I can understand them not wanting any characters looking too much like Nemo, but in that case they can make a fox with a different color to Nemo, like a red-orange or brownish hue, darker than Nemo's yellow-orange color. Maybe with a smaller head and larger ears, or an otherwise different shape / profile to Nemo.
