Yes agreed, it takes waaay too long to get them where they need to be and it wastes an incredible amount of instructional time. Teachers need to show the child has failed every step by step opportunity to remain with typical kids in the typical setting. Regardless the deficit, danger, and obvious need for a restrictive learning environment, it must be trialed and documented in detail.

@@liliwilson4839 if only it was a matter of convincing the principal.. no one has an individual say.. federal special Ed laws mandate specific procedures take place and are thoroughly documented before the child’s team of staff/parents can make the decision collectively to change a child’s placement. See my other reply above. The laws are for student protection to prevent teachers from giving up, with hasty disregard, sidelining, and dumping of the tough kids. The problem is, the process I explained above often takes the better part of an entire school year to complete!

I don't understand why the public schools held on to a kid like this. He should have been sent to a school that would have dealt with all of his social and emotional issues and learning disabilities. Clearly the kid wasn't learning learning anything or making any progress in his academic setting. There was absolutely nothing positive going on here. So why was he kept there with everyone knowing that he was struggling so much with absolutely Everything? Appropriate placements are crucial.

From personal experience teaching 23 years, it is NEAR impossible to get a disruptive and disturbed child out of your regular classroom and put elsewhere. Parents have the final say and let me tell you, most parents do not want to deal with reality. Teachers know the absurdity of the institution and have nearly no power to change anything. It's a "public" school, and EVERYONE is allowed. It is really, really difficult; hence, I retired at 23 years. The things a teacher experiences no one would believe. You document, refer, get IEPs if fortunate enough, parent conferences, principal, AP, etc. it is challenging to have a child removed from your class, especially in elementary school. The system gives chance after chance, year after year often to no avail. I agree; it seems absurd to put up with this.

@@hondafreedom9329 I really appreciate your response and comment on this. As a parent of an autistic child I literally fought with my school district to get my child out of the public school and into a setting where he could learn in a way that was conducive to him and his special needs. A child's IEP should show growth and development and every child by law ..should have an equal right to an education... Whatever that means and looks like for that specific child. If public school can't meet the needs of the child, they aren't educating them and therefore it's not an equal education and their rights are being violated. I hope this case is a wake up call for school administrators to be doing the most right thing by their kids. They need to be making an investment in their kids... in their education... so there is a future. I am hoping that is a wake up call for school administrators as well. Administration and teachers need to be on the same page and administrators need to be backing their teachers 100%. If a teachers says she feels threatened in anyway shape or form, administrators should be doing everything they can do to protect him or her to ensure a safe classroom and educational environment that is conducive to learning. If the teacher felt threatened, I can't even imagine how those students in NC's classroom were feeling. One action on the part of those administrators to remove Nic and put him in an appropriate placement could have spared so many lives, including his own.

A dear friend of mine has a son with profound dyslexia. She fought with his school, local Board of Education, the state dept of education to get specialized education to fit his disability. When the school was faced with a potential lawsuit they agreed to giving him the help he needed. More often than not, he didn’t get the classes. He graduated from HS & could not read or write. He did some work for me & once tried to leave me a note on the chalkboard. There were some letters, no words, & drawings in the message to help me understand what he wanted to say. I called his mom to be sure we could feel he wasn’t in some kind of trouble. Turns out he was trying to say he had to go home, but would be back. This young man was the sweetest, kindest person ever. He was a brilliant artist with all forms of medium. But no one ever gave him the education he deserved. Neglect by the schools, 1-12.

What this teacher and other teachers go through is exactly what the problem is. Problematic students know there are no consequences for bad behavior. All the teacher is able to do is take notes. Teachers should have more say in removing such a student from their classroom at once. This is exactly where such a disturbed student learns that he can continue to escalate such bad behavior and the adults around him will do nothing. The school system needs to deal with such a situation immediately but they allow this to continue, leaving the teacher and the rest of the students no choice but to put up with this. Such a classroom disturbance is not an isolated incident. It’s happening every day in most schools and it should not be tolerated!

