That's their problem.

I clearly see what's going on here- who wouldn't- but, that said- these parents infuriate me. 1. Don't come to court whining about how much you work, with no pictures, no estimates, nothing. When she started crying and talking about how she works 80 hrs a week- she was being asked about getting a picture off her phone- think about that, takes less than 5min. to do and no real effort at all. The estimate they say they couldn't get because of recent hailstorms- sounds like they went to one body shop to me- probably where they always go, and they were busy- so they just gave up. But what's the most infuriating- the fact that they know their son is the real culprit here- he's the one who chooses to be with this piece of lying slime, he's not paying them rent accept "when he can"- which you can bet is very seldomly, and it sounds like he cut this girl off in their truck trying to prevent her from leaving- which proves he doesn't give a damn about mom or dad or their property. If he's so sorry they felt they needed to make him give them this property before they would bail him out of jail- then crack the whip on the titty baby and make him grow the hell up. But don't stand there and say "There's absolutely nothing we can do about it..." when the reality is, you know you can do something about it- but it means doing it to Jordan, your son- and you don't want to do that.

We as parents of adults have to live our lives respectfully in order to get the respect we deserve. If I rented my house to my son on a "pay when you can" basis, he would not respect that decision by me, and he very well may take advantage. I believe, after seeing this entire hearing, that this problem is ultimately these parents fault for not demanding the respect they feel they deserve from the girlfriend… by allowing their son to walk all over them.

I think they used his (probably multiple) DV arrest(s) as a way to get the house from him so they can get her out. They see her as the problem. Yeah son we'll bail you out the third time IF you GIVE US YOUR HOUSE. Evicted her. Then got mad he kept seeing her. Why are they asking for damages that occured before they owned the place. That's like me going to my used cars previous owner demanding them fix it. When they got the deed it was as is. Dog piss basement, broken doors and all. 😂

But, November 2021 he and MsMott got in a vicious disagreement and he assaulted her, held her with a weapon and his parents got him outta jail. I think they required the deed to try and force him and msmott apart. Maybe they thought being the owners would make her go away and that'd keep their son out of more trouble.

Even if someone was not able to have a lawyer in the physical court room, getting legal assistance with preparing evidence, how to subpoena witnesses, or even legal advice on if the case is winnable can all occur outside the courtroom.

I can't find a list of states that do/don't allow lawyers, but all the law websites I'm looking at right now say that some states (or many/most) do not allow lawyers in small claims court.

⁠@@jmash7751 Having the right to counsel is indeed a right in CRIMINAL court, where your freedom is at stake. Civil court is different. Depending on the amount of money involved (like the Johnny Depp/Amber Heard trial where it’s millions of dollars on the line) you may be allowed to have counsel, but I’ve never heard of or seen someone being represented by a lawyer in small claims court.

The parents need to make their son grow up and stop enabling him… they keep blaming her for literally everything. It could be true.. but I have a feeling Jordan is just as responsible for the damages as her. They can’t force him to do the right thing.. they can’t force him to stop seeing her even if he could go to jail for doing so. I have a suspicion that they are still going to continue to let Jordan live there basically free instead of selling the property and making their son take responsibility for his own self.

I really like this Judge. Both sides needed a lawyer, to let them know what they needed and what would be admissible. That man blaming others and babying their son needs a wakeup call. They need to hold their son accountable. If they don’t they are going to continue to have problems with everything he does. He’s talking about “these people” not being held accountable, yet they continue to take up for the son. So, there you go.

Unfortunately, (or fortunately depending on your perspective), litigants are explicitly prohibited from legal representation in most jurisdictions for small claims court, in court. Now, nothing prevents you from consulting one, but you cannot be "represented."

