It seems, all existing members of the family,being copercener, would get equal share and if the unborn (although in womb at the time of partition) member's share is not kept unallocated, the partition can be reopened at the instance of that person left to be considered..Any way, after partition, the divided property would be absolute in nature and new succession rule would apply...

I have one question, mera ek case hein ,( muje apna grandmother ka property ka half share dad ka hissa hein voh chahiye , mere uncle ne haddap liya hein , uncle ka kehna hein mere dadi ne unke naam kiya hein , jinka information mere dadi jab jinda thi kaha nahi humse), PROBLEMS GRAND FATHER 2005 EXPIRED, MY FATHER 2010 EXXPIRED , MY GRANDMOTHER 2015 EXPIRED , mere dad ke expire ke bad , humne apna partition manga tha , dadi ke jinda rehne ke time , but mere uncle ready nahi the , dene ke liye , humare unka family ke bich relation acha nahi tha , aur mere mummy aur dadi ke bich , but mere grand mother humse ek chizz kahi thi property ka division uncle ke 2 sons aur humare bitch ( we r two brothers), ke bich honge. mere grandmother ke expire ke batt 2016 mein kaffi meatings kiye village ke badde logo ke samne , but koi support nahi milla , lastly uncle ne forcefully , grandmother ka property apne naam per kerdiya. Respected sir, agricultural land registered on my father name in 1966, when my father age 2 years only. According to register sale deed my father is fully and only owner of agricultural land. Mutation record is my father name since 1966. Property tax paid my father since major age to till now 2019 continuously. Possession of land keep my father since his major age(more than 30 years) my grandfather died 22 years before. My father take a bank loan and KCC on this land. Land possession certificate is also my father name. Now problem is my father uncle and my father brother is claiming on land duly registered on my father name, can they take share on this land

Sir, I have an agriculture land of six acres.The partition was done in my and my brother’s favor equally during 1986 with help of village accountant and tahasildar called as mutation registry.But partition has not done through deed registration nor court decree. Before june 1986 Property land was on father’s name.before 1963 it was on the name of my grand fathe who divided the agri land in between my father and and my fathr’s elder brother equally. I have four married sisters who were married before 2004 june, asking share in the above land.my father died in 1997 December.how much portion can they claim in my ancestral property. Kindly answer. I am from Karnataka.

Sir mere papa 2 bhai hain, bara bhai step brother aur chhota bhai mere papa, 1974 me saare sampatti ka batwara court ke dwara ho chuka hai, sirf ek makaan hai jo batwraa me chhut gaya, us makaan ko papa aur unke bare bhai apas me adha adha lagbhag 1978 me baat liye,mere papa ke bare bhai 1985 me adhe hisse makan ka mutation apne naam karwa liye,baki adha hissa ka mere papa ne 2005 me mutaion karwaya, dono admi apne apne hisse ki makaan ka kuchh bhag wrent pe lagae hue hain.mere grand father ne kewaala ke through us zamin ko 1950 me kharida tha, zispe housing siciety se loan lekar 1974 me makaan banaya gaya tha. Presently mere papa apne hisse ke zamin par puraana makaan tor kar new banana chahte hain, papa ke bare bhai ne mukadma kar diya, mukadma me likha hai ki---zamin ka batwaara survry knowing person ke dwara karwaya jae,aur purana makaan banane me mera presnal mony laga hai, wo de tab makaan banane dunga, sir mera maardarshan kiya jae

@@anujvigyan your uncle's case in the court of law is barred under "order ii rule 2 of Civil procedure code" Consequently you need not pay anything as a personal money spent by your uncle in the suit property... Rest being legally implications so you need to call me through the given link... contest this suit through competent advocate.. Your father has become owner of suit property since in continuous possession of 12yrs from 1978 uninterrupted... And it's time barred suit... Answers:- 1. Do one thing... Mandatory injunction suit file kr do in civil court to remove the structure (Kitchen) built in varanda... Because vranda ek common place hai... 2.