I even wrote the Board of education, cuty commissioner, state senators etc. NO HELP EVER CAME, or was available to us! Plus, they had Noone to recommend me too, for help. End result: Kindergarten she pulled out one of hef teachers hair out by the root due to her anger! Drs. diagnosed her as being bi-polar at age 9. End Result: She ended up dropping out of high school, gotten in trouble with the law numerous times, for theft, i can't even tell you how many times i was at the juvenile detention center.. Staff, Law enforcement, even the judge knew my name, NOW, she has a son, who's showingsome of the same behaviors nd has a learning disability also. Yup. I am a mom of a child on the spectrum, and encountered children with behaviors that went to school with my son in Sped. The parents were in denial, the teachers did nothing. The same child attacked my son multiple times. It took us hiring an attorney for them to move the child. Then there was ANOTHER little girl who modeled the same behaviors. Again, attacked my son and other children. The parent’s, once again were in denial. They did nothing, so we moved our child out of the classroom. I found out they push in children with severe behaviors into a mild/mod class to ensure they “don’t have a restrictive environment”, since it’s a part of IDEA (sped law), that children be kept in the least restrictive environment. What that does is affect innocent children as well. Sped law needs to change. Parent’s can be neglectful, or simply do not advocate for their kids when they’re in Sped. It’s truly sad. I have seen a lot go on, and it’s upsetting.

As a former teacher & School Psychologist I understand the dynamics that were going on between the teacher, staff and administrators. This kid was a walking red flag on a daily basis & was a danger to others. She was correct, he did not belong there. Her documentation provided all the evidence they needed to substantiate this. The burden of dealing with this student detracted from everyone and infringed on other student's rights. The amount of time required to document all of this was an incredible burden on the teacher/s and it sounds like to no avail. The school went through the motions with an evaluation, an FBA, etc but failed to utilize the data to place this student in a more appropriate setting as the " least restrictive" setting of the regular ed classroom was not adequately addressing his academic or emotional needs. Unfortunately it comes down to money & schools do not want to pay for alternative settings. This case, however, depicts gross negligence as there is a well documented history and pattern & he certainly was not making "effective progress". Unfortunately parents are not educated about getting an educational advocate or filing a case with their states' Special education board. This was a collosal failure on the school's part.

The stress of dealing with a student like this with little support is extremely stressful and a huge disservice to the other students. It takes way too long to get these kids where they need to be because they have to fail all lesser restrictive settings first. I had a fourth grader that I always said, “He’s gonna kill somebody one day.” Well a couple years ago, there he was in the headlines for triple homicide. My friends were so dismayed and said, “OMG Amy, you called it, you called it YEARS ago.” It’s absolutely sickening and devastating.

When you have a student like this and nothing works, it's just constant abnormal bad behaviour and aggression, the child should be taken away to some institution/rehabilitation centre for a while. This kind of kids don't grow into good adults without intervention. So to protect the child's peers and the society, and even the child themselves, drastic action should be taken! And that is, in my opinion, taking the child out of their home and environment, and putting them in a 24/7 place for as long as needed. Have professionals work on them and let the kid out when (if) they are deemed safe enough.

They gave him a great deal of help and support, plus wealthy, caring parents in a plush home and that is a great start in life. However, his genetics were terrible, having a violent, addict mother and probably a crazed, criminal biological father, which leads to this result in a child. Therapy cannot change the criminal genetics this kid inherited and maybe he should have been in an institution, with appropriate strategies and monitoring because he is violent and not career-oriented at all. The teacher is right and he should have been placed early on in a school for high-risk delincuents and also a vocational training school.

It is weird for me to watch this because I remember being disruptive in class too when I was in high school. My geography teacher would shake her head every time I made a rude comment, and my English teacher once said I'm excused from class afterward she told me that if I want to go to a special needs school, there is one down the road. I was acting up because my grandmother had died, in a rather gruesome way after struggling with breast cancer. I never wanted to really hurt other people though, only considered hurting myself, acting up for attention, and jokes to make myself feel better. I guess was lucky to have a father that took an interest in my education, or maybe it was online friends I made playing video games, or maybe it was because my mother didn't consume drugs when pregnant with me, but it kinda creeps me out being behaviorally similar to this monster. One struggles to think about what inhuman thoughts go inside his brain.

So what the defense is trying to say is, when a drug addict has a child she doesn’t want, abuses, neglects etc,the child should be excused when he kills , physically and mentally hurts innocent people. No, what should be done is, since birth control is free, woman shouldn’t be paid to have children . I’m a retired nurse, years ago babies were born to married couples that wanted and could afford children, not because they wanted a bigger check. The things I saw at the end of my career leads me to believe that this violent behavior will surely be repeated. People should be made to be responsible when having children, not irresponsible. Birth control is free have a baby when you are in a healthy relationship, able to financially and emotionally support the child. Raise your child don’t just let them grow.