@@nymetsfan912 The judge was most straight in asking about the truck damage. She asked Ms. Mott at least three times, a simple yes or no. The judge used simple terminology so any person could understand. Some judges use legal terminology that is difficult to follow. She took the time to inform the defendant about the law. ​@@dhec34I get you, I also thought it was a bit looney to suggest Ms. Mott should just send them random money to proverbially mend a fence that's beyond repair. I think Ms. Mott has the right to an estimate if she does intend to help cover damages, as well as payment receipts, for her own legal protection. But ultimately, I think it only hurts her own future to give them any money if she feels she wasn't responsible for the damage, and she ought to stay away in order to prevent possible harm to Jordan's future if the parents are willing to take away the equity he's established in the house so far just to get her out. I know they can't support him forever, but they already made him forfeit ownership of his property and now they're probably going to earn money from the sale, and he may have no legal recourse due to signing the quick-turn deed. I hope they consider that they may be destroying their relationship with their son when they weigh their decisions on this.

I like it. Its great being able to see both sides as it happens. I also like this judge. She’s able to have empathy yet still “teach” the law and tell them what is lawfully right and wrong vs what people think is right and wrong.

Hard disagree here - according to both sides, the GF did offer restitution, and the parents ignored her. IMO, then it's on them. GF then being advised sending money to them anyway with no paper trail or estimates or anything is actually piss-poor advice (and frankly, may be actionable) much less coming from a freakin' judge!

This court is located in a very nice part of Wisconsin, close to the Minnesota boarder. I like this judge, she listens to both sides. The plaintiffs are blaming everything on the defendant and not blaming any damage on their son. People should read the rules and what they need for proof to present to a small claims case.

I really admire this judge. She is highly articulate and she separates the issues clearly and concisely. She is balanced and fair, yet quick to be assertive when necessary. A very intelligent and skilled person 🙂

The judge’s frustration was sobering. She did what she was required to legally while offering both sides a look at the other side’s issues and pretty much making it clear to all of them what most of us would have wanted to say to these people

I like the split screen, you can see everything going on. Thank you. Don't go to court without proof. Print up photos etc. Sad for the parents who are getting screwed over.

I noticed that when the judge asked about a lease the father said the son doesn’t pay rent. Well, leases cover much more than the rent amount including terms for maintenance and damages. Don’t let anyone live on your property without a lease or some sort of written agreement!

No good deed goes unpunished....but, it is time to get tough...due to necessity. Stop enabling your son, make him grow up, move out and sell the house. Unfortunate, but true. Eventually, the son will regret his actions.

Seems like they're trying to control their deadbeat son's life, and he's just not having it. The defendant may be a wedge in the family, but the son put it there, and continues to willingly put it there. They're mad at the wrong person. She's not coercing him, that's laughable.

Thank you for posting this one. The man said that he's learned a lot from this case. Me, too. It's sad & frustrating to do what you think is the right thing to solve your ptoblem legally only to find out-- too late while sitting in court-- it doesn't help at all. I have the feeling that both the son & that girlfriend will continue to be problems for the parents forever & the parents will be resentful forever. Not a good way to live.

Or they didn't have evidence cause they're trying to sue someone whose not liable for the damages? Like the judge said their son is the issue and the only one they have legal grounds to actually sue. He was the tenant, anything that happened there is his responsibility especially if its a guest.

It's also sad to go into court thinking you'll win because you're right while providing absolutely zero evidence and then whining about the system is unfair because you weren't granted judgment when you had zero evidence.

I spent decades as a commercial real estate paralegal representing landlords. There is a lot to understand as a landlord and as a tenant. The judge is doing a good job here.

It doesn’t matter that she’s irresponsible, they are irresponsible for allowing their low life son to walk all over them then, then kick her out try to sue her for everything and he will continue to let it happen.

This is definitely MN or WI going by the accent, my accent! 😂 These kind of people think the police “don’t do anything” when in fact, these are civil matters, not criminal. Ignorance on their part, doesn’t make an emergency on the cop’s part, to fix the problems that they allowed. Too bad for them.

As soon as I heard he is on parole that told me everything! Those parents are afraid to actually parent their criminal son because they don’t want him to hate them. So they’re going after the girlfriend thinking she’s an easier route. However, she’s lacking serious moral fiber herself. Also, they had months to prepare for court…!

This group is pitiful. Mom is so angry; she was incapable of listening to the judge. She was going to say what she was going to say. They were their own worst enemy. Dad was red-faced and about to explode. What a sad lot.