I commend this teacher for the actions she took with alerting people within the education system as well as help specialists and other authorities to bring about the appropriate support and benefit. As a primary teacher myself of over 20 years plus teaching in the UK, I can appreciate the demands of supporting behavioural issues by going through the different outside agencies to seek the required help. The timeline attached is a lengthy process with form filling, meetings with minutes being taken, documentation and evidence as proof to support claims being made. It is critical that such paper work is kept for future reference in such a case as this and not only for end of term report writing. Once again, my praises go to this teacher who held her ground and proved herself extremely worthy.

reminds me of a kid who was in my class in fifth grade. my friends and i were sitting in the grass, and he came up to us apropos of nothing and started hurling rocks the size of softballs at us. i told the teacher, but he was on a behavior contract, so there he was, sitting in class with us, at recess with us, as if it didn't even matter. what's to be done about a kid like this? violently resistant to any kind of help because he sees no value in change. filled with outward aggression, seemingly takes pleasure in negative attention. it's perplexing. obviously, because we're having days and days of testimony trying to figure out what went wrong. i wish he'd engage in some introspection and then be candid, but he'd rather act out like a toddler. he's disappointing.

In Florida and most southern states along the east coast (so Georgia , South Carolina , Kentucky and Florida ) do not “hold kids back”. They just give them the classes they failed the next year. So example failed 7th grade math you take it again in 8th grade along with 8th grade math. However. If you don’t pass either or they forget about it and you start all over again in high school. And if you pass you pass. If you don’t then they just add in the classes per semester or give you two in a year at the same time and possibly hold you in school since you no longer have “7 classes “ they’ll make you stay 9 classes in a day if they want. However that’s not very common. But it is possible. Basically. You’re screwed if you fall behind once. Cuz. You’ll never be able to catch up.

Unless you were/are a teacher you have no idea how much time these people spent documenting his behavior. And in the meantime, with all of the resources provided there was nothing that anybody could do for him. What does society do with these people? They’re out there and they’re ready to kill or perpetrate violence. And for everyone we know about how many thousands of others out there undetected? And who’s at risk mostly? Women and children.

As a once trouble making middle schooler myself I remember doing the smallest things and getting referrals, 3 referrals and the next was alternative school. This teacher not only documented but she suggested it to the parents and was still allowed to stay in that school I was no where near as rude and disrespectful as NC and ended up at Alternative. The school system and adults failed him, the victims, their families, teachers and everyone else involved in the incident this should have been dealt with long before and just goes to show that kids do learn what they can get away withb

I think that more teachers should do this in these extreme circumstances, and there should be some sort of monitoring to check for these behaviors so they can be addressed by somebody who has more specialized training in psychology. These types of things are steps toward preventing gun violence, as well as other destructive behaviors.

Students name threw his school issued laptop at classmate/ threw laptop to the ground/ dropped on students head etc. Student tried to push kid down steps. Whole class held because Student would not stop talking. Whole class was last for lunch AGAIN because Student would not follow direction.etc” Not only are they ignoring Student’s behavior, they are creating animosity with him and classmates because they all get punished at times for HIS behavior. “He has a right to an education” is the response

Telling some children they're bad children results in them believing it and acting on it. I remember a little boy who was labeled bad by all the adults around him. If I'm being honest, he was a handful. I noticed that because I always referred to him as a good little boy, he was well behaved in my presence. He would act a certain way for those who gave him positive reinforcements. I can't even imagine dealing with a 15-year-old who was called a weirdo or bad their whole life. I'm not excusing him in the least, just pointing out how some children are affected by labeling.

I’m not rooting for the defense’s success, but these public defenders are not that good at questioning their own witnesses. The curly haired lady that wears glasses doesn’t dig deeper. She seems to not listen well and misses opportunities to get the witnesses to open up. The defense attorney is more concerned with asking her next question not what the witness is revealing.

The "No Child Left Behind" slogan was nothing more than that! I have a daughter, who still struggles today, however, she's now an adult! From the time she was 7 yrs old., I noticed her behavior nd learning issues. I tried every option available to me! There was no help available. It appeared as if Noone really knew how to help me! I even wrote the Board of education, city commissioner, state senators etc. NO HELP EVER CAME, or solutions available to us! Plus, they didn't Noone to recommend me too, for help. In Kindergarten, age 4, she pulled one of her teachers hair out by the root, due to her anger! Drs. finally diagnosed her as being bi-polar at age 9. Oftentimes, I felt helpless. End Result: She ended up dropping out of high school, gotten in trouble with the law numerous times, for theft, I can't even tell you how many times I was at the juvenile detention center.. Staff, Law enforcement, even the Judge knew my name. NOW, she has a handsome son, who's showing many of the same behaviors nd has a learning disability also. From my experience, I can tell you that, Raising a child like this is beyond stressful & absolutely draining, but a loving mother would do anything nd go nearly anyplace seeking help, to see their child succeed, I never gave up! Yes, I even wrote Dr. Phil seeking help! Please keep her nd my grandson, in your prayers 💜🙏🏾💜
